AG vs The Transfer Group

On July 6, 2020, Missouri Attorney General Eric Schmitt, announced that his office filed a lawsuit against Brian Scroggs and the following timeshare exit companies under his control.  Vacation Consulting Services LLC, VCS Communications LLC, The Transfer Group LLC and Real Travel LLC.

The lawsuit alleges that timeshare exit company employees, at the direction of Mr. Scroggs, solicited large sums of money from customers on the promise to either transfer or terminate consumer timeshare interests within one year or Mr. Scroggs' companies would buy out the interests themselves.  On numerous occasions, despite payments from consumers, Mr. Scroggs and his companies failed to provide the promised relief.

In addition to promising consumers relief from their timeshare burdens, the lawsuit alleges that, at different times, Mr. Scroggs and his timeshare exit groups instructed clients to cease making maintenance payments to their timeshares because the exit groups would cover the costs themselves.  However, Mr. Scroggs and the exit groups did not make those payments as promised.  As a result, many customers have found themselves in arrears with their respective timeshare holding companies.

On January 6, 2023, the Missouri Attorney General's office obtained a consent judgement against Vacation Consulting Services, LLC; VCS Communications, LLC; The Transfer Group, LLC; Real Travel, LLC; and their owner Brian Scroggs for failing to let consumers out of their timeshare agreements.

The defendants agreed to settle their case for $800,000.  This figure includes $700,000 restitution for consumers, $50,000 in civil penalties and $50,000 to the Missouri Practices Revolving Fund.  The judgement permanently prohibits Scroggs and the other Defendants from marketing or selling third party timeshare exit services in the State of Missouri.
