We hired this company in November of 2021 to redo our driveway. We paid them $12,000. They put a new surface on the driveway which also has a sidewalk that crosses it. It was a shiny material that gets slick. I have fallen on it my self. He has come out two times since then, most recently in June 22 to make repairs. I had a third company come out and give me an estimate, and that company said the material that was used should not be used on a driveway--it's the type of material that is used on garage floors and basement floors. The third party company said that the only way to resolve this is to tear up the entire driveway and start over with concrete which will cost $10,000.

      Complaint: ********

I am rejecting this response because:

I have numerous emails with our displeasure of his product with cracking starting 2 months after installation. The driveway was slippery you could not walk on it without falling. I fell twice and my cleaning lady fell as well as my stepson. The driveway professionals all three of them said the something that this type of application does not belong on a driveway. Our driveway was replaced last week and they put us in front of the other jobs because of the dangerous condition our driveway became. The owner was upset with me because I was angry with his service speaking up about my displeasure of his service and he said I was slamming his company and said he was finished with us and would not be doing anything more for us. I HAVE THE EMAILS saved. We paid $12000 for his product less than 2 years ago and with him saying he has no idea of what was wrong he was not being truthful. I WANT  a very negative report on his company to prevent him from cheating other people.

      Sincerely,

Hello, This complaint is not truthful as to we went far above and beyond the contract repeatedly.

i have copied & pasted here email with a response.

***** - I have numerous emails with our displeasure of his product with cracking starting 2 months after installation.

MARBLELIFE - I guess the simple question is whom said it wasn't going to crack? its concrete it cracks! With that being said what had happened was her concrete slab shifted, we did some repairs as to we always want our customers happy.

***** - The driveway was slippery you could not walk on it without falling. I fell twice and my cleaning lady fell as well as my stepson. The driveway professionals all three of them said the something that this type of application does not belong on a driveway. Our driveway was replaced last week and they put us in front of the other jobs because of the dangerous condition our driveway became.

MARBLELIFE - The Chip Polyspartic Coating with anti slip. The Coating is used all over the country on driveways, commercial & Residential pools, sidewalks, patio's, etc. with out anti-slip. We took it to the next level with anti-slip. The polyspartic coating has passed every anti slip test. Does ***** have in writing that the concrete company stated the polyspartic doesn't belong on driveways or did he get a slip test reading? Can i please see the documents? Also when she called complaining about it being slippery, we went back out to the job and sanded the coating to help rough it up and provide a anchor pattern.

***** -  The owner was upset with me because I was angry with his service speaking up about my displeasure of his service and he said I was slamming his company and said he was finished with us and would not be doing anything more for us. I HAVE THE EMAILS saved. We paid $12000 for his product less than 2 years ago and with him saying he has no idea of what was wrong he was not being truthful. I WANT  a very negative report on his company to prevent him from cheating other people.

MARBLELIFE - We were frustrated, she complains just to complain. i don't understand what she is complaining about or why she got a new driveway? She left out the fact that we repaired the cracks when the concrete slab slid, we cleaned & sealed her driveway free of charge this spring because she didn't understand why it was dirty.

      Pictures/attachments ***** sent

103058 picture. She has a chunk of material in a pictures. Where did that picture come from? To me it looks like a piece of material she picked up from when the driveway was tour out. Otherwise she would have a picture of it on the driveway like she showed the picture of the hair line cracks.

103005 - The contract clearly states 1 hour of crack repair. We spent 12 hour repairing crack when the project started, i attached picture (21760 & 21757) of the crack repair we spent 2 days repair when the slabs shifted.

150610 - 150602 -  150543 - 112959 - Coating looks great, Where is it failing. Just needs to be cleaned! We were hired to put down a coating to cover ugly concrete, that's what we did.

150514 - 150506 - This is hairline cracks, it was never stated the concretewouldn't crack.

130654 - Concrete replacement - Contract doesn't say the driveway was slippery & doesn't say the polyspartic coating shouldn't of been used. This is a company providing a bid to get a job!

Pictures a, b & c - These are pictures of removing the pea gravel coating in the beginning.

We were hired to remove the pea gravel coating and install a new coating!

      Regards

      Complaint: ********

I am rejecting this response because:

THE PRODUCT THAT THEY PUT ON MY DRIVEWAY YOU COULD NOT WALK ON WHEN MOISTURE WAS ON IT. I fell 2 times, as well as my cleaning lady and my son-in-law. This was a lawsuit waiting to happen with elderly people walking the dogs and having to cross my driveway to get to the sidewalks. The cracking started occurring 2 months after application. IF THE CONCRETE WAS IN DISREPAIR THEY SHOULD HAVE BEEN HONEST AND SAID THAT THEIR PRODUCT WOULD NOT WORK IN OUR DRIVEWAY. NO WAY A DRIVEWAY CAN FAIL IN TWO MONTHS TIME. I feel that they ripped us off paying $12000 for their failed product. Anyone one would complain after spending that much money. The concrete company was so concerned for our safety that they cleared a time for us to get it done right away. It is true that he his putting this topping on a lot of homes here in Wentzville and my lawn man said those driveways have cracks also and are slippery. I know that this company will not do the right thing, but I want my complaint to stand so that this company cannot do this to someone else.

Please see ******* statements below with our response.

Statement 1 - THE PRODUCT THAT THEY PUT ON MY DRIVEWAY YOU COULD NOT WALK ON WHEN MOISTURE WAS ON IT. I fell 2 times, as well as my cleaning lady and my son-in-law. This was a lawsuit waiting to happen with elderly people walking the dogs and having to cross my driveway to get to the sidewalks.

Marblelifes Response - Did you get the driveway tested for slip? where are the results? As I stated the coating used is the same coating that is in driveway, patios, swimming pools all over the country without anti-slip media. At you first complaint, we went above a beyond the industry standard by adding anti-slip media to the topcoat.

Statement 2- The cracking started occurring 2 months after application. IF THE CONCRETE WAS IN DISREPAIR THEY SHOULD HAVE BEEN HONEST AND SAID THAT THEIR PRODUCT WOULD NOT WORK IN OUR DRIVEWAY.

Marblelifes Response - Who told you the concrete wouldn't crack? There are only 2 guarantees of concrete. Its guaranteed to get hard and guaranteed to crack. Thats Concrete!

Statement 3 - NO WAY A DRIVEWAY CAN FAIL IN TWO MONTHS TIME. -

      Marblelifes Response - What failed?

Statement 4 - The concrete company was so concerned for our safety that they cleared a time for us to get it done right away.

Marblelifes Response - May I see this documentation. Their  in the business to tear driveway's out and install them.

Statement 5 - It is true that he is putting this topping on a lot of homes here in Wentzville and my lawn man said those driveways have cracks also and are slippery. I know that this company will not do the right thing, but I want my complaint to stand so that this company cannot do this to someone else.

Marblelifes Response - Here is another flat out lie. We have not done any other driveways in Wentzville. We have completed the coating on driveways in a lot of other towns but NOT Wentzville. May I get your lawn man's contact information?

I feel there is a slander/Defamation lawsuit coming as to we have been installing this coating for 10 years with no complaints. You are screaming and yelling as to we did something wrong, while stating the concrete & Lawncare company are saying the same things. Please provide proper Concrete & Lawn care business names and contact information with written statements/documents as to we are now getting legal representation to move forward.

***. The term slander means to say something untrue about someone or something. The lawnman and the concrete company both do not know that you did our driveway. It Isn't anyone else business.  WE DO NOT SHARE THAT TYPE OF pERSONAL INFORMATION. YOU CANNOT SLANDER A BUSINESS IF YOU DO NOT KNOW THE NAME of the company. I believe you put a product on my driveway that 2 seniors could not walk on without falling. Three people have fallen on my driveway. Another 4 people almost fell. The driveway. looked fine from the street, but you could not walk on it with any moisture on it. It was like an ice skating rink. YOU ASKED IF THE CONCRETE MAN DID A SLIP Test. Do you want statements from the people that fell and almost fell? I fell and cracked my tailbone and could not sit for almost 3 months. My cleaning lady fell after it rained. MY stepson fell getting our mail after it rained. No one is slandering your company. I paid you $12000. And I put this complaint out on the Bbb to warn anyone else from getting this product on their driveway because it is not safe. It is not slander when you believe that you have been wronged. This will be my last statement. You believe you provided a good product and I believe you didn't and it cost us a lot of money.

      Customer response

      10/27/2023

If you are getting legal representation, I would advise you that I have 2 people along with myself that has fallen on your product you placed on our driveway. I am 73 years old and my husband 83. I fell twice with my neighbor witnessing my fall taking the trash out. I fell so hard that a chunk of tissue came out of my knee. I could have broken a hip or broken my new hip replacement. Kind of hard to slander a company when my lawn man and the concrete company do not know who you are and the service you provided. Also spoke to the last young man you sent out to our house and pour a bottle of water and had him rub his foot over it and he said yes that is very slippery. Even after he got done the driveway was still slippery and I almost fell again getting the mail. So you took my money $12000 and put a product on my driveway that you cannot walk on when any moisture on the surface and refuse to do anymore for me. I HAD 2 DRIVEWAY SEALER COMPANIES OUT TO LOOK AT THE DRIVEWAY. BOTH SAID THE SAME THING THAT SEALING THE DRIVEWAY WOULD NOT STOP THE SLIPPERYNESS. I ASK FOR THEIR RECOMMENDATION AND THE ONE GUY SAID TO HAVE IT TORE OUT AND REPLACED. I called the BBB AND GOT A GOOD RECOMMENDATION. ALL THE CONCRETE GUY SAID WAS THIS TYPE OF APPLICATION SHOULD NOT BE PLACED ON A DRIVEWay where moisture hits it. MY LAWN GUY SAID THERE ARE DRIVEWAYS IN WENTZVILLE LIKE THIS. HE DID NOT SAY IT WAS YOUR COMPANY BECAUSE HE DOES NOT KNOW WHAT COMPANY I USED. THAT IS PERSONAL INFORMATION THAT I do not share with others. So if me speaking up to you about your product and not agreeing that you did me right after Jason said you all were done with us and that you would do no more is not slander. It is the truth. I really thought about getting an attorney. I WOULD HAVE BUT I Have a very ill husband. 3 PEOPLE FELL on my driveway and there have been several others that had near falls.

We have a senior couple that live up the street and they walk their dogs on the sidewalk and when they get to my house they are crossing over my driveway snd I just hold my breathe that they do not fall. Talk about a lawsuit waiting to happen!

I would like to correct this statement as my wording of the conversation was not what I intended to say.  The conversation went like this:

Me - Please do not come and cut grass today because our new driveway is being sealed.

Lawn Guy - Wow you tore out your driveway? It looked really good.

Me - Well we had some safety issues with slipperiness.

Lawn Guy - Well there are a lot of homeowners out here in Wentzville that have been getting these treatments done, especially home that are older, some look really good, some not.

Me - This is my correction to the statement and what I intended to say.   I hope that the company that did ours didn't do the others as we have had nothing but problems.  Did not mean to imply otherwise.  No time in this conversation was the company name mentioned.

This is my corrected response.  Please record.  I apologize for my miswording in the statement.  I am a caregiver to a very sick husband and all the stress in having to deal with everything on my own somewhat does not match.  Again my apologies for not expressing myself clearly.

We hired them on 4-22-22 to clean and seal our upstairs shower. The tech failed to reseal the area below the shower bench and as a result gallons of water poured through the gap and into the lower bathroom , which we had just painted, & the basement. The entire ceiling, & some of the ******************* had to be torn out & it took a water restoration company 5 days to dry out the bath and basement. Initially the owner acted like he was going to work with us and take responsibility for the damages which totaled $4,831.09, not to mention the $1500 we paid them for a job that was a nightmare. His tech came out and made the repair and apologized for the mistake & all we had endured. As soon as the shower bench was resealed the leak stopped yet the owner tried to blame all the damage on a remodel that happened 8 years ago. I emphasized that there was NO leak until the tech failed to reseal the shower bench & the leak stopped as soon as the repair was made but we were never compensated. We were forced to file a claim with our insurance company & were reimbursed some of our losses minus our deductible. We are still out $2,239 plus our insurance will increase because of the claim. We tried to settle for the $2,239 but the owner has ignored us,

      ***,

We are not sending any contractor's info nor are we meeting with any inspectors for a job done 8 years ago.  As we keep mentioning, there were NO leaks until your technician failed to seal the shower bench.  Had that bench been sealed we would not be having this conversation.  As soon as it was sealed the leakage stopped.  Period!

Since you refused to take responsibility we were forced to file a claim with our insurance company. After our deductible they are reimbursing us for $2,592.09.  So if you really want to settle this you can send us a check for the difference, $2,239 &we will call it even and not file our complaints.  We were informed that because of our claim our insurance premium will increase by a minimum of $170 per year for the next 3 years, so something else we have to deal with because of your company's incompetence.

If you want to continue to fight us on this we will file our complaints and we will see you in court!

Good Morning Pat & *****, I dont have great news. I spoke with ServePro &******* & the insurance company yesterday to review the project. While looking over the photos its clear to see the shower had been leaking for a long time. There is discoloration, looks like mold & water discolored wood. Zero chance that happened in 1 week. Why is silicone the only thing stopping your basement from flooding?  If you think about it, who ever installed your shower is 100% responsible. Where is the Blatter to catch any water intrusion that goes behind the tile. Unfortunately there is not one. Did the shower installer guy tell you that if you keep your shower sealed 100% of the time and fresh silicone the shower will leak in the basement and ruin you possessions? Most showers we go into dont have silicone, they have cracked grout. We remove the cracked grout and put silicone in because it can flex. I apologize for your headaches and I am going to put a check in the mail to refund your money. If I were you I would take the installer to court and *** for an entire new shower

Hello, the chain of ecents are atached below, and i want to be clear if i thought this was 1% our responsibility i would pay for the misfortune. You can clearly see inj the photos the water damage from months/years of being wet. Not from a few showers. i atached the chain of event below.

      Thank you

Attached are all of our invoices for the plumber and cleanup and repairs for the water damage done at our home, ***************************************************************** because your service person failed to reseal the shower bench.  The total comes to $4,831.09 which we have already paid out of pocket with the exception of $636.68 which is due upon completion of the repairs.  This should happen in the next week or two at the longest.

We are expecting a call from you before the end of the week to let us know when we can expect reimbursement.  This has been a living nightmare for us over the last several weeks so we are counting on you to make right your company's mistakes in a timely manner.
