      Signed contract on 7-31-2022. Amount paid ********* dollars. A new roof and new gutters. The problems with the roof are the vents. They say there are 6 turtle type vents up on the roof but we only have one they charged us for 6 on the bill, same problem with the flashing pipe jacks. Also we were billed for an ice and water barrier they said per building code but we do not have or fall under building codes and our paperwork states that they would not add anything without prior authorization. Lastly the workers urinated on our house, garage and driveway. The gutters were not finished and the ones that were installed were done incorrectly. They are not attached properly. They leak from between the gutters and the house causing icicles, which melt and cause water to run down to the foundation. I have called numerous times to speak to the owner but only get the secretary who refuses to connect me. She passes along a message and then I get a email. She is now refusing my calls. No one will speak to me on the phone. No one has come to my house since the work has been completed. The only correspondence I am receiving is emails. There is no account number only a claim number it is #*************

      Swagg solicited my home w/a sales pitch of "well do the repairs at no greater a cost that what the insurance will cover". We needed siding, roofing & gutters so we agreed to their services since they do all 3. The gutters & the roof were finished first & those services I paid in full end of this summer. During the time of the *************** my locked side gate that their crew members forced themselves through & bent. I allowed them to bend it back since they claimed fencing servicing were available for months. The main locking pole is still bent. I let that go. Later when it came time to do the siding, I pulled my two large pieces of drift wood away from the house to be out of the crews way. They were used as painting tables for trim material & got paint all over them. They came back and picked it off. They also had to come back with a pressure ************** my driveway as they got multiple large paint spots all over. Complete disregard for my property as they did not put a tarp down while painting & used my personal property as a table. They also broke & glued a corner of my window plastic trim back together after claiming it appeared to already broken. Only when a crew member fessed up did they glued it back. The current issue I want resolved is ****** refusing to provide me an 1 doc itemized invoice for the sidingtrade. He wants me to figure it out based off line item#s from his ********* estimate, which I can't do since neither ref docs line#s dont even go that high. He is refusing to provide me a transparent invoice. There is ins money dispursed for things that do not go towards Swagg as they did not perform those jobs. I want to pay Swagg, but they refuse to provide & now specially help because I will not allow them to come meet me in my personal residence to talk. Once I explained I wanted to mainly communicate in writing cuz of communication issues we have had & them denying & I am filing a claim with MT Consumer Protection, their communication stopped.

      We work with the insurance company on insurance claims. They approve our estimates, and we send in invoices to prove the scope is completed.We took state farms updated insurance estimate and supplemented for the ice and water shield that is required by building code to meet. Our initial estimate was still for more than what insurance paid for and we completed the work to our original estimate. We upgraded the homeowners underlayment and quality of shingles. (3-tab shingles to 40 year laminated architectural shingle)Free of charge as we must warranty after the work is completed. We had issues that the homeowner mentioned but they were all FIXED. The issue currently is the invoice, the homeowner refuses to meet in person to go through all the claim docs which she does not understand. It can be very complicated and not having a background in construction does not help the itemized breakdown that was requested. All our requests to meet to discuss at her personal residents or in public have been denied. There is an obvious misunderstanding of invoicing and the owner refuses to meet and discuss. We have supplied a simplified invoice and a detailed estimate that matches perfectly with state farms scope for trades completed by Swagg Construction. The estimate provided by the customer is the incorrect estimate and I have uploaded the correct and current one that matches the invoice exactly.

      I am rejecting this response because:

      I have asked swagg several times to name a time and place outside of my personal residence to meet. I have documentation commutation with Swagg requesting naming a place and time to meet outside of my residence. 


      I have also stated that unless the business is willing to place explanation of charges in writing I do not wish to meet in person since verbal discussion would not be recorded as ***** seems to "forget" had conversation. 

      The paint on my deck was not removed. The pole on my fence is still bent. They crudely bent it back themselves since per Swagg no fencing companies were available for months. The window corner on my kitchen is glued. Not fully replaced. This is fully documented via text. I left this alone. 

      I have requested a fully transparent invoice that states the total charges on the crude invoice provided for siding. 

      May I remind the construction company they many times asked for the insurance estimate prior to providing me a bid, as they wanted to see how much insurance would pay first before they provided me a bid. They also asked me not to tell insurance The roof was done, when insurance asked me if it was. Curious?


      But the roof and gutters are paid for. Not sure why Swagg is bringing up the gutters and roof. We are speaking about the siding.  Those two trades are documented as satisfied. 

      When I asked them why they provided a bid that matches insurance including items they do not do like the garage doors and steel door they said "it made it easier for insurance to release the funds". 

      I later asked if I could get an invoice stating only the items completed, they said " oh yes". They did not provide transparency only an invoice with line numbers that do not match estimates. 

      There are many items insurance paid ACV for that Swagg did not complete. I want to ensure their invoice does not include those items.

      I had said many times in writing that when the insurance checks are back from mortgage I will pay but in the meantime to provide me a transparent final invoice for the siding. They refuse. 

      Instead they told me via email and voicemail that unless we meet in person to discuss, they will cease communication with me and now state they have filed a lien on my home without ever providing the preliminary notice of intent to file a lien. 

      They also stated they paid in full *********************** which is their charge account for the materials they used on my home even though I had a phone call 12.5.22 where their office manager told me they have billed them twice and they have not paid. Same day ***** told me via email they have already paid ***********************. Is Swagg lying to *********************** lying? 


      This is why I am requesting a transparent itemized invoice. 


      I left the paint alone on my deck because it snowed and I currently cannot see it. The fence post is still bent. Again, I left that all alone.

      The whole point isn't due to their errors as a contractor in the way of damages. And I wouldn't call gluing my window back together satisfactory. 


      The whole purpose of this is to have Swagg provide an itemized invoice validating their final charges of the siding job. This has nothing to do with all their other problems they had a long the way including installation of options without our consent like the  dryer and ***** vents. 

      Swagg has claimed many times including in a voicemail I kept that they cannot explain charges unless they are in person. That they cannot put them in writing. Insurance has already explained to me they issued payment for siding that they approved however they cannot make sense of the line item numbers on swaggs final estimate. That the rest is between Swagg and I.

      Which swaggs contract with us states we will not owe them anything more that what insurance approves, any upgrades and our deductible. We have already paid the deductible in full and the one gutter upgrade in full prior to this complaint. 

      We have had nothing but open communication with Swagg but the second we say we want an itemized invoice, and they declined and we say we're filing a complaint with consumer protection, they claim they have already filed a lien on our property- which may I remind you we have never received a notice of intent to file a lien nor have never once in writing stating we refuse payment.

      Hi there,

      I have additional documents I would like to provide and upload to my claim .#********

      I emailed Swagg on 12.7.22 inquiring why does their invoice not. Only match up with the insurance payout, but mathematically it is off. This is after they told me they filed a lien on my house because I told them we do not need to meet in my personal residence.  

      I also said Swagg may name a time and place outside of my home, but there is no need for me to go meet them anywhere if they will not put their explanations in writing. 

      They have stopped responding. Wanted to get all this uploaded to the BBB

      Hi,
      The homeowner is looking at this incorrectly and not correct vital documents. After numerous attempts of meeting in person to better explain invoices. The insured prefers to stay out of the loop of how this process works and we must take the necessary steps to protect our business. The homeowner also states that the mortgage company asked for more information and the client refuses to give us mortgage contact information. The mortgage will stay uninformed by having the homeowner as the only contact. We must communicate with the mortgage to get this information to them. Regardless our contract is with the insureds and we finished our work October 27th. I am assigning an office support staff to assist with the customer. Hopefully, they will understand our invoice but without meeting in person to explain. ******* will reach out tomorrow. The owner keeps leaving key details out and this is wasting everyone's time. If we do not get paid by the end of the month we will be proceeding on the filling of the lien and eventually foreclosure on the lien if we are not paid in full.

      I spoke with ******* today and we were able to discuss over the phone the charges. The invoice was off mathematically which she is fixing tonight and sending over tomorrow. She is also removing charges for house numbers that did not get removed and replaced by *****. We are now in agreeance and with the corrected invoice, I will be issuing a cashier's check once the mortgage check clears in 10 business days. I did not refuse to stay out the loop, I only wanted to discuss the explanation of charges and did not wish to authorize ***** to speak with my mortgage. Swagg should be paid on full matching the corrected invoice prior the the close of the month.
