      Entered a contract with Dryworx on 5/5/23 for $8,520.12. Paid in full on 8/1. Reported defects on 8/11, *****, CEO, visited the site on 9/1. During his visit, we identified 2 critical issues: 1) erosion of the fill material, 2) instability and levelness of the ** unit. ***** responded to our concerns on 9/11 and told us that these issues would be resolved on 9/16.On 9/16 ***** arrived without the necessary equipment and materials. Despite this, he began work. Afterwards, the inspection we conducted together revealed that the ** unit was still unstable. A detailed investigation revealed there was no support underneath an entire end of the ** unit. It was evident that his solution was to stuff dirt, pine straw, and wheat straw underneath the unit to level it up. The proper way to support the ** unit is to provide 4 cinderblocks under each corner. This is how the ** unit was originally installed. There is no indication of where two of the 4 original blocks went. This was very deceptive and completely unacceptable. We demanded this be fixed immediately but he would not commit and then left abruptly.His departure not only left the property in a worse condition but also posed a safety hazard due to the unstable placement of the ** unit. In addition to the ** unit, when he left, the landscaping which consisted of laying down pine straw, reseeding, and covering with wheat straw was also left undone.This sudden departure, coupled with his failure to adhere to our contract, unresponsiveness to our inquiries, and the resulting breach of contract, constitutes a default on his part. To prevent further damage to our property and to ensure safety, we had no choice but to shut down the ** unit and take corrective measures. We are now required to hire another contractor to complete the work that he failed to finish.As such, we demand a full refund of $3,350 for the unearned portion of the contract: Backfilling/Seed/Wheat Straw - $1,850, HV** Removal/Re-Install - $1,500

      I am rejecting this response because: Dryworx' response was not satisfactory and does not reflect truth. Please see attached response to each claim made by Dryworx by number.
