I am not liable for this debt with charter communications, I do not have contract with NORTH STATE ACCEPTANCE, they did not provide me with the original contract as I requested.Business response

This customer has had 3 accounts with us. The second account was refinanced per the customer's request. This refinance required the customer to come in person and produce a copy of their ID. In addition, there has been correspondence with the customer throughout the loan. We have not received a letter requesting a copy of the contract. Attached to this compliant, the customer provided a copy but it is dated 7/22/2024 so perhaps it hasn't been delivered. We have answered multiple credit reporting disputes claiming not mine as well as identity theft claims. Per our procedure, a letter was mailed requesting a copy of a police report or ************************ filing and a copy of a picture ID to which we haven't received a response. In addition to closing this loan in person and doing verification our ID on file matches the photo ID the customer attached to this complaint.

In 2019 I had a vehicle reposition, the company it was financed with closed the account in 2020. Over the last 3 years the company has reopened the account multiple times causing my credit score to crash. I have had no contact with the company at all since 2020. Is there a way to stop them from reopening it so I can rebuild my credit. Please help, thank you for your time.Business response

This account was opened in August of 2018, repossessed in December of 2019 and charged off in March of 2020 after the collateral was sold and the funds applied to the account. The account never closed, isn't being "re-opened" and remains a charge off that is automatically reported each month end. The balance owed increases each month due to accruing interest . We zeroed the interest due and reduced the rate to 0% so the amount reporting will remain constant at the $5381 remaining unpaid principal due.Customer response

I am rejecting this response because: The account has shown closed/charged off multiple times over the last few years. Then randomly will show as open on my credit report and will crash by credit report this last time it crashed by almost 70 points. I have had a repo in the past and that never happened. The account needs to stay in a closed/charge off status.Business response

Charged off accounts are not closed. They are open charge offs. The only way that charge offs reports as closed is if an agreed upon portion is paid and we settle the account. Then the account would report as settled for less than full balance with a $0 balance and it would be closed. There has not been such an agreement made on this account. It has never been closed. If you have a copy of it ever reporting closed please share with us. We have never reported it that way.Customer response

I have reviewed the response made by the business in reference to my complaint, and theres nothing else to discuss. This company will never work with their customers to resolve anything.

The customer purchased a 2016 ****** Maxima from ***************** 02/25/2022. There was a lot of communication with the customer during the short time the account was opened. Shortly after the vehicle was purchased, it was wrecked and while. the customer's insurance policy paid the total loss claim it didn't pay off the account. The customer had purchased a GAP waiver and we filed a claim on her behalf which not only paid the account out but gave her an overage of $1,080.92 that we had to stop payment on because the last payment that she made to us was returned to us. We stopped payment on that overage check which was cashed by a check cashing service without checking the validity of the check. We issued a new overage check after the returned item was added back to the account. This customer received funds for both overage checks. We have never received a request for any loan documents from the customer. The customer hasn't requested a copy of her contract or application from us. The account is in paid out status and the contract was marked paid and sent to her at that time.
