      I contacted Daniel J****** (Jackson Farms) through a third party referral, which I choose not to name at this time, to perform well services per verbal agreement at initial contact on May 5, 2022, in the total amount of $3,000.00 to (a) dig deeper in current house well system to access more water with new pump and new bladder tank and if needed, (b) dig a new well and reinstall new pump and new bladder tank in that location, with the acknowledgement that HOMEOWNER would construct an appropriate enclosure, noting that we had 10+ visitors from out of state to begin arriving on May 27, 2022. A deposit of $1,500.00 was written on May 5, 2022 from a personal account (****** * ********) to ******* Farms. Once materials were delivered and install date of May 11, 2022 was set, the balance of $1,500.00 was written from same personal account to Jackson Farms at approximately 3:30pm, in which he stated that he and his daughter had dug the well 20ft deeper which was at their max. At 5:43pm, I texted that the water just stopped. He said he would be back on May 12, 2022, which he was at approximately 2pm. It was at that point he stated that we would need to move to option (b) but that the cost was already covered and that it would be minimal (~$250) as in tying into the old pump house location. Multiple texts back and forth looking to draw an answer or plan of application from J****** yielded little hope. Finally, anticipated guest arrive and well fails at 9pm on May 27, 2022. J****** gave a temporary solution of running hose form neighbor and backflowing in the home through the outside spigot, which we did, using 800ft of garden hose. At the date of this complaint, June 23, 2022, we are still using that 800ft of hose to brush our teeth and cook with. Multiple failed attempts and excuses have been made, mostly that he runs farmers markets Th-Su. He is also USDA certified for organic meat production. Filed as LEGAL AGENT for CPT MARKDAVID MERCADO, US ARMY deployed.

      Business Response /* (1000, 5, 2022/06/28) */ Apologies on the job taking longer than expected to complete. I understand that it has been frustrating not only for the client but for me as well. After a few days of repairing the original well we have decided to go to Plan B which is installing a new well. Complicating the situation further is the fact that I am a produce and meat farmer (I have no idea where the client got the idea that I was certified organic, I am not and never claimed to be not to I advertise that I am), and I am president of Robeson county farmers market, this is our busy season which gives us a little time to focus on the well as we have markets five days a week in both Cumberland and Robeson Counties. Due to the severity of the job and my prior obligations it is not helping, just prolonging an already difficult job. We also have had catastrophic mechanical issues and have been waiting on parts of which the client was informed of. I am very appreciative of client being understanding and working with my prior obligations during the week but as of today the parts are in and equipment is back in working order and I will be back to complete and satisfy customer. Furthermore I had I realized the unusual complexity and severity of the job to begin with I would have passed on the job due to time constraints. Consumer Response /* (3000, 12, 2022/07/08) */ Daniel J****** came out on June 28 for approx 1.5 hrs, then left the site. I texted to get progress report and he said that he had been in Jury Duty for that day and couldn't spend any more time until Thursday, which would now be another 36+ hrs of no well water. I asked that he communicate better. Then he showed up on June 30 and worked on site from 9:30am-mid afternoon. That evening after hearing no update from Daniel, I texted and he said no luck, was hard dirt. No future work date shared, although I knew would be a holiday weekend. On July 5, I texted for update; no response. On July 6, I texted again for update; no response. On July 7, I called and left a message and finally got a response full of excuses noting that by working on site 6+ days (granted they were not full days and this was over an 8 week timeframe) that he had fallen behind at his farm and basically said that was because he had taken the job at 206 McFadyen Drive. I have asked him is he is open to negotiating out the $3k that was paid to him but I would need an itemized invoice and receipt for parts and supplies. He does not have a timeline of if or when he will complete the work. I have never been more disappointed in lack of communication from a paid contractor, not to mention the mis-treatment of service and property to an active duty service member. I feel that if he cannot complete the work, he should make things right. I have asked him to contact me by 5pm today to carve out a time he can present the itemized invoice to me and we can negotiate the appropriate amount of actual charges. He needs to realize that his inept ability to perform verbally agreed task, while accepting payment has cost the property more in damages and soon to be repairs and improvement by way of another contractor, supply hoses, replacement hoses for the extended pressure and them backing in the hot sun, the added cost to the neighbor who is so graciously helping by allowing us to use his water and the fact that the home is not available to be used for AirBnB which has resulted in $4k in lost revenue since the homeowner deployed. Any guidance or help that the BBB can provide would be greatly appreciated. Business Response /* (1000, 16, 2022/07/29) */ Not able to complete, have met with Mr ******** and are waiting for him to go over what work was done, how much I was paid and what he would consider a fair trade for the work that was done. I have been in contact with Mr ******** the entire time. Have not hear back from him since I dropped of an itemized invoice of what was purchased that he is in possession of, time spent there as well as what work was completed. Have just sent the document of his itemized charges and the notations of incurred damages and liquidated damaged. I will wait to see if he accepts the agreement to refund half of the total paid to Jackson Farms. Consumer Response /* (3000, 30, 2022/08/24) */ There has been no further follow-up, verbal or action from Jackson Farms. Repeated attempts for status of refund and signed document have been made.
