      I paid the initial deposit for landscaping on June 2. Work did not begin until early July. He was here maybe 3 times, and has not been here since. He delivered one load of rock for a retaining wall and placed it in the back yard. He had two loads of fill dirt delivered July 21. He has not been here since mid July and I have received a nuisance letter and a fine from the City because of the dirt. I have not heard from him since Sept 6. I have sent multiple texts and left multiple messages with no response.

      Mr. ******************* is willing to pay for the fine that was issued by the ************************** but nothing else.

      When I had arrived on site with my equipment on the previously agreed upon start date, I was unable to begin for not just 1, but three continuous days. This was due to the clutter in the backyard that I had been told by the homeowner had already been moved. When I arrive onsite the start date, all of the clutter was still sitting in same spot untouched. For three days there was a junk removal truck in the backyard blocking all machine access.

      I am rejecting this response because:

      I agree with the situation Mr. **** describes.  As a result of our not having the area ready for him, there was a delay of 3 days before he could begin work.  He stated that he was fine with that.  He does not respond to the reason he did not return any phone calls or emails.  He worked for 3-5 partial days, moving rock into the back yard,  He then had dirt delivered, which sat for 2 months with no response to my inquiries.  I then had to pay the city.  His neglect in responding to me caused a loss of time in my yard..  Had it been completed within a reasonable time, my grandchildren would have been able to enjoy playing in the yard, and having access to our swimming pool.

      I believe that there is a significant amount of "injury" to my family because he did not complete the job or even explain to me that his calendar would be "full" for X** amount of time before he would be able to return to my site.

      I paid him $2804.65 on June 2.  The loads of dirt were delivered on July 21. I was receiving multiple complaints from him about equipment failure and his promises to be here, but not showing.  On September 2, I received a nuisance letter from the City.  I sent a copy to Mr. *********** He promised to be there that week.  He did not show.  On September 10, I received the penalty letter from the City.  I sent a copy to Mr. *********** He did not respond.  

      It is my belief that he took on too many jobs to complete mine in a timely manner; however, he did not notify me of any potential delays on his part because of his schedule.  He did not respond to me until I threatened filing a complaint with the BBB..

      He offered $750, including the penalty.

      I believe my loss of the use of my yard for the entire summer is worth more than $600.

      I am willing to accept $1000 for my inconvenience plus the $150 fine to the City.

      The client was made aware that the primary trailer used to haul equipment around for our company was currently at the welding shop having repairs done to it. The client was told that as soon as we got word from the repair shop that the trailer was ready to pickup, we would be back out to the *******. I understand that there are some repairs that can be put to a later date, but when it comes to the safety of everybody else out on the road in danger... That is something i absolutely can not and will not put at risk.
