12/17/2023 at 1315-false/untruthful accusations from *** Leppert-store manager. Call placed to Beatrice Bomgaars store @ 1330 by minor-spoke to *** *******. When asked by minor customer why store representatives were seen filming vehicle and following them, *** stated he doesn´t recall taking video (although seen by multiple people) and believed the individual was consuming merchandise in the bathroom. Minor stated he was using the toilet and his brother was blowing his nose. Minor notified manager of the other party sneezing into the sleeve and noted to have a large amount of phlegm that required cleaning. Store representative entered the bathroom washing his hands and able to visibly see there was no consumption of anything. When called by 2 customers to ask why they were recorded, *** denied filming customers and/or vehicle. He stated, customers were seen consuming store merchandise in the bathroom. Minor stated that is false and there was no merchandise consumed in the bathroom and the store rep would´ve seen it. Call placed by adult parent @ 1411 to store. Adult spoke with *** who immediately recalled the event and accusation shared by minors. *** said male consumed merchandise in bathroom. When asked what merchandise, *** repeated consuming merchandise without recall of what. *** recanted story and said, I mean he concealed a hat in his jacket. Again, *** was questioned on the validity of the accusation as he clearly was unable to provide evidential cause for the accusations and changing story. *** was asked to not lie about the incident and instead own wrong doing to which he deflected. He was asked to provide video footage of the said incident if in fact true. *** noted they have no video or proof of event. *** said, what do you want me to do? He was told to be honest. *** declined to further assist, and stated he was being harassed by the questioning. This event has caused emotional distress for false accusations. Manager unlawfully profiled customers.
