      getting multiple phone calls from all kinds of areas i am homeless and need my phone to try to locate work

      BQ & Associates appreciates the opportunity to respond to *** *********’s complaint dated May 19th, 2024. *** ********* states in his complaint that he is “getting multiple phone calls from all kinds of areas…and need my phone to try to locate work.”

      BQ & Associates has made two phone calls to *** ********* in the past 100 days.  The first phone call was made on February 28th, 2024 at 10:33AM.  The second phone call was made on May 17th, 2024 at 10:17AM.  In both instances the call was not answered.  Upon receiving notice of this complaint our firm has put a note in *** *********’s file to make no further phone calls to him. 

      BQ & Associates, P.C., LLO hopes that this will explain the situation to the satisfaction of *** ********* and the Better Business Bureau. We believe that no wrongdoing has occurred on the part of our client nor this Firm. We will fully cooperate in any way necessary going forward, but ask the Better Business Bureau to close this complaint.

      On September 2 said business sent garnishment to my bank account. At that time $****** was removed from my account. I went to bank and got a loan for balance owed of $*******. At which time that is what was owed . Upon paying account in full I was told the $****** would be returned to me but that they didn't have it. I needed to call back September 6th. So I called back and was told as soon as money cleared it would be sent back to my account and that the courts had it. I called the District Court and was informed they don't it was sent to Attorney that garnishment was from. Greg from BQ & Associates is whom I was talking to and he was very unwilling to tell me when I would get my overpayment of $****** back. I feel it should be sent back to bank account immediately. This company is about getting collections I get it but they need to return the money not owed plus interest. Case number ************** Susan ******* *************** ****************** ************ Total due on account $*******( approval code ******) Total paid on September 2, 2022 was $******* Total overpayment $****** This Greg is not telling me the truth about my overpayment and all I want is to get it back into my account.       Business Response /* (1000, 5, 2022/09/14) */ Introduction: The claimant is not a customer of BQ & Associates, PC, LLO ("BQ"). BQ is a law firm. Ms. ******* was an adverse party that ***************** ("****"), through BQ, filed a lawsuit against on March 19, 2021, in the District Court ***************************, Case No. **************. Facts: As stated above, a lawsuit was filed against Ms. *******. Ms. ******* had a judgment entered against her in the lawsuit because she did not respond to the lawsuit. In August of 2022, ****, through BQ, attempted to garnish Ms. ********* bank account fifteen months after the judgment had been entered and at which time, Ms. ******* had not paid any amount owed on the judgment. The attempt in August of 2022, to garnish Ms. ********* bank account was the first and only garnishment attempt made pursuant to the March 19, 2021 judgment. On September 1, 2022, BQ received notice from Ms. ********* bank that the bank was holding $****** of Ms. ********* money. Ms. ******* called BQ on September 2, 2022, asking that the garnishment funds being held by the bank be released back to her. BQ's representative told Ms. ******* the garnishment could not be released without authorization from ****. BQ's representative obtained authorization from **** to accept a payment of $******** to settle the claim in full. Ms ******* subsequently paid BQ $******** on September 2, 2022. Friday September 2, 2022, was the beginning of the Labor Day Holiday weekend. Courts and banks would be closed the following Monday, September 5, 2022, and would not re-open until Tuesday September 6, 2022. BQ is filing a release of the garnishment and satisfaction of judgment on September 7, 2022. As of the date of this response, BQ is not and has not been in possession of $****** held by Ms. ********* bank. BQ's Response: BQ understands why Ms. ******* is frustrated, but believes her complaint is unsubstantiated. After Ms. ******* had paid $******** to settle the claim, BQ took no legal action to receive the $****** held by the bank. After Ms. ********* payment cleared, BQ filed a release of garnishment and satisfaction of judgment, on September 7, 2022. It took legal action to get Ms. ********* attention and finally arrange to settle the claim. To expect BQ to be able to release the funds back to Ms. ******* immediately upon receipt of her settlement payment is not reasonable, especially considering the timing of the payment coming immediately prior to a long holiday weekend. BQ was never the party in possession of the $******. BQ only had the power to release the valid garnishment, which BQ did in a reasonable amount of time. While BQ believes that Ms. ******* most likely does not fully understand that legal proceedings may take more time than expected, BQ believes that Ms. ********* filing this complaint as quickly as she did created an impossible situation and an unreasonable timeline. Conclusion: BQ has acted professionally and courteously toward Ms. ******* and has promptly filed a release of the garnishment and satisfaction of judgment within a reasonable time period. BQ thanks the Better Business Bureau for the opportunity to respond to the issue presented. Consumer Response /* (3000, 7, 2022/09/14) */ (The consumer indicated he/she DID NOT accept the response from the business.) As stated in my complaint it was yes about the return of the money that was being held after payment in full was made on account, however it was also about the way it was responded to verbally by the bill collector Greg. He told me several places the money was sent and each time I called those places I was told it was most likely sent to attorney handling the case. Several of my calls were made AFTER the Labor Day weekend. When I ask Greg to speak to his supervisor I was told several times he was available. Although I take full responsibility in the lack of payment of this account and not making excuses ****************************************************************************************************************. The way I was mislead and taunted by Greg is unprofessional and down right mean spirited. I'm sure this company has gotten away with this mistreatment of other clients as well.
