Metro Driveway company replaced my daughters driveway approximately April 2022. On September 26th 2022 I noticed a small crack in the driveway, I contacted ****** via text with a picture, he advised me that he thought the roofer could have caused the crack with 2500 lbs of shingles in a small pull behind trailer which is less weight than a small car. On Oct. 3rd 2022, I texted ****** again, no reply. Knowing winter was coming I waited until April 14th 2023 and sent him another picture and text, he replied we'll get it fixed up. No one ever showed up. I texted ****** again on June 9th 2023, June 12th 2023, August 15th 2023 no response. after numerous phone calls I finally got ahold of ****** October of 2023, he said they would be out next week and repair the crack no one showed up again, I called ****** end of October and on November 3rd, with no response. The reason I didn't file this complaint within a year is because the owner ****** kept telling me he was going to take care of the problem and I believed him.

      *** *****

Let go with the facts -

      - You originally hired a different concrete company but cancelled them and hired us because we saved you $3000.00

      - We showed up, installed your driveway to agreed amount and finished in one day - No deposit -

      - You were happy and paid us

      - 6 months later you called( I answered right away) and said you had a crack in your sidewalk and that the roof was redone but you didn't think their trailer would do any damage.

      - Roofers use dump trailers, not lawn trailers.. and they usually overload them. Always

      - So your Roofers caused the damage NOT US

      - I said I was happy to repair the damage, no cost to you..when we were in the area next time. My time ...my dime  correct?

      - We haven't been in your area and I'm not spending $2000.00 of our money to repair your sidewalk just because you're impatient

      - Yes...you've called several times. I've answered and called you back on all of them until you filed this complaint. One of those times, I explained to you this wasn't a dire need situation and that I had to be close to be able to repair it no cost and you laughed and said "ya ...you're right"

      - I was doing you a solid by agreeing to repair the damage that wasn't caused by us for free when it was efficient for us to do so. But now has evolved into a complaint to the BBB

      - Mr North, I run a good business. We do a lot of good things for people everyday....   I won't be extorted into fixing your job by you filing a complaint with the BBB.

      Mr. North

Your responses prove how irrational you are. Once again the facts:

You hired us - no deposit

We showed up, completed the scope and you were  happy

You paid us and recommended us to others

You hired roofers, they damaged your concrete NOT US

We agreed we'd help you out a fix it for free when it worked for us - You agreed

We did answer several of your calls and texts - we have documents to prove

You got erratic and irrational and started to complain about us when the damage wasn't fixed on YOUR timeline! Not what was agreed upon

You're  the problem with Society today Mr. North, not us! You're  impatient, erratic and lying about our Business

We reserve the right to seek legal damages for defamation and slander. Nebraska Law allows to to pursue damages for defamation on Social Media

      Complaint: 20826121

I am rejecting this response because: ****** first of all your a liar, as I said I regret referring you to anyone. Second the roofer had nothing to do with your shoddy workmanship , third your time frame of 2 years doesn't work for me. and last you and your company are the problem on society, take the money and run!! I reserve the right to inform others, buyer beware with Metro Driveway Company!!!

      Sincerely,

      ****** *****

      Resolved
In Sept. 2021 Metro Driveway Company replaced my parents driveway and sidewalk. With the replacement we also purchased the Deluxe Package (1 year warranty, life time joint expansion, and sealing the concrete). In Feb. 2022, I emailed Damian ****** that a square of the concrete was a darker gray than the other sidewalk squares. His reply was they would apply more sealer in the spring (his flyer stated sealing would not change the concrete color). Nothing was done during spring or summer. On Sept. 9, 2022, I emailed again to determine what the status was on the sealer and to advise the company there was a chunk of concrete that broke off in the same area of the dark gray area. I was advised on Sept. 15th to send pictures and it would be checked in a week. I sent the pictures of the off color square and the chunk of concrete that broke. Since that date I have sent multiple emails, left multiple voicemails, and sent texts asking when the concrete would be checked and repaired. I have not had any response since the last email from Sept. 15th. I am not even sure they are still in business. The company address appears to be a house and not a business. The contract stated they are not responsible for sprinkler systems. I was told to mark the sprinklers and they would work around them but we still had to do $******** worth of repairs. All the marked heads and underground line were damaged. Looking to get this fixed for parents ******************************************************************* and now feel they made a bad decision. The address listed for my information is different from where the work was done.

Business Response /* (1000, 5, 2022/11/20) */ Contact Name and Title: Damian ****** Contact Phone: ************ Contact Email: ************************* Mr. ***** Yes, our office is located at a local residence just like many other small business's in the world and it is the same address that was on your original estimate without question. This has not changed in 25 years. We did disclose we weren't going to be responsible for your sprinkler system which was very neglected at the time of installation, but you're still complaining about it. We provided you the product and service you paid us for, in a timely manner. We did check your property out and there are no structural or cosmetic defects caused by anything Metro Driveway Company did or didn't do for you. We always take care of things under our warranty, and most of the times out of warranty, that are justified. Discoloration of concrete especially around trees and other natural elements or not considered defects. We cannot guarantee uniform coloring of concrete. Especially when there was an oil leak on the driveway per your email 2/2/22 As far as the chunks on the edges of your concrete, a one off would be something but its happening in a couple places which leads be to believe a mower deck might be hitting the edges. We will fill in the broken areas with high strength concrete which the color might vary but they will be filled. Let us know if this is sufficient? Regards Consumer Response /* (2000, 7, 2022/11/28) */ (The consumer indicated he/she ACCEPTED the response from the business.) Just to be clear, this complaint was generated because multiple calls, texts, and emails were never responded to about the broken concrete and discoloration. A call back and explanation was what we were trying to get. Yes, I think it would be fine to fill in the broken areas with the high strength concrete. To be clear about the discoloration, that is not near a tree and is not in the driveway where the oil leak occurred. It is located on the sidewalk in the same place the broken concrete was found.
