transaction date, 05/01/24. Amount to be paid $335.00. WHAT THE BUSINESS COMMITTED TO DO. THE RELEASE OF MY TRUCK!! NATURE OF DISPUTE , NEBRASKA TOWING AND RECOVERY TOLD ME that i had to pay a fee to get my truck released. fee of 335.00 dollars, they are trying to charge me $335.00 and then charge Loanmart the same if not more, NEBRASKA TOWING AND RECOVERY DOING BUSINESS with LOANMART , AFTER THE MATTER WAS SETTLED AND NOT ONE PERSON SAID THAT I OWED nebraskatowingandrecovery this money.untill the day i was getting my truck. something was not right, so i contacted LOANMARTAND EXPLAINED TO THEM WHAT WS GOING ON LOANMART RESPONDED RIGHT AWAY TELLING ME THAT LM told nebraska towing and recovery to bill loanmart for the 335.00 storage fee but nebraska towing an recovery said i had to pay cash, they only take cash. that is B.S. So what NTnR IS doing is charging the customer a cash price only because cash has no trail. then charging loanmart a higher price but loanmart was not told cash only. so NTnR IS scamming people. a legit company takes alltypes of payments. on 05/02/24 at 10;30 am i be getting my truck, and not paying a fee, i am sure this has happend to alot of people, but nobody explored the possibility that NTnR IS PRACTICING FRAUD AND SCAMMING PEOPLE I CHECKED IT OUT AND THEY ARE CAUGHT.

We are required to follow directions from our clients on what we will or will not collect at our lot.  I have attached an example sheet to show what our clients have given us for their guidelines.  As you can clearly see in Example A, the client is telling us to collect from the debtor per *********** our administration fee (our agent standard in Nebraska is $75), a storage fee of $20 a day (vehicle was stored for 15 calendar days) and a personal property fee (which we waive in Nebraska).

As you can see in Example B from another client, if the client wants us to bill them back for these fees and not collect from the debtor, it is clearly written for us to bill back the fees.

Example C shows that on 5/2/2024 the redemption release was updated and we were then instructed to bill the fees back to the client and to not charge the debtor.

This final fees for this vehicle for storage and administration were $375.00 which was billed back to the client.  The fees provided to Mr. ******* were in the amount of $335.00 because he called 2 days prior and wanted to dispute the fees. It took *********** 2 days to change the release instructions so it added 2 days of storage at $20 a day.

As far as us only taking cash from debtors. That is correct.  It is not an attempt to scam.  It is because we have had debtors cancel checks and stop payments on credit cards in the past.  We are protecting our interests by only accepting cash.  We also  have to pay cash when we pick up a repossession from any other impound yard in Omaha as they also only take cash.

      ********** ********

I am rejecting this response because: i have sent the emails from Loanmart telling nebraska towing and recovery

that loanmart would cover the fees,   ALSO EVERYONE KNOWS IF YOU RUN A CREDIT CARD OR DEBIT CARD

AT THR TIME OF THE TRANSACTION AND IF ITS DECLINED. NO PAYMENT,  IF IT GOES THROUGH THEN THE CHARGE HAS BEEN ACCEPTED.  THE PERSON USING THE CREDIT OR DEBIT CARD  CAN NOT STOP PAYMENT.

SO CASH IS ILLEGAL WHEN YOU DO NOT TURN IT IN TO THE IRS... ALSO I BELIEVE THAT MOST PEOPLE  WOULD

NOT HAVE PURSUED THIS SITUATION AND PAY NEBRASKA  TOWING THE FEES. I KNEW THEY WAS NOT A HONEST COMPANY.

It is obvious that any answer that we provide is not going to satisfy Mr. *******.  We have already provided a screen shot of what is in our contract for the financial institution that Mr. ******* references.  In that contract they advise us to collect from the debtor.  We have also provided the date and document that said financial institution advised us not to charge Mr. ******* and to bill them directly, which we did.  Mr. ******* did not pay anything at our facility.

I would also like to note that all of our cash transactions are recorded and submitted back to our clients (all financial institutions) showing the amount collected.  This is in case the debtor was overcharged or if the financial institution believes there was an error on their end.  That paperwork is also kept on file for audits.

We have had several credit card transactions stopped when we first opened in 2005.  The transactions are not final for 24 hours to 2.5 days.  Debtors would claim that their wallets were stolen, card was lost, there was a fraudulent charge etc...  This is why we no longer take credit cards.
