I signed a contract on April 9, 2024 with Andy's Painting to complete an interior painting job at my residence. The work was completed between April 11th and April 25th. The total to be paid was $1280.74. I paid a 50 percent deposit prior to work being initiated with the remaining 50 percent due at completion. Our contract (attached) states that Andy's would "Lay plastic and/or drop cloths over the furniture and flooring to prevent drips." This was not completed resulting in white paint on the flooring in various locations including the stairway floors and caulked areas of the stairway. Andy's worked to remove the paint. However, some paint remains on the flooring and in the caulked areas. The flooring was installed using clear caulking. Andy's indicated that they would not be able to remove or repair all of the area where their white paint leaked onto the clear caulking. This has resulted in uneven/painted areas of caulking that cannot be repaired per Andy's employees and were a direct result of them not performing the tasks stated in our contract. Andy's failed to properly protect our flooring as stipulated in our contract. Andy's attempted to clean up the leaked/spilled paint by using an abrasive orbital buffer and sharp hand tool similar that a box cutter to remove the paint. While doing so, they scratched/gouged two stairs. Andy's agreed to forgive the remaining 640.37. They did retain the initial deposit in the amount of 640.37 in spite of not fulfilling the contract as it relates to covering and protecting the flooring. Additionally, Andy's states on their website that they do not utilize subcontractors. The website currently states "We do not subcontract our painting work. All of our painters are employed by Andy's." The painter "Cisco" and the project Manager "Kris" both told me on the first day of work that Cisco was indeed subcontracted. This is a clear misrepresentation by Andy's and should be removed from their website.Business response
