      My name is *********************************. On may 10th 2024 I purchased a s90 2017 four door sedan ***** from open lot used car sales. The sales person that sold me the car was *****************************.We discovered within 2 days thats the driver side air conditioning vent was blowing out warm air. ****** informed me after bringing it to his attention that he would repair the Air conditioning. I took the car back up there to have it repaired, within another couple days he called an said he fixed the problem. After receiving car back I noticed that the problem was not fixed and the ac was still blowing cool air He told us to drive the car for a week to find out where **** was coming from. After a couple days the air went back to blowing warm out on driver side initial problem was not resolve. We bought the car back on the May 29th 2024 where he gave a me a rental car. I was told that car was sent to ***** dealership in ********* I called him on the 3rd of June no response called him on the 4th. He said that he would call ***** this morning to find out status of the car. I called the service department at ***** gave them the make and model of the car and to my surprise I was told it was never brought there. Sales assistant at ***** told me that open car lot was supposed to bring the car in yesterday 6/4/24 but they never brought the car in. I spoke to ****** right after I spoke with ***** he said he paid $1000.00 to have the air conditioner repaired with *****. I asked to speak to his manager of open car lot used car sales, he refused to let me speak with the manager or give me a direct number to where I could call and talk to him. I just want my air conditioner repaired I payed twenty two thousands dollars for a car I was told that the air conditioning would be fixed or I wouldnt have bought it. I want to get this resolved as soon as possible although my car is still not repaired as promised.

      In addressing the complaint lodged by ************************************* regarding her recent purchase of a ***** vehicle and the subsequent air conditioning issue she experienced.  

      ********************** did indeed purchase the ***** as stated.  At the time of the sale and upon her departure from our dealership, all systems, including the air conditioning, were in proper working order.  However, a few days post-purchase, ********************** reported a malfunction in one side of the vehicle's air conditioning.  ********************** purchased her vehicle on an "As-Is" basis, as clearly indicated in the sales agreement.  Under this agreement, the dealership is not legally obligated to perform or cover any repairs to the vehicle following the sale.  However, in the interest of customer satisfaction and as a gesture of goodwill, the dealership voluntarily offered to inspect the vehicle post-sale.

      Upon receiving the vehicle back for inspection, our technicians conducted a thorough examination.  No leaks were detected, and the freon levels were confirmed to be appropriate.  Despite this, ********************** returned the vehicle to us, prompting a second inspection which also yielded no evidence of leaks.

      Given the persistent issue, we decided to consult ***** directly for further diagnosis.  Although the earliest available service appointment was five days out, during our phone conversation with *****, they suggested a likely location for the leak.  Acting on this information, our technicians re-inspected the specified area and successfully identified and repaired the leak.

      Consequently, there was no necessity to keep the appointment with *****, as our dealership promptly procured the required parts and completed the repair internally.

      Regarding ************************** conversation with ******, he conveyed the information provided by our service manager, including the potential inspection fee at *****, which was estimated at $1,200.

      On June 5, 2024, ********************** was informed that her vehicle had been repaired and was ready for collection.  ********************** expressed a desire to speak with ******' manager before picking up the vehicle. The manager contacted ********************** on the same day, and following their discussion, ********************** retrieved her vehicle a few hours later.

      We trust this response clarifies the events as they transpired and demonstrates our commitment to resolving the issue in a timely and efficient manner.  Should you require any further information or clarification, please do not hesitate to contact us.

      I purchased a vehicle 4/11/24 with $3000 down 500 remaining for down payment and 500 down for car insurance which was $474 I gave 500 dollars and left with the vehicle when I left the next day I go back to the Carlot they said it will be a hour to get the car fixed time passed and they said it was fixed and it was not fixed then on 4/24 I called the dealership to let them know I needed a few more days to pay the rest of the down payment I was told to bring the car back for a involuntary repo and once I get the 500 they will give the car back on 4/29/24 the repoed the car and wont give me my deposit back or let me pay to get the car back it has not been 30 days. Ive also called 4/30 4/29 and they wont let me speak to anyone on 5/1 I called and I was told to call back at 5pm to speak to speak with someone which is around the time they close I also asked on 5/1 can I know what the supervisor name is and they told me they can not give me that information and there is no other number to call. I also was told through text messages that there was nothing they can do I cant get my money back or the car I also have the paperwork for the insurance stating I paid $307.00 down which was not true I have the agent name ****** 500 for the insurance

      On April 22, 2024, the Customer purchased through a Motor Vehicle Retail Installment Sales Contract, a vehicle secured with a $3500 down payment. The Customer paid $3000 of the down payment and a $500 deferred remainder of the down payment, which was due on April 25, 2024.  The Customer left with the vehicle and the promise to make the deferred payment on April 25, 2024. 

      As to the Customers comment on vehicle insurance - on occasion and in this instance, when a customer is having difficulty finding insurance coverage, we will assist them by suggesting insurance companies.  As this customer was paying cash, she gave the funds to our Sales Representative, and he forwarded the funds to the insurance company.  Normally Customers pay the insurance company directly, however, we have on occasion proceeded with a cash payment as we did with this Customer. 

      On April 24, 2024, we reached out to the Customer as a reminder of the $500 remainer due on April 25,2025, but received no response.

      On April 25, 2024, we again reached out to the Customer as a reminder that the remainer of the down payment was due and owing.  Again, we received no response.

      On April 26, 2024, the Customer called and requested a postponement in paying the $500 deferred remainder of the down payment until the following Friday (5/3/2024).  We agreed to the request, under the condition that the Customer would bring the vehicle back to the car lot and the vehicle would remain there until the deferred down payment was settled.   The Customer agreed to this arrangement and promised to bring the vehicle to the car lot on Saturday morning (4/27/2024). 

      On April 27, 2024, the Customer failed to return the vehicle to the car lot and failed to communicate with us on that Saturday.

      On April 29, 2024, with the Customers failure to return the vehicle and with no communication from the Customer, repossession proceedings were initiated.  The vehicle was repossessed and secured on the same day.

      When the Customer inquired about the repossessed vehicle, we offered her the car back by paying the $500 remaining deferred down payment and the $350 repossession fee.  The Customer stated that they would not pay the repossession fee.

      In the Contract that the Customer signed when purchasing the vehicle on April 11, 2024, and under 1. Recourse,it states, Seller absolutely and unconditionally guaranteed the prompt payment of either the total unpaid amount of the contract and any accrued interest or such other amount agreed to by Seller and Assigneetogether with all costs,expenses and reasonable attorneys fees incurred in the collection of said amount; default of Buyer, or arising by reason of any extension of time given to Buyer, or by reason of any failure by Assignee, to pursue Buyer or the Collateral

      In this event, the Customer did not make good on the promise to return the vehicle to the car lot on April 27, 2024.  With no communication from the Customer by the following Monday, ********************** was within its rights to pursue the return of the vehicle and the costs incurred. The Customer was offered the vehicle back on the condition that the deferred down payment of $500 was paid and that the expense to return the vehicle (repossession fees) was also paid.

      We have merely exercised our rights under the contract once it became clear that the companys collateral was at risk because of the customers failure to honor their contractual obligations.

      As to the vehicle insurance we are not an insurance provider, therefore, we cannot refund to the Customer any insurance payments made. The customer would need to speak with the ***************** about any reimbursement of funds.

      To date, we are still working with this Customer.  Per their request, we are giving them more time to pay the remainder of the down payment,the repo fee and the first payment which was due on May 11, 2024.

      The reason why I am reject Open Lot decision due to conversation and none conversation that wasnt being held I saved that money for 6 months in the amp of $3000 dollars plus $497 for car insurance which I gave 500 dollars in cash and paid $163 for warranty coverage.. due to my employment I had six months to get a vehicle its a part of my job description to have one. I did everything to try and get the car back even offered on the 29th of April to pay half of the 500 I was told no there is nothing they can do.  I also paid for car insurance and wasnt returned any payment for the 11 days I didnt have the vehicle. On 5/1/24 I called to speak to ****** after calling three time a the same day I was told hes busy, he will call me back, and call him after 6pm I called at 6pm on 5/1/24 to speak with ************** was told hes with a customer the receptionists said she cant give me name of supervisor or number she doesnt know which two is going to come i asked for the names she said she couldnt give me the name or the number. On 5/1/24 I spoke with ****** and manager **** on speaker phone and was told I cant get the car back I told **** the situation and I was still told I cant get it back ****** said to me he will call me back and see what he can do I didnt receive a call back at all.  On 5/2/24 I 
      Called Carlot 6 times and ****** cell phone four times he answered one time and said he will call back he has a customer three hours pass I called back he said call back at 5pm 5/2/24 I 
      Called back Close to 5pm ****** had no answer he needs to speak to **** again.
      I spoke with ****** through text messages from 4/25/24-5/4/24. I received a call from ****** 5/7/24 I was in a conference meeting so I couldnt answer I texted back and I asked was he busy on 5/8/24 at 11:57am  I called and was asked did I want to get the vehicle back I told ****** yes I did due to me being in my conference I told him I have to call back I called the office twice no answer so I will be able to speak with him and his supervisor. On May 10th ****** called me twice I missed the call I called back and he said this is what I cant do you pay the down payment and the repossession which was a total of 850 I told ****** due to me paying my rent I only had $675 and I can have the rest on my pay date plus the car note that is to be due the next day on the 11th of April he said no he cant do that he need the whole amount I top him that I would call back he said ok so I called back and I was told a different price that I need to pay the 500 which the rest of the down payment plate $350 repossession fee and the car note which was 247 dollars totaling $1,097 I told him I didnt have that full amount he said let me know that was the end of the conversation. On May 11th I called ****** cell phone twice no answer he text me at 1:51 pm  and asked if he can call me later which I didnt receive a call back.. On 5/24/24 I texted ****** and I asked Are you all open today Im trying to come get the car no response he only looked at the text. I sent a text the same day and said Hello I wanted to know if you have the Jeep I want to pick it up today. No response I have the text message to prove these action and I also can retrieve my call log for communication as well.

      As part of our Retail Sales Contract, we do require that a Buyer have insurance before the vehicle is taken from the dealership.  ****** did take the payment for the insurance from the Buyer.  That payment was then taken to the insurance company by a representative of Open Lot.  Either way a refund from the insurance company must come from the insurance company and is issued upon the customer cancelling said insurance.   

      Unfortunately, the images of the text conversations from the Buyers phone do not indicate that the Buyer was communicating with ******.  Per the dates indicated in the Complaint, Open Lot was open for business.  We are open for business six (6) days a week, closed on Sunday.  On 5/24/2024 when the Buyer was supposedly texting ****** whether we were open for business, it was a Friday.  We were definitely open.

      At the heart of this matter is that the Buyer did not make good on her promise to pay the deferred $500 down payment when it was due.   And not making good on her next promise to return the vehicle to Open Lot on April 27, 2024.  The Buyers inaction caused the repossession of the vehicle and additional monies incurred. 

      We believe the Buyer has filed this response under false pretenses as the Buyer has disputed the $3000 down payment debit card transaction with her bank.   The Buyer has her $3000.  The Buyer has never made the deferred $500 down payment nor the payment for the repossession fee saying that she did not have the money.  And Buyer did not make the first payment on the car note, due on 5/11/2024, yet again she did not have the funds.

      In conclusion, this whole situation could have been avoided had the Buyer fulfilled the obligations as outlined when the contract was signed.

      The photo that I sent was from his website with the number at the bottom also if you have a IPhone there is a new caller ID method you can have on your phone with your picture saved when you call someone or they call you that is ****** the salesman I worked with.

      As part of my contract as a retailer I was required as buyer to have insurance before the vehicle was taken off the lot  from the dealership ****** the salesman that I worked with did take the payment for the insurance from me ********************************* in the amount of $500 dollars In cash that payment was I was told it was $497 ****** asked If I had change I said no. I see that  the money was then taken to the insurance company by a representative of Open lot through this complaint unbeknown to me ********************************* as to who took the payment but I was aware that it had to be paid that day on 4/11/24. 


      The images of the text conversations from my cell phone does indicate that me ********************************* was communicating with ****** with the dates I indicated in my Complaint with Open Lot . They are and were open for business on the days I was communicating with ****** besides Sunday 4/28/24. On 4/25/2024 not 5/24/2024 as Openlot says I did.. I was speaking to ****** the salesman via phone cell and office and text messages as of 4/25/24 until 05/24/2024  I was never not speaking with ****** which I have proof of due to ****** the salesman retrieving my phone to receive my utility bill because I couldnt email it to the website that was how I received ****** the salesman number and from that day I saved it to my phone. The number that I have been supposedly texting that the Carlot claims is making a false statement and I know and they know it is true the number that I have been communicating with ****** is his cell phone the number can be googled its him and his wifes other business they have which I will and can send proof of. Me the Buyer did not make good on my promise to pay the deferred $500 down payment when it was due on 4/25/2024 on 4/26/25 I did speak with ****** again about my 500 dollar payment and he advised me to do a involuntary repo I told him on 4/26/24 to let me call him back to think about it due to me not knowing what other options I had or could receive. On 4/27/2024 I did reach back out to ****** via phone I called his cell phone number and the office and I was getting no response. I did speak with ****** on 4/27/2024 and I told him I would bring the car back.. I let ****** know I would bring the car and bring back the 500 dollar down payment that Monday or Tuesday which would be 4/29 or 4/30 whichever date which he was ok with if I brought back the car. I spoke with ****** via text and cell phone and called the Open Lot office 4/27/24 he asked if I can bring the car I asked would I be able to get the car back he said yes bring it he will be there until 6pm on that day which was 4/27/24 I was not able to bring the vehicle on 4/27/24 due to me being stuck at work and not having any staff to cover my work home I do not feel I ********** caused the repossession my vehicle and additional monies incurred.  


      I ********************************* did NOT file this response under false pretenses as the Buyer I did dispute the $3000 down payment transaction with my  bank. This was complaint here was way before I decided to go that route being I had no other option ********************************* the Buyer does Not and have not received any of the $3000 dollar payment from My bank that I made to Openlot bank. Its under investigation. I ********************************* did not make the deferred $500 down payment on 4/25/24 I called ****** and communicated that with him also the receptionist which she directed me to ******. I was willing to pay the 500 dollar down payment  ************** just needed a couple of days On 4/27 as I sated I was stuck at work on 4/28/24 they are closed which was a Sunday. On 4/29/24 I had a emergency that Monday morning for work I had to take my client to the Emergency Room which I have proof of that Monday I was going to make the payment of the 500 dollars for the rest of my down payment but when I returned to my work house the car was towed from my job I immediately called the carlot and spoke with ****** and I was told its nothing he or we can do I cant get the get car back because it was repossessed and this went on for a while with me calling daily more than three time sending text messages asking can I speak to a supervisor being told I cant speak to a supervisor there is no number .


       I did not make the first payment on the car note, due on 5/11/2024, because I didnt have the vehicle as of 4/29/24 so I felt I should not have had to pay that as of yet ****** wanted me to pay the $500 hundred for the down payment and the repossession fee of $350 and the car note which is around $280 No I did not have the funds to pay all those fees that day I had to pay my rent and other bills all those fee were to much. 


      In conclusion, this whole situation could have been avoided if Openlot did not reposes my car and tell me there was nothing they can do for me to get the car back and not communicating with me properly I was willing and wanted fulfill the obligations as outlined when the contract was signed. I even offered to pay Open lot half of the down payment on 4/27/24 and ****** told me no he will not accept half of the $500 dollar down payment.

      I purchased a car from open lots about one or two years ago and they told the car has no problems so I thought I was true . I only used the car to get to work and back home, so I didt expect to be paying anything else other then the car bill but that was not the case . 5 to 6 months in the *** didt work so I had to drive like that for months before it got fix and the issue with the bcm if it don't work the car electric parts didt work so no head light and I was like that for a while before it got fixed . That was around 700 then the ac goes out and we had to buy a whole ac kit because that's what they told me was the problem 1200 more then more problems back to back and now today 03/02/2024 the transmission goes out and they fixed a module wasn't to sure if it needed fixing but they fixed it and that's more money out my pocket in total just fixing the car alone I spend around ****** just to keep the car running and what's worse out of everything they lied to me . I was forced to keep paying the car because they told me that it's going to ruin my credit and I didt want that, that was the first 8 months of me having the car . So I kept it so it won't ruin my credit, but then I purchased a new car last month at ****************** and I found out that the **** I purchased was never on my credit so I was lied to for a year or two just for me to start all over with owning a first car on my credit. This business is absolutely horrible to their customers. Oh and I texted the owner to see what's going on with my car and still yet I have no response. The **** broke down about a month ago and there is no helping me resolve this . But honestly I wasted to much money I don't want no problems because of the car . I just want at least some of my money back . I have all Receipts on what was done to keep the car running . The car was only supposed to be 9500 plus tax and everything so in total it was around ***** but because of the car repair I lost around 7000/8000

      Date 9/17/2022 made the contract to buy a car on this car dealership , at beginning not problem with the car but I noticed the hood of the car didn't closed easily as the supposed to be and saw the car was in wreck and was repaired but on the car report didn't said and after that as I use the car more mechanical issues start, I went to back to get fix it, and part of that was repaired but I got letter from lender, the loans has been cancelled caused car dealership made a mistake on the paperwork, I definitely went to ask for explanation and told me was copy problems and offer me try again or look another lender to continue with purchase and asked If this time can get better deal cause my credit score is better than the one they get or give to lender bank make me pay a lot more for it and they said no is the best they can do , after this he started being not nice tell me how do you wanna continue, return the car or try again, asking if I can get better deal and he said no , well I told him Im going give them back the car and he well lest go check the car and see the condition of it , the car was and same condition as got it and he told me the car was good and I ask when I can get my down payment back and answer me he will let me know soon from that is just gave me excuses about the when I can get the money all this conversation has been by text where ************** to send the money back soon but still no saying how much he is going to give me back of ***** dollar of down payment I made to them , I have already called to finance bank and they told me they never had any money from the car dealership , I really appreciate if you help me with this matters ill thankfully For any question call me or reach on email than for you attention

      I put $2,500 down on a car to be financed. The car lot told me I need to have full coverage to drive off so I added it to a policy that I have a car on in **********. the car I was purchasing was in Nevada. The car lot waited almost a month to inform me that the vehicle has to have Nevada insurance in order for the finance company to ***** me the loan. so for a second time in less than a month I purchase insurance but this time in Nevada. the insurance company did not put open lot as the lien holder as requested, open lock contacting me about the matter and within 48 hours the insurance company resent the documents over with Nevada insurance and with open lot as the lien holder. I spoke to open lot during those 48 hours and not one time that they informed me that my car would be repoed, instead they told me that if I get the insurance they can turn in my application to get the car loan even though I already had the car. 2 hours after submitting the documents with open lot as the lien holder my car was repoed from work and open lot with never answer any more calls, they only replied with a text informing me that they did not know what was going on and that they were contacting the finance company to see what happen. when I talked to the repo recovery business they told me that open lot issued the car to be repoed even though open lot told me that they were trying to get in touch with whoever assigned my car to be towed away. so open lot seemed to not know anything about the situation but they put in the order to repo my car. my reason for this complaint is I feel like my $2,500 was taken from me and even though I was in contact with open light everyday they never informed me on what I need to do to not get my car taken instead they told me if I get the right insurance everything would be okay and that they were trying to help me. now I have no car in my **** is completely gone, if I never received a actual loan from the finance company where's my money ?

      Southern Nevada Auto Sales has refunded the customer his down payment.

      The vehicle being listed on a policy from another state is contradictory to the contract, credit application, and all other purchase and loan documents which indicate that the customer is now a ********************** resident, purchasing a vehicle from a Nevada dealership,and with the intention of registering the vehicle in the state of Nevada.Additionally, Southern Nevada Auto Sales was not listed as a loss payee when we attempted to verify the insurance information provided. The customer was advised of this on multiple occasions but chose to ignore or procrastinate in making the necessary changes. Had the customer been involved in an accident prior to having his policy updated the insurance company could have denied the claim on the basis of fraud. Southern Nevada Auto Sales merely took action to ensure that this did not happen and only after the customer repeatedly failed to honor his contractual obligations. While it is unfortunate that the customer could not understand our position, we wish him the best of luck in shopping for a new vehicle.

      i saw a car listed on **********,.com it was a 2018 ********************, it was listed on line for 12995.00 I drove to this place with the intention of buying. they had very bad customer service all they wanted to see was my check stubs, I did not have them with me so I left. I obtained my own financing because I could tell these were some shady characters. So I came back the next day to get a purchase order to give to my bank. These people did not give me a purchase order and claimed the machine was down. but the salesman showed me what the cost of the van would be with tax, lic a and doc fees. That is normal what was not normal was the 2100.00 in fees in addition to the taxes that could not be explained. This is a criminal operation and they need to be reported to the Attorney General. I'm sure if I had agreed to the 2100.00 in additianl fees the printer for the purchase order would have magically started working. As you can guess I never got a purchase order from them in my email as requested, because that would be proof of their fraud. They are running a criminal operation.

Most motor vehicle sales are financed by a lender, but the amount of the transaction remaining--or the amount left to be financed by a third party--after down payments and trade-ins, or the amount that the price will increase with additional items such as service contracts or warranties and GAP, will always be variable. Sales prices advertised by every dealership across the country are the starting point of a motor vehicle sale transaction regardless of whether the sale is financed, or the vehicle is purchased for cash. Advertised sale prices are never the "out-the-door" price for a car. Fees charged by state or local governments are mandatory and cannot be disputed. Dealerships also lawfully charge additional fees to cover the costs of operating expenses, but dealerships are required to ensure that all fees charged are done so uniformly. We are unable to charge one fee for one customer and a completely different fee for another. As such, the fees that Mr. ***** would be charged are the fees that every customer who purchases a vehicle from Open Lot would pay. On average, the total cost of fees for buying a used motor vehicle at any dealership (not just Open Lot) in the state of Nevada are around $2,897. Average fees for purchasing a brand-new motor vehicle are nearly double at $4,296. Open Lot endeavors to remain competitive by keeping its fees lower than the average for the state, but we cannot simply choose to not charge a customer our regular fees because they are unhappy with standard industry procedures. This car was not to be financed thru open lot I had my own financing and they added 2100.00 to the online advertised price, these are scam artist, his response is a smoke screen, they need to be reported to the attorney General. Business Response /* (4000, 9, 2022/04/14) */ Mr. ******'s inability to acknowledge the realities of the used automotive market notwithstanding, Open Lot does not wish to engage in business with a consumer who chooses to be combative and adversarial. His sticking point concerns routine fees that are paid by every customer. Open Lot can not make an exception simply because he has chosen to file a complaint with the BBB, or because he is threatening to file a frivolous complaint with the Attorney General's office. Mr. ****** is welcome to take his business elsewhere. There are several used ************* being offered for sale by other dealerships in the Vegas Valley.
