      This company is doing a patio at my neighbors house and went on my property without my permission and tore my lawn up. I talked to the owner about it after it happened .. she told me she would call me back and never did till I talked to my neighbor and told her to tell them to stay of my property. They are still working on the neighbors house so I can’t fix my lawn till they are done! This has been going insincere beggining of June!

      To Whom It May Concern:

      In all instances of projects contracted by a contractee/homeowner, where there is a neighbor in close proximity to the contractee or a shared access road; it is incumbent upon the homeowner to notify said neighbor and/or ask permission when needed to obtain access to contractee’s project area. 

      In this case, our sub-contractor was told by the homeowner/contractee - the complainant’s neighbor, that he had permission use her side-yard, a small pass-through area between the two houses.  Unfortunately, there were tire marks left between the two houses, and on the neighbor’s yard.

      The complainant notified Prestige Construction WNY upon our next visit of the damage and we told her that we would take care of her lawn.  Part of our business is landscaping, and we had no problem adding some topsoil, and reseeding her lawn in the area where the tire marks were left.  We also informed here that we would do so once the project was complete, so as to not risk the possibility of further damage.

      About 10 days later, the same day as we were at the contractee’s house again to remeasure her patio area, the complainant phoned Prestige again to inform our company that we did not have her permission to enter her yard, and that we were going to have to find another means of entering the neighbor’s backyard.  We agreed that we would not use her yard again.  We offered to re-seed her lawn at that time, and she informed us that she was going to have a friend fix her yard.

      From the time that the damage occurred it did take some additional time to finish the project while the contractee decided whether she wanted to expand the size of her patio, and then our sub-contractor contracted Covid.  When we were finished, the complainant maintained that she would have her friend fix her lawn.  We offered, but she refused our services.

      I feel I should be able to hire my own landscaper to fix the lawn at their expense. They are not a landscaping business! They told me all it needs is grass seed. I need topsoil and leveling and grass seed. They left cigarettes everywhere so I don’t want them on my property again.

      I have spoken with ******* ************ and informed her that we are NOT the contractor doing her driveway. We completed our work on the neighbor’s patio on July 22nd and had no further work to do at her house. We are not responsible for the contractor doing her neighbor’s driveway. We are not the ones putting cigarette butts on her lawn as we finished our job weeks ago. She was made aware of this when she called me, but still chose to file the complaint under our company name.

      I’m not quite sure why they are talking about the driveway?My complaint is about the work that was done at my neighbor when she had her patio done. It has nothing to do with her driveway?  The damage was done to my lawn when my neighbors patio was done by them. They sub contracted the job out so it’s their responsibility. I have sent you pictures of my lawn from the damage that was done to my lawn. If you didn’t receive them I will resend them to you again. It took them 3 months to finish the patio!I could not keep waiting for them to finish the job… I need them to reimburse me for the topsoil and seed and labor to fix my lawn.
