On June 6, 2023, we signed a contract with JMEG installations for a deck tear down and rebuild. We gave the owner a bank check for $6784. We were told the deck would be completed by the end of the month. By 07/17, we had heard nothing from the owner, called him and he said he would begin the job on 07/20. We returned from vacation on 08/01 and no work had been done. A flurry of phone calls later, we were told they would be here mid August, again no show. At the end of the month, the deck was partially torn down and support poles installed. A few weeks later, partial floor joists were added. Between July and November we have contacted the owner 20 times to ask when the deck would be completed. He is now not returning any of our calls. We want a full refund issued in a bank check as we believe we have been scammed by an owner who clearly has no intention of honoring our contract. In addition, we have discovered 2 other people who have had the same experience we have had. The owner has taken 50% deposits from all of us and has not done any contracted work.Business response

I did take the old deck down, got the permit and poured the holes. I set all new footers, carrier beams, and joists. I need to finish the decking and stairs. I am hoping to finish the framing and start decking next week.

Summary: On 6/28/2023, I signed a contract with James Pollack (JMEG Installations) for demo and reconstruction of my desk to be resurfaced with **** decking and pressure treated railing with rod iron spindles with a matching gate as the top of the stairs for $17,211.75 and provided a $8600.00 deposit. Mr. Pollack also signed the contract. On 8/18/2023 the majority of the work was completed (with the exception of the gate), I paid the remainder of the contract. Between 8/20/2023 and 10/22/2023, I repeatedly contacted Mr. Pollack and received 3 separate dates and assurances the work would be completed. As of 10/22/2023 it is not.Business response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. Mr. Pollack has previously given me 3 firm dates when he would "pick up the gate and get it installed by date____". He failed to do so in each instance. That 3rd failure was what led me to file this claim and why I asked for a refund instead. I have absolutely NO faith he will do so this time either. And because my accepting his offer closes this case, I believe that problematic. IF he does get the gate installed, and I am satisfied with his work THEN I will close the case. I am currently in the midst of an egregious battle with JMEG Installations (James P****** and Meghan D*****), to recover my full 50% deposit that was given to them in good faith. Despite our initial discussions and their assurances, the services promised (finishing basement and egress window) were not fulfilled, and as a result, I am left with no choice but to seek a refund for the aforementioned deposit. I am also dealing with the ******** District Attorney in charge of Financial Crimes, as well as ********* Police, to recoup my losses. What's more concerning is their unprofessional behavior when my wife and I requested a refund for the full amount of the deposit. Megan D***** of JMEG verbally abused my wife and used offensive language and belittled her. Upon contacting James P****** to address the issue, he initially agreed to the refund but later changed his tone, using threats and intimidation tactics. He told me verbatim he would “pound my face in,” multiple times, after I suggested that we meet the next day before work at the JMEG address that was listed to me on the estimate. I suggested this in an attempt to make it convenient for him to return my deposit, as earlier that day he sent me a photo of a flat tire as a reason to excuse his no-show. This escalated to a point where I had to involve the police and legal authorities due to their hostile behavior. A report was made and James and Megan were contacted, and instructed them to return our money within a week. Only after involving legal authorities, Megan offered a partial refund, met with more intimidation tactics, making it clear that their priority was anything but customer satisfaction. In the end, after being subjected to intimidation, threats, and deceit, I reluctantly accepted a partial refund of $5000 instead of the full amount, just to put an end to the ordeal. I will continue to pursue this matter legally to seek justice for the remaining $623.50Business response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does NOT resolve my complaint. I won in small claims court on October 3rd, 2023 - Case #******** in the ******** Town Court of ********. Judged ruled in my favor for JMEG to refund the remaining $500 by November 1st 2023. JMEG never paid the $500 judgment. I submitted the judgment against ***** ******* and ***** ****** to ******** County Clerk on November 2nd 2023 after the transcript was released to me. Please see attachments for proof. I will resolve this claim once they pay back the remaining $500 that is owed. Regards, *** ******
