In September of 2023 I signed a contract with Rob Oleary, owner of RJ Lawn and Landscape, for a $13,223.92 landscape job at our home. We gave Rob a check for $3,967.18 as a 30% down payment. Since then Rob has refused to answer all phone calls, return voicemails, texts, or Facebook Messenger messages. The new business address is 3536 State Route 247, Canandaigua, NY.Initial Complaint

In January of 2022, I signed a contract with RJ Lawn and Landscape for a backyard project that included a concrete patio surrounding a pool, a small deck from the house to the patio, a vinyl fence, landscaping, and a fire pit. A 10% deposit was put down at the time of signing the contract with an anticipated start of September of 2022. The project was to take 30-60 days. On 8/4/2022 an additional 40% of the total was paid “30 days prior to anticipated start date”. September and October 2022 pass with no work done. Minimal work done in November. During this time communication was scarce from RJ and always initiated by me, receiving vague answers/excuses. The project went dormant over the winter. In the Spring of 2023, same pattern of behavior, with multiple delays/excuses. RJ poured the concrete with his team instead of subcontracting it out to save himself money (according to him). He completely botched the job in every conceivable way. The pour’s finish was extremely rough and uneven, among many other issues with it. He claimed he could fix it and after July and August pass, said he would put paver stone over it but I would need to purchase the paver stone up front. This solution was agreed to with the addendum that all work would be completed within 30 days of the stone delivery which was on September 8th, 2023. I have not heard from RJ since Friday October 20th, despite multiple calls, texts, and emails. The fire pit, fence, and lawn repair are all incomplete, and at this point I am forced to believe he has abandoned this project. I am now seeking to recover over $9,500 in work paid for and not completed by RJ and will seek legal action against him if not refunded. RJ has shown throughout this process to be untrustworthy, incompetent, and unethical. A project that was supposed to be finished in 2022, will now continue to not be finished in 2023 and I am left needing to find another contractor to finish the job and having to try and recover over $9,500 from RJ.Initial Complaint

We contracted with RJ Lawn and Landscape to deliver a patio renovation project in May 2023. We were told the work would commence in June and be completed in 1-2 weeks, ahead of a planned graduation party. RJ collected a deposit from me of $7,500. No material was ever delivered, no work was ever done. After multiple attempts to contact RJ, we finally spoke in July and he told us he would provide a form to release us from the contract and pay our full deposit back. His words- "I wont hold your feet to the fire, I will just refund your $7,500 down payment". He never sent a form, and after repeated attempts to contact him via phone and email he has not communicated at all and has not sent a release form, has not returned our money.Initial Complaint

I put a deposit down for $1,000 on 6/16/22 for a comprehensive hardscape design of our "front/back" which was supposed to include "3D plans, scope of work/material list, detailed preliminary cost estimate, and $1,000 credit if contracted to do project" for both the front and back. I received a design/estimate for ONLY the front, which happened to be $5,000 higher than RJ's verbal estimate. We moved forward anyways, despite these failures, and put down an additional $5,750 on 8/3/22 with a signed contract to do the work. I was told this money would "get you on the schedule" for September, and RJ also conceded that there may be some delays which could push us back into the first week of October at the latest. Our project continued to get pushed back, and ultimately was not completed in 2022. Not once did Rob reach out to me to notify me of these ongoing delays. I had to rely on my own monthly inquiries into the status of our project. I requested a full refund on 12/15/22 and I was informed at that point that the project would not be completed until following Spring. I was offered a 10% discount to "remain on the schedule", which I declined. I received a refund request form to sign which was pre-filled out for $5,750. This amount is clearly $1,000 short of the amount owed to me. When I subsequently requested the full amount of $6,750, I received no response. I have received no further communication nor have I received a refund since my request. I am seeking a full refund of my money and I am concerned with the lack of communication throughout this entire process. I find this to be profoundly unprofessional, if not negligent. It is unacceptable to take peoples money, tell them to expect a September 2022 start date, not communicate during the process, and not be able to start the project until Spring of 2023. Furthermore, it is unacceptable to be unavailable and unresponsive once the project was cancelled without providing an expeditious refund.Business response

This is a very tough and unfortunate situation.
Although we had every intention and worked hard to stay on schedule and complete this project within the time frame discussed, it just got pushed too far and it became unfair to the family.
Ultimately, we failed to deliver this project before end of 2022 and upon a final discussion with the client we have agreed to refund the deposit and cancel the project.

I have reviewed the response made by the business in reference to complaint ID ********. RJ lawn and landscape has agreed to refund my money and has provided 50% of the refund. I am still owed $3,375 and will update this record once the issue is completely resolved.
