  About 4 months ago, natale and I agreed on a deposit for land in Spalding green development, with the agreement that if we did not build with them I would get a refund of my deposit minua a few hundred dollars for lawyers fees. I have an email stating this. Fast forward several months, and we decided to not build with them because their price point was to high. We told them we would not be building with them 8 weeks ago and over the past 6 weeks I have emailed them 9 times and they have not given me my deposit back. The deposit was for $5000. They keep telling me the check is on its way, but I have not received it . They then offered me half of the deposit back without giving me any explanation of fees. I have emails proving everything that has been said I just want to get my deposit back and never deal with them again.

  Hello:  I was supposed to issue the $2,500 check but was out sick and hadn't had time.  The same day the customer contacted me, I tried to explain and resolve the issue and offered to refund $2,500 of the $5,000 deposit-I told him he could even come and pick it up if he didn't want to wait for the mail.  We were offering to refund half, even though the professional services exceeded the $5,000.  Here is a summary:

  The  Principal fees consist of at least 8 to 10 in person meetings averaging 1 to 1.5 hours; there were on site visits walking the lot and at least 50 emails.  The Estimating is time includes costing the project, getting plans/specs to trades, trade meetings/discussions, setting up spreadsheets & cost comparables.  Inhouse drafting is straight time draftsperson signed in & worked on the project.  the other time includes setting up files/managing communications and providing information.  

  As I told the customer, I would have had a check the same day he contact me and would have provided this information but he didn't want to wait and decided to submit the complaint.  We are still willing to issue the $2,500 check and the customer may pick up, I just need to know.
