On 2/21/2022, I signed a contract with McClure & Sons to have my bathroom and kitchen floors redone, along with 50% down payment ($1400). Work was to begin on 3/21/2022. On 3/17/2022, I confirmed via text message that work was to begin as scheduled, with an affirmative response. Nobody showed up the next week, and text messages on 3/21/2022, 3/24/2022, and 3/27/2022 went unanswered. On 3/29/2022, I received a text that they had fallen behind on another project, but they would be to my project on Monday, 4/4/2022. Once again, nobody showed up to work, and there was no communication. On 4/5/2022, I sent a text stating that if the work was not going to be completed by 4/13/2022 that I wanted to deposit back. No response. On 4/7/2022, I sent an email stating same as above. On 4/18/2022, I sent a text stating that I would be filing complaints if my deposit was not returned by 4/22/2022. There was a response, and John McClure stated he would return my deposit. As of 5/6/2022, I have not received my money back, and there has been no further communication from McClure.Initial Complaint

We met with John McClure and our 22 year old son who had just bought a house. John signed a contract for work to be done and the price was set for $34,000. John was to renovate the entire house and side with vinyl. We paid John $17,000 up front for materials with completion of the work in 2-4 weeks. After six weeks, the only work done is a small exterior room and extremely small front porch removed, sheet rock in one room and a short wall removed. We have called, sent texts and talked in person to John who has repeatedly told us the work will be done. At this time, he has begun to get belligerent towards us and now refuses to answer any calls, or requests for refund. He took $17,000 and has not done anything even close to $17,000 worth of work! We are requesting a refund of our money (less a reasonable/rational amount owed for small demolition work and sheet rock in one room) now that John has walked out on the job. We have seen other complaints against John McClure for taking money and not completing agreed upon work.Business response

The client was engaged in a contract to trade a house they own for the work being done on their sons house then the client tried to sell the house that I was recieving for the work I was performing and the project is half completed so I charged them for half the money for work that was completed. They now want a refund after I paid for materials and labor out of my pocket up until charging them for work performed so no they are not being reimbursed!!Customer response

Better Business Bureau: I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. Attached are 2 text messages from McClure and sons construction owner John McClure stating 2 separate times that the deal for the house in question was not gonna to happen. That was after we paid him the $17,000 with the under that he would pay that back to us as down payment for the Main Street house within 2 days. To date we still have not received any money back, and work has not been completed on tour sons house. This is not the first complaint against John McClure for taking money and not providing services. I am in contact with others in the same situation. In short, John took $17,00 from our son, and did little to no work. He through text messages has said the Main Street deal is off. Construction job agreed to in December of 2021, job completed on March 1st 2022, however upon examining everything and paying in full, I noticed next day that one security camera was not working, a wiring issue in the area they were working on. I contacted McClure & Sons to have it repaired. I was advised that he would be by the next day, being March 4th 2022, to take care of it, he never showed, never called. I had further contact with him in a few days, I advised him I knew what the problem might be, and it might not be able a lot of time for him to repair it, his response was that I could fix it myself if I know where the issue is if it's urgent. I keep getting pushed off that he's too busy to take care of it right now, this is an electrical wiring issue that needs to be addressed. He has agreed to come back to finish some outside work he has to do with the back porch. Otherwise it was an okay job.Business response

Mr ******* has not been advised an exact day when I will be there to repair the camera I said I would get to it as soon as I can it's not an emergency. I am helping people that have there foundations falling out from under their house.Customer response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
I have not heard anything from the contractor.
They initially said when I notified them on March 2, 2022 of the electrical issue they created, that they would be there the next day, but never showed up (text image attached).
Although I did accept his expanded response that he was working on a emergency project, it does not mean it's resolved yet, as they only told me theey were busy, and said they would get to it whenever they can, but that could be anytime, and told me that if I knew what it was I could fix it myself.
Additionally there's a couple of things that need to be fixed that we're reaized now, not finished completely not mentioned earlier...being GFI outlet outlet in bathroom is not resetting because it's full of plaster dust, improper repair of back porch as vertical post was not replaced as they only put a horizontal beam on top, no GFI outlet in kitchen unless it is not needed, and need to check voltage or breaker on outlet connecting to the electric stove.
Also, additional after I filed the complaint on March 18 2022, they did reply in a text message (text image attached) with a threat to put me on a not to work for list, which is retaliation, being completely different than any complaint, and in violation of the federal trade commission and consumer fairness act.
Looking for a peaceful solution, but if he does not want to get to it, or can not, we can apply a part refund.

Have not seen McClure & Sons return to the property as he stated he did "after April 7, 2022,"; if so, what date and time, I have not heard from him notifying he would be there or was there. Additional security cameras have not shown him on the property, nor has any tenant seen him. If he was there, I'm sure he would have notified me as proper procedure that he was going to the property to enter the premises and would have notified me also that he looked into the wiring issue that involved them, whether they found anything or not.
Therefore issues from their work are still not resolved since March 2, 2022; although he stated he would be there on March 3, 2022 to take care of it.
Also, It is not a handyman issue as they stated, it's a wiring issue they created, somehow breaking the electrical connection to a security camera when doing new wiring.They also have not returned my keys, which is now considered theft of property.
They also agreed to return to install a steel bumper post as a protection guard for the porch post at a later date, when we purchase it, which is part of the project. So they have not completed every aspect of the project as of yet, as they stated.
As stated before to BBB with other pictures, additional to the initial electrical issue created by the contractor on the last day of the project, they seemed to be in a real hurry to get out of this project on March 1, 2022 to start another one, it was realized they did not install a new vertical post support replacing an existing back porch 4x4 post that was initially pointed out by them as not in good shape and would be changed, they installed a roof horizontal support as a patch over a cut support that was not removed, added a bad or used 240volt breaker and outlet for electric stove that is not functioning properly and wire with ripped insulation lying on a hot water pipe, new GFI outlet they installed in bathroom is not functioning for reset, and they did not put a GFI outlet in the kitchen which is required, binstalled a wo pronged outlet.Some pictures attached.
I have had to hire an electrical contractor to verify the above electric issues and will fix them, as I do not expect McClure and Sons to return to repair their errors. I have another good contractor who noticed heir sloppy work and will finish up the project.
Therefore this will remain unresolved from my aspect.

On 6 May 2021, John Mcclure sent me a contract for work on a building. We met and agreed to the contract and I gave him the down payment for the work to be done. As the work requires a full removal of a roof, he stated that he was waiting for four days of no rain to do the work. While it has been an unusually rainy summer, I've have checked in with him regularly for progress and he has assured me that everything has been ready to go and he is waiting on weather. On 17 October 2021 I checked in with him and he responded that the materials have been ordered and will be in next Friday (22 October). He promised to send progress photos at that time. On 19 November 2021 I contacted him and asked for progress by the end of the month because I am beginning to feel jerked around. He blamed the weather and said he would move forward if I was okay with risking rain damage. I said to go ahead regardless of weather because the roof has been leaking and doing damage all this time already. I have heard nothing from him since 19 November 2021 and I do not know what kind of options I may have for mediation and resolution. I have a signed contract with him and I found his information through a BBB list. I have already paid him $7530 for materials and $5850 for labor and am contracted to pay him another $5850 upon completion. Please advise me on how I can see this contract fulfilled. The job has been on hold due to extreme weather conditions in our area. Then myself and my entire crew caught the covid 19 we have just recently recovered from this and now we can move forward on this project. I have not heard from ****** ******* since October I am not avoiding anyone. We are now behind schedule on all of our projects not just this one. So progress will start very shortly and I will be sending progress pictures to her.Customer response

Better Business Bureau: I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me. For purposes of correct documentation I have attached screen shots of the most recent chat that I shared with John McClure, the date shows as 15, November, 2021. There has been no information shared about medical issues nor any notification that there would be further delay after my last response.There has been no further contact between John McClure and I since I filed this complaint.
