      I purchased a vintage loveseat and two chairs from an online auction house, ****** 52, on July 18, 2023. The condition was as follows: "Good vintage condition .... trace of age and use." The total cost was $5,873.90, which included the furniture, buyer's premium, tax, and shipping (from *****). The invoice number was *******. When the furniture arrived, I found that it smelled strongly of mildew and mold and I wrote to ****** 52 immediately (8/12/23) to apprise them. Their "Happiness Agent", ***, subsequently requested that I have an independent expert provide written documentation confirming that the furniture smelled. I forwarded such a letter from a reputable antique furniture upholsterer on 8/26/23. I have requested a full refund and arrangements for the furniture to be picked up and returned to the auction house. It is now over 7 weeks since I wrote to ****** 52 about the misrepresented furniture and I have received no refund. Over 50 back and forth email messages have been devoted to this matter, but there is endless procrastination on the part of ****** 52 and no commitment to resolution. This is despite the fact that the ****** 52 fine print reads: "Your purchase is protected. Photos, descriptions, and estimates have been meticulously prepared by fully certified experts and appraisers. All items in this sale are guaranteed to be authentic. In the rare event that an item does not match the lot description in the sale, our Jasper52 specialists are here to assist. Buyers may request a full refund if they notify Jasper52 within 5 days of receiving the item." I am in the unfortunate position of having spent almost $6,000 on misrepresented items from an online auction dealer that is not fulfilling its stated pledge. I have a set of smelly furniture that is sitting in my garage because I do not want to contaminate my home with mildew and mold. I request that the BBB intervene in this matter. Thank you.

      This case is straightforward.  ****** 52 sold an item at auction that was misrepresented.  I alerted them that this was the case and requested a full refund.  ****** 52's stated policy is that it will provide a full refund if an item is not as described.  I have been waiting for almost two months and there has been no resolution, despite my having provided the requested third party independent expert verification that documented that, in fact, the furniture smells horrible.  ****** 52 has the full correspondence I have had with their Happiness Agent, ***.  There is no justification for delay in sending a full refund.  ****** 52 is responsible for the auction items it sells and therefore ****** 52 is responsible for making the refund.  I request that the refund be sent today.  [Your Answer Here]

      On June 16, 2021, I purchased a ring from Jasper52 through LiveAuctioneers. According to Jasper52, this was a natural pink diamond. The *** certificate included with the stone states it is a fancy pink natural diamond. However, it has a note saying "Color of stones shown is generated of special gold micro coating " and says underneath "Natural Pink Diamond". When I questioned Jasper52 about that certificate, they replied that it was still in natural pink diamond. Their response will be uploaded below. I was unhappy with their response and recently decided to have the main diamond certified by the ********************* of America, which is frequently done with colored diamonds, especially if one would like to insure them.I took the ring to *************************** in ********. The results are shown below. The photos show that there was a coating on the mounting and the bottom of the diamond, that dissolved with acetone, which suggests this diamond had been coated with a compound similar to nail polish. The REAL problem is that the diamond below has no pink color whatsoever. So, unlike their statement in the advertisement and their email from November 2021, the diamond is not pink; it is not even a faint pink diamond. It is brownish and evaluated as O-P in color according to two (2) Graduate Gemologists. This is clearly Fraud.I reported this to LiveAuctioneers and Jasper52. When I requested a refund, Jasper52 replied:Jasper52 Support via helpscout.net 11:10?AM (1 hour ago)to me ******** *** *** **** ******** ** ************ ******* *** ******** *** ** *** *** **** ********* ** ***** *** ******** ** **** ****** * **** **** ******* *** ** **** ****** ** ****** ******* * ****** ** ** ** ** ****** *************************************** ********************************** They refused a refund for a fraudulent transaction! NOTE: Liveauctioneers has hundreds of pink diamonds for auction. Natural pink diamonds constitute about 0.1% of the mined diamonds.

      I am sorry to hear about your issue. In looking at your case, I can see that the sale is dated 2 year back. On the lot page, we have indicated that buyers can reach out within 5 days of receiving the item, in order to be covered. Partly, the reason behind this timeframe, is to ensure that the item in question, is the same item that was sold - we do have a returns policy in place, to help our buyers. I am sorry that the termination was not in your favor, but we have to follow our policy to ensure the integrity of our sales.

      The business response is that they give a customer 5 days to figure out that underneath the coating there is a yellowish diamond. They know that no gemological laboratory would have tested it in 5 days and the odds of the customer getting acetone on the ring within a 5 day period is very low.

      I refuse to accept this response because this is a case of fraud.  This was sold as a natural pink diamond, but it was coated with nail polish (or a similiar compound) to give it that color. The color came off as the acetone touched the diamond. Pink diamonds constitute less than 0.1% of the diamonds in nature.  They are rare.  The seller lied by saying that this is a natural pink diamond.  The diamond is O-P in color.  The pink color seen in the original ring is ONLY due to nail polish.  Underneath there was no pink stone.  This is FRAUD. It is absurd to say to a customer:  "if you don't discover my fraud within 5 days, you can't make any claims."  That is in essence was this business is doing.  

      Again:  Jasper52 lied about what the item was.  They said it was a natural pink diamond and it is NOT.  Not only am I demanding a refund, but, also, I have notified several jewelry organizations of this situation.

      On May 7, 2022 I purchased a painting on LiveAuctioneers in the amount of $1,725. USD that was sold by Jasper52.The transportation is $395. USD plus payment in the amount of $1,725. USD was paid to Jasper52. (Attached Please find paid Invoice in the amount of $2,120.)I was recently informed, after months of searching, that this painting is in Formal Abandonment by *********** Customs.I would like to make a formal complaint & request that I either receive the purchased item with no more costs OR that I am fully reimbursed for all my expenses in the amount of $2,120.       I purchased 2 fur coats during an auction. Jasper52 is acting as the agent for the client in the *******. The to coats arrive and one is much too small; much smaller than the size 12 stated. The other coats, or both coats now, smells sickly sweet with an overpowering stench or bordello sweet perfume. The overpowering smell of sickly sweet perfume was so strong it filled the room until we were forced to remove the items to an out of doors location. Jasper52 will reluctantly take back the items that were mislabeled and misrepresented but there is a caveat: they will only take them back if they are sent to **************. I guess they don't want their showroom smelling like a cheap bordello. I bought from a *** firm and I will return these furs to a *** firm.Jasper is not being a standup company and is wanting to wash their hands of it. I want to be done with them and wash my house of the "stink"

      I bid and won an advertised Star ***** which was beautiful, clear and very nice. They mailed a piece of redish milky color stone FAR from and COMPLETELY DIFFERENT than the one advertised. I complained the moment ai received the stone, and sent pictures. Jasper52 are DISHONEST AND SCAMMERS.i sent pictures in regular light, they asked me for photos in natural light (which made the stone look worse), then they asked me to put a light right above, the stone which showed the dark spots inside the stone. None of the pictures show the stone as advertised yet they refused to refund the money.Live Auctioneers doesnt support the clients BEWARE OF THIS COMPANY.

      Hell, I just received a letter that I had not replied stating that my complain has been solved. I has note been solved. I contacted the seller and they couldnt care less. They said the seller told them that was the stone, even though the pictures I sent compared to their advertised product (which is what I thought I was buying) are completely different.

      Lot ****, Fine ********************* *** description stated 100 % natural Baltic ***** pressed. I put it under a black UV light. It is 100 % composite. While it does have ***** it is not 100 % natural. *** photos vs the actual item is night and day. It does not float in salt water and is sticky when wet. *** description also said will be shipping from *******-it was shipped from *******. *** auction ended on August 2nd and I just received Sept. 9th. One of the items was lost and had to be substituted. Contacted auction house-they want a third party verification of my claim. I have been dealing in jewelry for over 20 yrs, the items are not ****** I refused to pay another cent to a third party to tell me what I already know. I just want to return the items and get a refund.

      Date of transaction: July 5, 2022 Amount of dispute: $1,132.75 Nature of Dispute: Leading up to the auction I had not met the reserve price for four items. On the day of the auction this auctioneer lowered the reserve price to match the my bid. Coincidentally I was the only one to bid on the items, and as stated, I had not mer the reserve going into the auction. They also removed the option to retract my bid. This auctioneer deceptively adjusted the reserve amount just to make a sale and refuses to provide a resolution in the form of a refund. I did not accept the shipment of the items, therefore I do not have the items that I paid for.

      At this time the shipment has not been sent back to the listing agent so the items are still not recovered. While there is one item that buyer is questioning, they have disputed the entire amount which they have stated they clearly won three of the items. As for the item they take issue with, our consignors do ask us to lower reserves on the day of the auction if they are able to give us more room to help make sales. LiveAuctioneers (the platform for the auction) sends out messages to bidders when these changes happen and those changes happen 24 hours in advance of the sale going live. 

      The buyer had ample time to retract their bid, as bids are only locked in 2 hours prior the start of the auction. As the buyer has already stated they will issue a Chargeback on the payment, we will work through the dispute process at this time.

      2. My dispute encompasses all four items. 

      3. LiveAuctioneers did not send nor did I receive notifications regarding changes to the reserve price. 

      4. The ability to retract bids was turned off more than 24 hours before the auction, which is when I checked.

      This buyer was given every opportunity to withdraw their bid, and make other arrangements. The buyer neglected to see where the items were shipping from. As we have stated before the listing agent does not confirm the receipt of the packages back to them. Therefore, we must keep the dispute on the buyers account. Once the listing agent confirms they have the items again, we will remove the dispute. Until that time, we will fight the chargeback with their credit card company and will handle the process with them directly.

      Broken ********************** in question was purchased on April 19, I received the necklace without a clasp, I was told to send the lot #****, along with the invoice #*******, and a picture, they reviewed the invoice pictures but said they never received the pictur of the necklace in which I resent different pictures every day, I even shrank them down incase they were to large to view. I have Emails saved from when I started to suspect something was Ary. From April26,27,28,29, on the 30 I sent another picture, more again on the 30. Then on May 2- 3x, 4, 6-4, 8, 23, on the 24th I finally heard from them, then they said they finally received the picture and was sending it to the listing agent, on the 27 i heard back again that its past 30 days, then on June 1st they said I could return it for them to fix the clasp.i received the necklace on the 25th of April, andI left on Vacation on the 26th, I didn't return until May 19. So all the emails were from me when on holiday. I would like a full refund of ****** I was also under the impression it was a Amber ********* but it's actually bake-o-lite.
