Started June of 2022. After the tornado we were gathering estimates. He came out gave as a estimate on the entire fence, siding lifted, gutters full with debris and bent. The first estimate ( 11, 800) had to redo to the fact the insurance was giving us less money. We went from cedar (the first estimate) to treated. The difference of 1300. Total price of 10,500. I was required to put a 500 deposit at that time. That was July 2022. Was give a completion date of the first week of September 2022. Several messages to him about starting and finally the Fence was up in November of 2022 almost three months after he was paid in full. (Aug 8th 2022)He promised to fill holes with the fill dirt in our yard and up by the fence which never happened. His crew stole signs that we did get back after complaining. He was paid in full, August 6th of 2022 and was supposed to return and complete the siding, gutters, power washing & fill dirt the following weekend. It’s now January 2023. After Multiple multiple text messages from *** and myself that went mostly unanswered. I did tell him we were going to file in small claims court to get our $1156.00 that he was paid. Only then did he finally say that he would make it right to me but yet has failed. This was all the money that was given to us by the insurance company to finish the work from the tornado damage he’s made multiple multiple promises and never shows up. I have every text message promising to make it right and to complete the work but he’s yet to show up. After this we will be filing this week in small claims court to try to get our money back from him. I recommend that nobody pay this man until the job is 100% complete this is totally my fault because I trusted him. A resolution would be our 1156.00 paid back to us.

I hired this company to erect a 6 foot privacy fence in my back yard 2021. Owner, ****** ******* claimed 27 years experience. Owner did not call Mansfield codes and permit office to confirm a permit was needed or not. A permit was REQUIRED for my zone. Thankfully, my neighbor called on my behalf. Work is still unfinished to this day. The double gate needs rebuilt. One side of the gate is severely warped and the other does not open all the way (it runs into the driveway). He has promised me at least 4 different days he would have it fixed and not a single employee has come to fix the gate. He directly ignored one one of my calls and let many others ring through to his non-existent voicemail. I also visited his office at **** **** *** ****** ********** ** *****. His receptionist took my information and told me he would have ****** on-site by 5pm that same day - he did not show. Owner overstayed his welcome at my home on weekends and evenings while we were in contract. Now, he refuses to communicate with me. He also lit a cigarette at my backdoor with my pregnant wife nearby. We do not smoke. He last told me on June 29, 2022, "I have a job at the reformatory I will be at until July 18th. I will get to you July 19th."

      Business response

      07/07/2022

Prior to 1st installation, customer was instructed to get a survey, as he lives in-town (Mansfield, Ohio); he refused. customer wanted the fence to be installed directly next to city sidewalk. customer refused to get property surveyed. and said he wants fence snug against side walk. we did as customer instructed.

once city said they "own" a portion of said section, customer said we need to move it at our expense and refused to pay any for removal. we moved fence at our expense.

      this customer was rude.

I did NOT ever smoke a cigarette nor light a cigarette at his back door!!

WE DO NOT WORK WEEKENDS.  we believe weekends are for God and family.

the picture attached is of the "new install". You can see the original posts we set next to sidewalk. we cut them off and added border as customer said he would plant flowers etc.

as far as his gate, we do not warranty warpage.

we had every intention of addressing any issue that may have been a defect in our workmanship, if any.

      thank you.

      Customer response

      07/07/2022

I am rejecting this response because:

      1. Jay's Fencing never recommended a pin survey to me. The first time it was recommended was during Mansfield's city planning committee meeting for us to obtain a permit (reminder: my neighbor called codes and permit office). I happily obtained pin survey without conflict to ensure the fence was built on my property. I did want the fence to extend as close to the sidewalk as possible, but it was not reasonable for it to be directly next to the sidewalk. The reason I hired a professional company was to be the subject matter expert and make appropriate recommendations for permits and placement of fence. I refused to pay for the posts to be cut, as the professional should have considered a pin survey and permits.

      2. Jay's Fencing claimed, "You don't need a permit because we [(Jay's Fencing)] are replacing an existing fence." Reminder, my neighbor called Mansfield codes and permit office on my behalf, since Jay's Fencing did not call.

      3. "this customer was rude." Please elaborate. This is non-specific in describing behavior. Having expectations of a professional company and being rude is very different. I think owner and I we're quite cordial and rapport building throughout the process. I am not going to get personal in a business dispute. I treat everyone with respect and dignity.

      4. My wife was in the kitchen when the owner lit a cigarette at my backdoor (the backdoor leads directly to the kitchen). She could smell the cigarette. Thankfully, he extinguished the cigarette upon request.

      5. I do not know why "WE DO NOT WORK WEEKENDS.  we believe weekends are for God and family." was included. That is great the owner dedicates time to "God and family". Owner most certainly showed up at my house in the evening and weekends. My wife vividly remembers owner coming to my house on a weekend at 7pm because I was not home. I work some weekends and 13 hour days. That was a weekend I worked.

      6. I never wanted a flower bed. I specifically told owner, "I do not want to maintain a flower bed."

      7. The gate was warped within the first few days of install. The gate warped because the lumber used was warped prior to install. I

      8. Unfortunately, my last resort was filing a complaint with BBB about the quality of work. Intentions and actions are drastically different in this case. Owner promised four other instances when someone would fix it and it never came to fruition. The only way I could get owner to take action was to file a complaint to motivate him enough to fix their work. I hired, which I have paid in full, a professional company to execute on a high quality, professional level.

In closing, I am simply an unsatisfied customer; and I want the warped gate fixed and for the gate to function properly without defect. Regardless of all the other points made within the complaint and responses to the owner, I want what I have paid for fixed. Upon fixing the gate, I will resolve/remove my complaint.

May God bless you and keep you in His favor,
      ******* ****
