      On 8-8-24, I purchased a ***** grill from the auction, it was listed as new, when I got it home and started to put it together I saw that it was damaged (one leg was severely bent) and it was missing all of the hardware needed for assembly. I paid $365 for it because I thought it was new. I want to know why the seller listed this as new in box when it is very obviously NOT new and how is the seller allowed to falsely advertise a product as new and knowing that it isnt new be able to take someones money?

      As you know, our terms and conditions clearly state that all items must be thoroughly inspected before leaving the warehouse. Once an item has left the building, no refunds will be issued. You agreed to these terms no less than 58 times across six accounts, one of which is currently in default for failure to pay.

      You also acknowledged these rules during the purchase of the ***** Spirit grill, which you inspected before leaving the premises.

      The grill you purchased was listed as "New," and the winning bid was $285 for an item with a retail value of $639.

      We understand your concern regarding the missing hardware and bent legs; however, as per our policy, all new items must be checked on-site.

      You mentioned that you inspected the item and believed it had all necessary parts before departure.

      Unfortunately, once an item has left our facility, we cannot control what happens to it and thus cannot offer a refund.

      Please be aware that our listings are accurate, and our terms and conditions are designed to protect both the buyer and the seller. We encourage all customers to thoroughly inspect their items and understand the terms they agree to before bidding.

      The item was lusted as new, there is no way to know what hardware is needed or supplied. You shouldn't list an item as new unless your cimpany has inspected the item and know it is new with all parts, I believe Ohio has consumer acts that protect buyers from a business selling items as new and the are not. It is not the buyers responsible to make sure this company is selling or advertising items correctly.

      We have reviewed this complaint regarding the item advertised as new but found to be damaged once the bidder was at home.  As stated in our terms and conditions, which are presented and must be agreed on each time by the bidder,  upon logging in, before each bid: "In the event of a discrepancy of an item, the Buyer must notify our onsite staff at the pickup, before you cross the doorway to the outside. Once items are outside of our location, the Auction Company and Buyer agree that no adjustment or refund will be made." & "New: These items are believed to be in new, unused, and complete condition. The boxes may be damaged, open, or missing altogether. Any item marked as NEW is fully refundable if the item itself is damaged or incomplete. It is up to you to open all your paid-for items, before leaving the physical warehouse, and checking the contents fully. No requests for refund once the item has left the actual warehouse will be accepted." & Condition and Suitability: When in doubt about condition, completeness, or suitability for intended use, buyers are advised to bid accordingly. Our policy explicitly states: & "You are encouraged to fully inspect all NEW items once you have paid for the item and before leaving the building at pickup and may request a refund at that time if there's a problem."  On the invoice in question that was emailed to the bidder the morning of pickup by 9am, and handed to the bidder at pickup in print, after 3pm states:  Inspection Requirement: Buyers must meticulously examine each item before departure. and  "New - Refundable If Different Than Described and Only Before Item Leaves The Building."

      We stand by our terms and conditions, as we are unable to determine what happened to the item once it left our control. Had this bidder requested a refund prior to leaving, and the condition confirmed we would have refunded it 100%.  However, as stated in this complaint, the item was checked and was to the bidders satisfaction before leaving, then once home, decided otherwise.  Potential issues could include the item being switched, damaged in transport, or altered after leaving our premises. Given these uncertainties, we will not be offering a refund for the item.

      I am rejecting this response because: I have done business with this organization for multiple  years. To be accused of damaging any product is insulting. There warehouse  was packed and there was no opportunity that day to inspect the package completely without blocking aisles that were severely limited in access. 

      This item was glued in some places and was shattered. They knew it and hit those parts deep in the box. If they want to run a fraudulent business that treats customers like crap they stick their suction where the sun don’t shine. 

      I have recommended dozens to the auction site who have spent thousands of dollars. No more. I will highly discourage anyone I know from using a business that treats their customers like criminals.

      02/25/24...won an auction for a twin bed frame with drawers for $117.00 (this is total price including tax). Went on 02/26/24 to pick up the bed. Paid the cashier and was directed to Chase's pod (2B). He gave us a box and said "this is your box". Asked if it was just one box and was told yes. Took this home and opened that evening. There was definitely a box or boxes missing. Went back to the warehouse on 02/27/24 to see if we could get our missing boxes. Chase wasn't there so we spoke to a "manager". She told us we were out of luck. She refused to let us go find our missing boxes...the ones we paid for the day before. She said we should have opened every box in Chase's area the day before in order to realize we didn't have a complete bed. Mind you, this was sold as a "New, In Box" item, not as is. But, because we walked out the door with only one box, we have absolutely no recourse, which is unacceptable. We should have been given the option to go get our missing boxes, or to get a refund. I would be happy with receiving my missing merchandise...which I've paid for, or a refund. Or, for this business to be completely shut down.

      I’m hoping this company will actually give us the missing box(es) that we’ve paid for. That is my first hope for resolution. If not, I want this company to reimburse what I paid, since I didn’t receive what I paid for. 

      I have a receipt for a complete, new platform storage bed and all I received was a few pieces of wood.

      As clearly stated in our terms and conditions, which you have agreed to multiple times before winning an item, "Refunds for damage or missing parts are applicable exclusively to items labeled as 'New' within the description. However, these refunds are only applicable prior to the item leaving the warehouse. Once an item has left the premises, regardless of the reason, no refunds will be issued."
      Furthermore, we would like to highlight that our camera footage indicates that our manager on duty explained the process during your visit. It was emphasized that customers are required to open and inspect any item they personally won in the warehouse before leaving to ensure satisfaction. Once an item has left the building, it is no longer refundable for any reason, as per our policies. At no time were you told to open all boxes in the warehouse. 
      In light of these circumstances, our business will continue its operations within the established guidelines, and we will not be issuing a refund. Our records confirm your purchase of a twin bed frame with drawers on 02/25/24, and we acknowledge your visit on 02/26/24 for item pickup. The camera footage reveals your request to find the remaining boxes the next day, 02/27/24 which is outside of the terms you stated several times you understood before getting a bidder number and placing any bid.

After reviewing your complaint and the attached documentation, including Invoice #*********************** we regret to inform you that, based on the terms and conditions agreed upon during the purchase, the item was sold "AS IS."

      As explicitly stated in both the invoice and our terms and conditions, items not marked as "New" are sold as is, where is, and are not refundable. Refunds for damage or missing parts are applicable exclusively to items labeled as "New" and must be addressed prior to the item leaving the warehouse. Once an item has left the premises, regardless of the reason, no refunds will be issued. Therefore, the request for a refund of $290.00 bid is denied.

      I was lead to believe that this a new product and in working condition. I got it home and there are obvious signs that is not the case amd it does not work. I have attached conversation from the seller where he told me it looks perfect and it was just open box.

      I purchased what was supposed to be a couch from the auction on Monday and went to pick it up Tuesday 7/18/2023. I told M******, the workers who got the box, this is not a couch. She told me it is open box and sold as is. I left to pick up my children and went back to speak with a cashier after talking to family and friends, who also use the auction and say if it is something different, you are still supposed to get a refund. The cashier told me that I was supposed to get a refund and I would have to come back before four to speak with a manager. I emailed and explained them the situation and they said that if it is something totally different, I should get a refund. I came back today, 7/20/2023, and spoke to C******* C******* said that I should have gotten a refund that day, and I advised her M****** stated that it was sold as is. C******* had M****** come up and speak with me, and M****** agreed that I did tell her, but she thought it was incomplete and not a totally wrong item. I paid for a couch and got a TV that is broke. Per their email, I should be getting a refund. However, C******* was yelling at me and M****** when I went in to speak with them to get a refund. She refused to rectify the situation and threatened to fire a cashier because the cashier told me I should’ve gotten a refund before I left on Tuesday and gave me the email to reach out to.

      Thank you for bringing your concerns to our attention and regret to hear that your experience was anything less than positive.  As per your attached photos, you purchased an "as is" U shaped sectional sofa where preview times were provided for you to check before you placed your first bid. 

      The listing strongly suggested the preview as well, and our Terms and Conditions state "Open Box: These Items are SOLD AS IS. These items could be new, refurbished damaged, maybe incomplete parts, or in the wrong packaging. For accurate information PLEASE preview these items. These items are not eligible for refund. We strongly recommend attend the Preview for accuracy. No Packaging or Out of the box: Item is not in original packaging or clear shipping bags, therefore IS SOLD AS IS. These items could be new, refurbished Floor Model, damaged, maybe incomplete parts. For accurate information PLEASE preview these items. These items are NOT eligible for refund" 

      As with any "AS IS" item we will indeed fully refund IF the item is not part of, what is described.   In your case you state it was a TV and not the full sized sectional U shaped sofa set.   Had you taken your item directly to the employee on duty to show them, they would have refunded your item.  Once the item has left our warehouse door, we can no longer offer that service.  When you agree before bidding to the terms and conditions, this is part of that. 

      Our cameras confirm you leaving the warehouse with the TV, and then coming back to the cashier table to inform them that it was not a sectional.  Our friendly staff informed you that you did leave with the item, therefore there was nothing they could assist you with, other than allowing you to speak with the manager who is on duty until 4pm, and could explain the policy in more detail if you required so.   

      We sincerely wish you great deals in the future, and hope you will take the time to come to our scheduled preview days to fully inspect what you are wishing to bid on, as well as inspect the item you won again at pickup, before walking out the door with the item.

      I had an incident at you Groveport location. I placed a bid on an item as seen in the attached photo. I arrived to find that the item did not include a light. They cited the fact the it was on the box and on Home Depot's website but neither were referenced on the items auction description. When I asked for a refund I was told no by C**** and the manager, both citing the box and Home Depot website. The manager proceeded to wait until I was already loaded to come out and demand I give her the paper and the item back so she could give me a refund. When I asked why no she had no reason other than saying I was rude. Later I find that my account has been removed.

      Date of purchase 6-22-23 Capital City Auctions I bid on a pool that was listed as NEW. I spent $679.94 When i got home to put the pool together I am Missing 2 out of 6 supports, im missing the sand filter which is a main part, along with 6 more rails. There is a filter in the box that goes to a completely different pool along with 4 other pieces that go to a 3rd differnt pool. This item was listed as New and obviously this is a lie. I am seeking and exchange for what I thought I was bidding on which was a new in the box pool or a full refund.

      Every Capital City Online Auction customer is required to Read and Agree to our terms and conditions before placing a bid.       Date of transaction: 4/12/23 Amount of purchase: $115 Item purchased was supposed to be a full body massage recliner retail value of $1349.

      Once I got there to pay and pick item. It was not what was advertised on their website. It was side panels that goes to the massage recliner. It stated nothing about side panels on the website. That is false advertisement to me. They would not give me a refund and told me it was an open box policy. What would I do with side panels for a massage recliner that I thought I was purchasing?

      I ******* *******, purchased Westinghouse 12500 Watt Generator from Capital City Online Auction 4949 Hendron Road, Groveport, Ohio 43125 as "New" Please see the attached invoice for Auction # ****, dated December 8, 2022. I took the machine home, and it would not run. I found that the generator was damaged and inoperable. I attempted to have the machine serviced at Westinghouse. Westinghouse was unable to repair the severely damaged generator. The generator had been sold by Capital City Online Auction as "New" Per the terms of their online auction I should receive a refund for the total price of $470.46. All communication with this company has failed to produce any positive results, at which point I have requested a full refund. No opportunity was afforded me to test the generator as they implied in their communication, as it is a gas-powered machine. And no disclosure that customers were allowed to bring gas to the warehouse to test the equipment. Public assumption would be that you do not bring gas to a place of business unless express permission is given by the business. Also, Capital City Auction failed to inform me that the equipment had fallen off the truck when being delivered to the warehouse. An employee informed me that this is a common practice for this warehouse, but they still listed the item as NEW. I have documentation of this fact. At this point, all communication with Capital City Auction has ceased and they have suspended my online account. I am demanding a full refund. I am including all communication with this company. Your assistance in resolving this issue will be greatly appreciated.

      Thank you for giving us an opportunity to share our side of this.

      Mr. ******* contacted us, asking if he could bring gas into the warehouse to test a generator. We replied with yes of course if you win it. He then told us he bought a generator, but when he got it home it would not work.

      We explained our policy which is once an item leaves the building we can not provide a refund. Mr. ******* then made up a story about the generator having fallen off a truck. None of our employees ever told any customer that a generator ever fell off a truck. Please understand, that ALL trucks arriving at our location ARE SEALED and LOCKED! If the Seal is damaged, our company will not accept the shipment. No other generators have proven to be any issue. 

      This is an Auction business, all items should be tested in our location. We are sorry but there is nothing we can offer to the customer at this time. Please refer to our terms and conditions for additional information.

      Please note I have answered your questions below in RED.   Thank you again for the opportunity to respond.

      Capital City Online Auction's position was very clear in that they have many terms and conditions you must agree to before participating in the bidding, and that consumers should bring any questions or concerns to their attention before they leave the warehouse.

      Yes, I’m aware of this but I couldn’t turn or flip a 300lb generator, to look underneath it nor did I have access to any fuel to try and start the engine, which was dead prior to bidding and purchasing.  
      We have listened carefully to the recording, and we heard something slightly different than your interpretation of what was said. 

      CCOA said items are delivered to them in a sealed truck, and if the seal is broken they do not accept delivery. They did not address where the items come from or what condition they are in when they receive them. 

      Yes, I’m sure that’s the story they’re sticking to, but ****, that handles the generators that come into this warehouse is the primary person that handles them and as he stated on the recording (time stamp 3:15-3:35), they’re aware that these generators may be passed around by 5 differenent vendors and aware that they have been dropped but they will still list then as New. 

      The employee to whom you were speaking clarified the items mostly come from Amazon, but sometimes Lowes and Home Depot, and multiple hands may have come in contact with an item before it arrives in their warehouse. Correct 

      He also said you were welcome to start and or test the generator before you leave but that once you leave the item is 100 percent yours.

      Yes, again I’m aware of all of this. Also, I want to mention this recording was made after the fact of my purchase in December 2022.

      Hi. I also want to be clear on a couple of things. 

      I have had my CCOA bidding number for close to 2 years and I have purchased over hundreds of dollars of items listed as New. When purchasing them I reviewed them before leaving the warehouse, brought them home and all was well.  

      When purchasing this generator listed as NEW, I thought I would have the same results although I couldn’t lift it by myself before leaving, that's why I took the word from **** that it was in running and good shape. Maybe it’s just me, but when did the definition of the word “New” change? If they had this generator as they do some of the others listed “As is Item”, then I would understand. 

      Are there no consumer rights when organizations don’t want to take responsibility when they’re knowingly selling broken and damaged products to their customers? No, they get to get away with it by creating a NO ACCOUTABILITY POLICY as they have posted below. 

      New or New in Retail Packaging: Meaning the item seems to be NEW during our  inspection of the item. These Items are the ONLY items that are eligible for a refund if they are not found to be as described, missing parts/pieces, damaged or not complete box sets (unless stated as such) !       It is company policy at capital city to send a full invoice at the end of the last auction for the night, so that you may see all items that you are responsible for picking up. On one occasion two months ago, I was paying close attention to a television, and bidding accordingly. I was sure I'd won the auction. Twenty four hours pass, no invoice. I sent out an email inquiring, they give zero information on the status. They tell me to wait until my account is terminated. ???? This never happened, and after I reached out again, no response. Currently, my account is stuck in limbo, unable to bid. I still haven't received my television or any information whatsoever.

      * Any item not paid for by 7:00 pm EST on the scheduled pickup date, will be restocked, at the expense to the winning bidder.  A restocking fee is then due before bidding privileges will be restored.

      * Bidders not paying for the merchandise won will be barred from participating in any future auctions until a 39% restock is paid.
      * If you win any items, you will receive an invoice by email and find an invoice added to your account, viewable by logging in and going to your account/invoices. You are responsible for checking your email and/or your account/Profile/Invoices.  Your invoice will detail date, time, and location of pickup.
      * Unpaid, Missed Invoices, Missed Pickup: Items must be paid for the day of scheduled pickup outlined on your invoice by 7:15 pm EST.  You can make payment by texting the auction manager on your invoice.  Any item(s) not paid for as outlined due to negligence, forgetfulness, weather, or unforeseen circumstances will cause your account to be suspended, until a restocking fee is paid.    If your account is locked, please email INFO@CCOA.EMAIL with your account/bidder number.   Once they reply with your restocking fee details, you will need to take that information to the cashiers at Green Pointe in person to pay.  The cashiers will need this email from info with the details in order to charge you properly and begin the reinstatement process.  This fee HAS TO BE PAID IN PERSON.     Restocking fee is 39% of the BID TOTAL.

      I am rejecting this response because: Company failed to deliver any sort of invoice, receipt, or confirmation via email, online account or otherwise. This has been a problem with numerous of their customers, who I have also spoken to regarding missing invoices. There is simply no way of knowing the status of an auction you have entered, once it closes. I will not pay an arbitrary fee that is levied against customers, for a failure of the business to communicate.
