      On Jan 5th we agreed to have C Baxter Masonry tear down the chimney to the flashing and rebuild for $3500. On March 8th they removed the crown, the top 2 flues, and 5 courses of brick but did not tear down to the flashing. They rebuilt the crown, flue and brick. You then decided to tuckpoint the remaining original brick. We accepted if that was the best option but C Baxter never finished the tuckpointing. His original quote was to tear down to the flashing and rebuild for $3500 or do the crown and tuckpointing for $2500. We have repeatedly contacted C Baxter to come out and finish the job but they refuse to return our emails and calls. We want them to come out and finish the tuckpointing and we believe our balance should be somewhere between the $2500 and $3500 maybe $3000

      I have attached Signed estimate above . I also attached some photos of what her Chimney looked like before she posted the ones from after, also the materials we purchased for her chimney with our own money. As she signed per estimate no money until the completion of the job. At the day of completion she was home and approved the job and loaded her invoice and paid with her card. her Husband then called and said he would like us to come back up that we had missed some spots. So we sent a guy back out the next day. About a week later we get a quickbooks notification that she had disputed the job with her credit card for merchandise wasn't as described. we were very surprised. So she received her full refund of the $3500 She paid us. quickbooks took it and the $101 it cost to take her payment. We have never had a dispute in 6 years we have been open. Also this was our first job after being off work for 4 months of a bad winter. That was a hardship for us! So we are out the money we bought her supplies & for and the money we paid our guys to go there and do the work. She also chose her own brick, we have proof. . So if we keep going back  how do we know will actually get paid? We trusted her to pay us and she went  behind went our back and got her money back for completed work. We would like paid in full. . We in good faith did her complete project as she signed for and we are at the loss. She is also trying to harass us and post everywhere bad reviews. Why would we in good faith even trust her. Again we don't have $1 of her money. So I'm not sure how she has a case in court.  I Would like to see a full picture of the chimney as of today. she is showing close ups which  just shows mortar ,every repaired chimney is similar.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      1)    We are not questioning if they should be paid.  We are more than willing to pay for the proper rendering of services.  As you can see in the email on Jan 5 we were quoted and we agreed for him to tear the chimney down to the flashing and rebuild it for $3500.  See attached email1 and email2. 

      2)    We are not questioning the choice of bricks.  We are asking for him to finish the job.

      3)    When the work was done on March 7th, C Baxter crew DID NOT tear the chimney down to the flashing.  He tore it down some and that portion was rebuilt along with the crown. Thus in fact he did not DO what we had agreed upon.

      4)    We called and were informed that he didn’t need to tear it down to the flashing and he could just tuckpoint the remaining part of the chimney. C Baxter agreed to come out and tuckpoint the remaining places on the chimney that needed to be repaired.

      5)    On March 8th C Baxter sent a worker, Stephen, out and he tuckpointed some of the chimney but not all.

      6)    On March 10th we called but C Baxter did not return our calls. So our only option was to ask Discover to dispute the charge hoping that would force C Baxter to return and finish the job.

      7)    On March 11th I disputed the charge.

      8)    I did notify C Baxter that we did this as the only way to get him to return and finish the job. C Baxter stated he preferred to communicate through email We exchanged a number of emails and I shared with C Baxter the pictures of what we believe still needs to be done. He asked for dates that he could return to finish the job and I gave him dates.  We heard nothing from him since.  He will not return our emails nor has C Baxter been out to our house.  I have all the emails but have not included them here.  Please let me know if you want copies of those emails.

      9)    April 12 – Discover found in our favor

      10) May 1 – Discover reversed their decision and found in favor of the merchant because his invoice says no refunds. THEREFORE C Baxter has been paid and is lying when he says he has not received payment

      11) We emailed him again asking for an itemized bill so we can make sure he is paid for the brick C Baxter purchased.  See email3May1. We have received nothing from C Baxter

      12) When C Baxter refused to respond to our email we sent a certified letter on May 10th asking him to complete the job. See Letter. C Baxter quoted us $3500 to tear the chimney to the flashing and rebuild and $2500 to do the crown and tuckpointing.  It seems that we should owe him $3000 because if C Baxter completes the tuckpointing he actually did part of each quote.

      13) Again he has been paid $3500.  Discover has given him the $3500 April 24.  We are trying to get C Baxter to be true to his word and do the job we requested.  The fact that we have received no contact from C Baxter since March 8, 2022 has made this to be quite the challenge.

      14) C Baxter asks for more pictures. What we would like for him to do is come out and look at the job.  We would like C Baxter to come out and talk with my husband Mark and they can both discuss what should and shouldn’t be done.  We have repeatedly asked C Baxter to come out and discuss this in person.  Again C Baxter refuses.

      15) I, Sally, am in no way harassing his company.  I have left one review where I clearly stated that he has not yet finished the job as requested and refuses to communicate with us.  I would not want anyone to hire him and have to fight to get the job done correctly and as promised.

      16) I, Sally, contacted the BBB on May 10th to see if you could help us resolve this matter without going to court.  If you cannot we will file with the small claims court.
