At approximately 1140 am on 5/3/23, a rental truck drove fairly fast down the main drive toward our neighbors house. Shortly after at approximately 1150, the same truck cut across our neighbors lawn (leaving marks) and turned into our house drive, which is clearly marked with a house number sign. As the truck proceeded down our driveway and then back up, it was breaking numerous branches of the tree near our drive and continued to back up toward our garage. I was in our house working. The entire time, I was trying to figure out what was being delivered, as I didn’t order anything. I walked outside to see what the delivery was the driver began backing up. Again, clearly struggling as he was breaking numerous branches off our tree and oblivious to that. As the driver continued backing, it didn’t appear he was going to stop. I tried yelling to no avail. The driver continues to back into the top of our garage/house. Damaging the gutter, soffit, and roof. At no time, slowing to check his surroundings or stop until he hit the house. The driver apologized and tried calling his boss, with no answer. I took the number and contacted ***** Tri State Foliage at 1155, spoke to him briefly and was transferred to **** in HR/insurance claims. I explained to **** what happened. **** stated she would be calling their insurance company and would get back to me that afternoon regarding next steps and how to fix the damage. Pictures were taken of the truck, plate, house damage, invoice with neighbors address, damage to lawn, and the driver. The driver left at approximately 12:15 pm. During his departure, he proceeded to make additional ruts and tear up our lawn. The driver stated that he wasn’t used to this route or area. However, our house number is very clearly marked at the main road with a fire number sign in excellent condition. The address he was supposed to go to is also clearly marked. Prior to turning into our actual drive, we have another very well marked house number sign. The Ryder insurance company is not willing to pay the full amount to mitigate the damages. They are trying to take a depreciation amount for the age of our house. However, we are not insured by them, Tri State Foliage is. We are being penalized for something that was completely out of our control. We are not asking for anything above or beyond, just to put our home back to the original condition. Ryder won’t respond to emails nor is Tri State Foliage responding to texts.Business response

I am sorry that Mrs. ****** is struggling with the insurance company. Tri State Foliage promptly took care of filing the accident with Ryder, in less 24 hours. Once a claim is turned over to insurance, it is no longer in our hands. It is not the responsibility of Tri State Foliage to make adjustments from what an insurance adjuster has said is the coverage is. This is a dispute between Ryder and the complainant.
