We had a signed quote for service that he was paid for, yet we never received any service. He billed us for several months of service that was not performed, and fraudulently obtained monies for service he never provided. Khalil then stopped responding to all forms of correspondence from several different members of our office. Obtaining money without providing the service, essentially stealing from this HOA.Initial Complaint

On December 15, 2021, payment of $550 and a signed contract was sent to Khalil S**** of Khalil's Landscaping and Snow Removal. The contract (attached to complaint) stated that he would provide two visits every time it snows, for each 3 inches accumulated. He also guaranteed through text that he could provide one of those plows before 6am. Since the beginning of the season, he has came once to our property to plow. It was on January 17th 2022, 10:30 at night. He has claimed that he was having truck trouble. He had one plow out for the season due to the transmission. He did not show up again any date it snowed afterwards. He did not show up at all for the large snow storm that occurred on the day of Thursday February 3rd-Friday February 4th 2022, as shown in the text chain attached to the complaint. He claimed his second and last plow was unable to start so he couldn't make it. He did not offer to rectify the fact that he has not held up his end of the contract. I requested a refund to which he denied, saying he can't afford to refund me. He is now claiming that he has visited our property more times than he has. I have been home during each snow storm, he has not shown up since the initial day of January 17th. He is lying even though I have the proof that he only showed up one time this season. I have since contacted him over the phone and by text over 15 times, with no response. Multiple other people have left reviews stating how they were ripped off for the season, for totals of upwards of $900. He will not refund his customers for his shady business practices. Khalil has scammed my neighbors and I, and multiple other people, this season. We would like a refund for the deceitful contract that was not honored by the business, Khalil himself.Business response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
Khalil’s reasoning for not providing a refund is because there is no refund policy in the contract, and because he admitted to me through text that he can’t afford it. I have proof of him sending refunds to other customers this season via his public Venmo. So why did he refund them and not me? The contract guaranteed two visits per day and he did not come during the major snow storm on February 3rd. He is admitting to not upholding his end of the contract for at least that date. So he is breaking a legal contract. So where is the partial refund for that day?
