I moved out of ***** ***** **** ********** OH 44092 on 9/13/24 due to 19 violations from the city of Wickliffe, OH and me not having any gas or hot water in the unit for over 30 days. By law my security deposit in the amount of $1360 was supposed to be given back. I have asked 5 Points Management and the owner of the property ******** ******* **** to please give me back my deposit several times and I keep getting the runaround. I was told I would get a portion back of $754.98 by Robert ***** and that he would send it by *****. Never happened. I explained that I was due the whole security deposit back, based on the 19 violations and being without hot water and gas for over 30 days. I provided the info based on Ohio Revised Code Section 5321.16 of the Ohio Revised Code states that landlords must return the security deposit or provide an itemized statement of deductions within 30 days of the lease ending. In Ohio, a landlord must make necessary repairs, including hot water, within a reasonable amount of time, which is usually 30 days after the tenant notifies them of the issue. However, emergency repairs, such as no hot water, must be completed faster. Landlords must provide running water, reasonable amounts of hot water, and reasonable heat at all times. I then called Curtis at 5 Points Management the next day to confirm the address so I could go in the office and collect my money. Curtis stated that Robert G advised him to email the owner of the house to confirm if it was okay to give me my money back. And if they did not hear back from the landlord that I could come pick up my whole security deposit today 10/16/24. I called Curtis back to check the status and Curtis stated he was advised that I would be getting $600 back. I asked Curtis for Robert's info and he refused to provide it. And then stated that Robert G was all of a sudden sick so he has no idea when I would get my deposit back. I have attached a more detailed statement also.
