      We hired Tom Gorman’s company with written contract to put on an addition and remodel part of our first floor of our house. After many delays, poor workmanship, and issues with his subcontractors, he is refusing to finish our house. We are into month 11 of what we were told would be a 5 month project. Tom has refused to resolve many quality issues which we have had to either take care of ourselves, or pay other contractors to correct/finish. Including but not limited to electrical, drainage, drywall, paint and cleanup. As of today, the new Air conditioner does not work. This was installed by Gorman construction with a new furnace. Tom refuses to produce structural drawings for the main supports of our house which hold the second floor up. We have four windows and a set of French doors that were installed by Tom and his crews that need to be removed and reinstalled per the windows manufacturer. This means all the siding adjacent to them, and all interior trim will need to be removed and reinstalled if not damaged.

      #1- Delays because of trade shortages, COVID, Homeowner had a death in family, Homeowner had COVID.  When Homeowner was out of town for funeral, he stopped work until he returned.

      #2- The addition is built with fine workmanship.  I have been in business since 2000 and have never had a complaint.  This client will never be happy.  He disrespected my subs and continues to text nasty messages to me.  I am fixing some  issues on his long list of items that need addressed.  Other items are within building standards and the client is being unreasonable.Some of his pic that he sent have been resolved.  

      #3- I offered to fix drywall/paint items but he refused so he hired his own help which i paid for.  

      #4- Repairs are scheduled for the week of June 13.

      #5- We installed homeowner bought furnace/ac.  ******** ******* was out just this week to check the charge on it.  It is working fine. 

      #6- Structual drawing should be done by the architect which he hired and paid for.

      In closing, most of my team has refused to return to his job because he will never be happy with any work we do.  He should of done the job himself since he is such a perfectionist.

      I am rejecting this response because: the delays were not as he stated. We requested that drywall finishing not take place while I was out of town because there were MANY issues with the installation including missing or not properly install screws. I have photos form the person hired to inspect the installation while we were away.This took 4weeks to get the drywall mostly corrected which Tom argued about every step of the way.  I spent 3 weeks getting him to admit that the beam holding up our house was 3/4 in out of level. His response was “ I’m not tearing it out and fixing it”. The shower was delayed due to shoddy workmanship, they ruined the tile and we had to wait 4 weeks for the replacement. The structural drawings were changed by the contractor and new ones were supposed to  provided to the inspector, which they were not. This is the contractor’s  responsibility. Two rooms were painted the wrong color and he refused to fix the. We have not been reimbursed  yet. Drainage outside the house was done incorrectly, it drains the rain water up hill. We are again having to have this corrected.  The entire yard was trashed due to incorrect grading.We we’re forced to sod the entire yard. We had many of his subs behaving unprofessional, leaving our house unsecured, drinking alcohol  on sight, caused flooding in our basement, damage to our house and property, and we’re very rude at times. . Some workmanship was so poor that it is needing to be redone. More than 8 months after windows and doors were installed, we are still waiting for them to be redone.Tom has only been on site twice since mid January. He has many excuses and does not want to admit the short comings. I would have to send pictures of the shoddy workmanship to his as he did not follow up on his sub contractors. We still have a lengthy list that his dismisses as “acceptable “ work. An unsafe deck railing came off the house and damaged the siding, he refuses to do repairs stating it it’s not his fault.

      I am rejecting this response because:  While we agree that we are no longer going to be working with Mr. Gorman or his company, we do not agree that this dispute is resolved to our satisfaction. There is work that has not been completed, and work that has not been completed correctly.  There has been an attempt to take care of issues, however, the list that Mr. Gorman decided to address was never completed.  The issues that were addressed cased even more work for us.  We have agreed to end our contract because Mr. Gorman is unable, or unwilling to finish our house correctly.  However, in doing so, we are foregoing him completing the following work that remains incomplete.  Sliding door is still not installed completely and has never been cleaned even after several attempts.  The sliding screen was "adjusted" however, when we have never been able to operate it with out it falling off the track.  The new siding was damaged from faulty workmanship on the outside landing. The hand rail fell off and damaged the siding.  The rail was repaired, however the siding repair was refused because he didn't feel it was his fault.  We are still missing a latch on one new window. The keys we were provided for our second rear entrance door do not work it. The lower weather strip is torn on the same door and we were promised that would be replaced.  Our downspout drains for the addition still back up when it rains, this problem was reported to Mr. Gorman on February 9th.  We have spots on our existing foundation that were drilled through for the addition and were told in August of 2021 that they would be addressed. One repair was to take place a few months ago and was not done. We have cabinet moldings that the tile person cut short and were promised would get fixed, again have heard nothing.  Several cabinets that have bad or non functioning doors. The repairs to the damage caused to our dinning room, a room that was to remain untouched, was not even mentioned until 6 months after our scheduled completion date.  Mr. Gorman then stated that the sub contractor he had hired to do the drywall work in our addition was going to do the repairs.  Even after we had to hire someone else to finish the drywall work Mr. Gorman could not get his subcontractor to finish correctly.  we have at least four window that still need to be removed and reset.  This means removing all the siding and digging into the walls on the side with brand new carpet. There has been no mention of of our shed that got hit by the Bobcat in July of 2021.

      We personally have had the Guest suite repainted, ever room that Mr. Gorman painted was the wrong color.  We had a great amount of time in picking out exact colors, though they we similar to what we picked, they were  not the colors we picked.  We were very specific. The furnace was wired wrong and quite working, we took care of that with no response from Mr. Gorman. As well as the generator breaker box. We discovered that it did not work when we hooked up the generator during a power outage.  Again, no response from Mr. Gorman.  We had it rewired correctly at our expense.  We have outside coach lights that blow off the house when it is windy.  

      I am sure we are still missing things, but considering the amount of excuses we have heard, the delay after delay, and the amount of damage that is done every time his company sets foot in out house, it would take and entreaty to finish this job and we have had enough.  Mr. Gorman has been asking to get out of this contract since October.  Well he finally has drug his feet long enough and caused us enough pain that we are granting his wish. we can only hop any major warranty issues will get taken care of.
