On May 16th, 2022, I purchased the Premium Launch Package for $5,997, which included a list of business services needed in support of launching a new business. However, many of the services were never completed, and some services I actually completed myself. While the original contract states that “There is No refund policy in effect for the Premium package at this time.”, this does not absolve her of her responsibility to perform, which appears to be the point of confusion on her part. My documentation includes the original contract, list of services, a separate checklist of services, and email conversations. I also have text messages, video and files corroborating my claim.Business response

Thank you for bringing this complaint to my attention. It is very disappointing to get a complaint from a client, especially one that I personally spent a lot of time with. It is truly my goal to make an impact on everyone who trusts me with their business. I have never received a complaint before, I am hoping this response will suffice.
******** was behind on her payment plan with our company for a few months and offered to get some business items taken care of on her own such as her logo, brand colors, state registration etc due to non-payment. I did not request this, again, she offered. In return, I continued our weekly sessions with no break from May 2022 to May 2023 even though we were on a 9-month contract. There were also instances that *** did not want to wait on our team to deliver on our services, in which case she did them herself in the timeframe she preferred. Absolutely her choice.
On May 16, 2023, *** brought a few concerns to my attention via email. We spoke about her concerns the week following, via zoom. I addressed each concern, reiterated the no refund policy, and offered to complete whatever she needed and to add additional services free of charge for the misunderstanding. She agreed.
I took extra time out of my schedule specifically for *** because she needed more explanations and an understanding of how our launch services were executed. I have never had to explain to any client what I had to take the time out to explain to ***, but I did it anyway. I feel that I went above and beyond for her personally and in business. My offer to address her concerns was more than generous and she decided not to show up to the meetings we had scheduled for her for free. She stated she did not want to work with me anymore.
Please review the attached documentation. I tried to enclose text messages from *** stating how she valued me as a person and appreciated my services. I also have messages between myself and my assistant regarding ***'s balance and promises to pay when she was thousands of dollars past due. You will also see receipt of the emails regarding the items she said she never received.
Everything I have stated above is documented and attached.

Unfortunately, ****** has further proven my case instead of her own standing, or lack thereof. Yes, I was behind on my payments initially. And, I had a conversation with ****** regarding my need to place the services on hold, due to my inability to pay. The residuals of COVID created a great hardship for my real estate sales business. ****** stated that she did not want me to put things on hold and that she wanted to continue working with me; which is what happened. Of course, she did not continue to work with me because I forced her to. It that what she's expecting anyone to believe? She continued working with me of her own accord, knowing my exact financial situation. When I was able to make payments again, she was paid in full.
Further, being paid in full is the only point here. You accepted the payments as provided. In turn, your were to provide the services paid for. You did not. That is the only point here. Even in the documentation that you provided, my complaints to you are clearly shown within them. So I'm puzzled as to what you felt was to be seen from your "evidence". I have the video recording of our discussion of those missing items and I did not agree to your explanation of those missing items. I simply chose not to argue and end the discussion, because as per your usual, you will not allow yourself to admit that you were wrong. Your services are clearly spelled out. You have zero proof of them being rendered because they were not.
What happened to my Trademark application???? Since filing this complaint, I've found that you never paid the Attorney, so my application was never filed. What is your explanation for this? Your Attorney, stated this to me via email, which is now attached. Further evidence of your lack of credibility, your disgracing the name of the Lord, and your arrogance in thinking you are in the right. Its truly amazing.
Lastly, you most certainly did have to explain things to me because I am obviously not your typical client, whom you can simply say anything to, without question. I am of course going to require you to explain your thought process and actions. You are launching MY business, not yours. Therefore, I am entitled to ask as many detailed questions as I chose, to ensure that I know how you plan to execute. Further, my question of your methods were proven to be genuine points of concern, considering how things played out with my event, photo shoot, and the fact that I just THIS WEEK received the pictures from my event that took place on May 5th!
The bottom line here is that you failed miserably and while, yes I will always give credit where credit is due, and my actual event turned out well, despite the unnecessary stress surrounding it. You were in way over your head and your pride and arrogance will ultimately be your downfall. The fact that you continue to take this stance, knowing you did not perform is truly astounding. As mentioned previously, this will not simply go away. And the explanation you've provided is unacceptable. The Lord willing, I will not allow you to do this to anyone else.

Kim,
You wanted a refund and our contractual agreement states no refunds. Our agreement was already provided as documentation. The previous response and solutions I offered on this BBB platform as well as via email back in July-August still stands regarding your other concerns.
Unfortunately, if you decide not to move forward with those options there is nothing else we can do to support you. You are certainly entitled to your opinion of my company, but all of your concerns have been addressed outside of your opinion of them.
Please let me know if you are open to the solutions I previously offered.
