In August 2022 we signed a contract with a sales representative who gave us a quote and visited us twice, name Michael. We were asked for 33% of the cost up front as a deposit, 33% when the project started and said the remainder would be due upon completion. We were told that our project of a gazebo, paver patio and built in fire pit would begin in 6 to 8 weeks (October 2022). We called Capital Deck and were given several different numbers to call and would not receive responses and when we did were told they were running behind due to weather and shortage of people. We explained we understood, but needed communication. The runaround continued until I asked for my money back. In December 2022 they stated they would start our project. They came out to my back yard, dug it up and broke drainage and pulled the stairs from our back of house to the ground off, also tearing off siding (all of which is still not repaired). Capital Deck then brought out some stone and put a few piles in the back yard leaving a pile in the road. Despite calling repeatedly, explaining the city had come to our house and was fining us, they would not come out and remove the stone. We finally moved what we could ourselves and Capital Deck came and the next day. This situation occurred from Jan- March 2023. The same thing happened with a pile of wood in our front yard. The HOA fined us because the project did not progress from December to August and the wood had to be removed. Capital Deck finally moved it in Aug 2023. We have paid the deposit of 33% and the first payment in December of 33% now equaling $23,334. Charles Brown is listed as the owner, but he has stated to me he just answers the phone. I have been very patient for over a year and just want the project finished. I have a $1,000 restocking fee I paid for a hot tub and an HOA fine of $500, as well as have not been able to use my back yard since December 2022. As of 9/15/2023 all phone numbers I have are disconnected.Initial Complaint

- Date of transaction - 08/27/2022 - Amount - $2000.00 - Business commitment - Capital Deck Company, LLC agreed to construct a deck for **** ****** ** **** ******* ******* by the end of October with a $2000.00 deposit. - Nature of the dispute - Capital Deck Company, LLC did not show by the end of October, breaking the agreement that **** ****** had. They did not call or email with reasoning why they could not show for the construction. **** ****** followed up with them on Dec 5th. Capital Deck Company said that they would come on the 15th/16th of December and they did not call or email when they did not show up. **** ****** would like her $2000.00 Deposit back, and Capital Deck Company LLC is requiring a 30% ($600) restock fee. - Business Resolution - Capital Deck Company said that they would come on the date of Dec 15th when they did not show by the end of October, but no call/no-showed at that date as well. - Job# - *********Business response

I am rejecting this response because: My deck should have been built in october 2022, It has been one excuse after another . After several phone calls and emails, the owner , Charles B**** finally responded
that they would be out on dec 15th / 16th to start the project. They did not show up or even call, To my knowledge they did not have a permit from Grove city and zoning divison in december to build my deck even
though Mr b**** had told me via email that workers will be out on 12/15 to start work. i WANT MY DEPOSIT BACK. DO NOT WANT TO DEAL WITH CAPITAL DECK COMPANY.

I am rejecting this response because: this issue will not be resolved until my refund 0f $2000 is in my possession.
the wood on my lawn is killing the grass.The wood needs picked up ASAP , otherwise, Capital deck will be responsible for replacing the grass. It was just dumped there without my knowledge. Gross disregard of my rights'

Hired this company to tear down an existing deck, install a new deck and 3 season room. Also to renovate front porch.
Signed agreement on 6-16-22. Gave a $14,000.00 deposit. Was supposed to start around 8/1/22.
No call, no show. After several calls, finally showed up and removed old deck at end of August.
Asked for second draw of $13,000.00. Delivered wood to back yard, dug holes for new post middle of September. Haven’t been back since. Kept getting promises that they would be here “next week”.
It is now November 9 and “next week” still hasn’t come. Beginning to think they just took money and ran.

On 4/21/2022 I went into contract with ******* * of Capital Deck Company, LLC thru the website ****. The site showed good reviews so I went with them. They were to build a composite deck w/roof, 12x28, and a paver walkway for $35,300. A deposit of $11,766 was given to ******* on the 21st and the check (#****) was cashed the following day.
Work was to begin in 6 to 8 weeks from contract date, weather permitting. As soon as I gave him the check, it was like crickets, ignoring the emails I had sent him with questions moving forward. I contacted him on April 25th and 26th. He sent a text he'd call the next day....nothing until the 29th with another text. I contacted again on June 25th and got a text he'd let me know when they would be starting. He was to obtain approval from my HOA as well as permits and plans thru the city of Pataskala. He contacted me after I had reached out yet again, informing me permits and plans were submitted...this was on June 30th and they were working on getting approval from the HOA. We went into contract in April and he was just now getting to the approval and permits of which the HOA approval would take at least 2 weeks!

Based on this complaint I did nothing wrong I never owned another debt company I'm so proprietor of capital debt company that's the only company I have ever owned we contacted homeowner after running behind schedule to inform her that we were running a few weeks behind homeowner wanted to cancel contract we had already had plans drawn up that she approved of we paid for the material which is a 30% restocking fee as well as our salesperson's commission that we are willing to negotiate and finish the project but we did absolutely nothing wrongCustomer response

I apologize for not responding back to this complaint, but I had a family emergency. Here is my response to Capital Deck per their response of Oct. 21st:
The complaint I had Mr. Brown was with your salesperson/partner, ******* *****. I never said you owned another decking company.
From the research I had found on Mr. ***** and how he was doing business under the other mentioned company, gave me pause to be concerned about doing business with ******* **** because he is now your salesperson/partner.
And this has led to my complaint with your company...a lack of communication, not starting the project on time and not acquiring the permits from the city of Pataskala and the HOA before the project was to start. If I had not checked about the permits, especially with the city, I wouldn't have known.
I have never spoken with you until I told Mr. ***** that I wanted to cancel the contract. This was on July 19th of which he never responded and when you called me on July 27th saying you were two weeks out from starting and that the job wasn't even scheduled until this time, begs the question why hadn't Mr. ***** informed me of this or the fact no permits were ever acquired and when I mentioned the HOA permit to you, you wanted to do a rush on getting it through when I was told on June 30th thru a text from Mr. ***** the permits were being submitted at that time. It takes what, at least 2 weeks for permits? We went into contract on April 21, 2022.
We have tried to reach out to you several times to discuss making changes to the original plans and you have not gotten back with us, once again, lack of communication.

Again I don't know how many times we have to let you know that ******* it's not a partner he's not a owner he's no way affiliated with our operation he is an independent salesperson that we use periodically we haven't heard from him since June of 2022 please stop.
The last conversation I had with you you wanted to communicate through the better Business bureau so if you try to reach out to us we have no record at all of that we would like to work with you to get this resolved however at the present time we have over $5,000 invested on your project and we did absolutely nothing wrong and we're willing to work with you .

Though you may not recall, a friend of mine did reach out to you on several occasions, on my behalf, trying to work something out but you never returned a phone call. With that said, here is what I propose if we decide to work with your company moving forward.
You have stated over and over that your company has done nothing wrong and to give you the opportunity to show what you can do, so I am willing to consider a new detailed estimate based on a deck only, and since you already have the down payment, and if the price is right, no other money will be exchanged until the job is completed.If we should go into contract, here are the stipulations that I feel should be put upfront:
The contract will need to show in writing, materials to be used, a work schedule, details of the work to be performed that should cover clean-up, yard repair, trash removal and a warranty on labor once the deck is finished.
Also, I will need to see proof of license (number should be on the contract) and liability insurance, receipts for materials, pulled permits from the city and the HOA and city inspections.
These are legitimate requests that I would expect from any contractor I choose to work with. I just want to lay everything out in writing so there is no miscommunication if we move forward. If you are in agreement, we can discuss further after the holidays.Business response
