This started with a signed agreement on 10/28/21. The agreed upon price for our addition (bedroom ,bathroom, closet), kitchen and bathroom remodel, hall closet, and miscellaneous items discussed. The price included the above mentioned work as well as all plumbing, electrical, hvac, doors and windows. This also included all concrete work. Then we have a separate price for the shed with electric and ramp. The shed was built to our satisfaction but still needs the electric and ramp to complete according to the agreement between **** *** ****. Due to their negligence not putting up any type of protection for our new patio, Neiborhood children put divot marks on the patio that needs repaired. We are now dealing with incomplete work after we have paid him to do the completion of the work that has been started. He is now avoiding our phone calls and has left us no recourse but to seek action. His excuse about not starting the addition work, is that he has no carpenter now. Not only is this leaving us with no addition, but we also have a boarded up hole in the living room because the window he ordered does not fit. The house can not be inhabited without a secure window in place. There are several cosmetic jobs that need completed as per our agreement that he is not taking care of. Unfortunately, we made the mistake of giving him money as he claimed he ran out and needed more. He claimed he needed 4,000 plus 450.00 to pay the electrician off. We gave him 5,000 on good faith. This still needs completed and we are seeking to have the work done. The original proposal was for 65,000 and the outdoor storage building was an additional 5,000. Both parties agreed to 70,000 to complete all of the above mentioned work. We have requested the precise drawings for the addition, that he submitted, that were cleared by ********** ****** Zoning, and he has failed to provide them. Customer response

      06/07/2022

      Hello,
We were unable to type on your email so we are sending the responses to you.
We have heard from the owner, **** *** ****** , and after several phone calls he is claiming to come this week to do everything inside with the exception of the front window. He is saying that will be completed on the third weekend in June.
He has yet to call us to tell us when this week, as he said he would. Our initial conversation back on October 28, 2021 when we signed our contract was that all work including concrete, plumbing, electric, and addition would be completed early to mid year of 2022. Not only has he not fulfilled the contract at this point, we do not have the interior of the existing home completed, and of course, no addition. He claims he cannot find a good carpenter to continue with the addition and we find this hard to believe. We cannot continue now with the addition because we have no plans that he claims to have left in our mailbox nor can he find the originals. He claims to have submitted to the county, the necessary drawings for approval of the addition. We have no other conclusion but to think these drawings were never generated and submitted. We have been extremely patient with him. Our contract has not been fulfilled and we are in a position now that it us causing us tremendous mental stress and anguish. We would like to resolve this and have given him every opportunity to comply, but we feel he is not going to fulfill the contract. Please advise.
      Respectfully,
      ******* *******
