      Contracted for 24 ft + 30 ft pole barn / lean too. Delayed start by contractor. Poor communication. Customer noted mid construction was 20 ft = 30 ft and brought to contractor attention who was aware and did not communicate this as “it wasn’t a big deal and only shorted the building 4 ft on the pourch side” requested correct size building to be corrected. Arrangements made for correct trusses but no show to complete building or reimburse for incorrect material. Cont with poor communication. Property damage near driveway (trailer stuck – customer push back project D/T ground wet those days) See Attached Documents

      Customer stated that there were to be no ruts or tracks in their yard or pasture and from the time that the incorrect trusses were found to be the wrong size weather turned bad and was not possible to complete or disassemble current building progress to keep their wishes on not making rats in their yard in pasture due to the building was a half a mile away from their driveway. When weather and ground conditions permit the passing of a vehicle with tools without making rats or tracks in their yard and pasture, her wishes will be completed. She is asking hours of walking back-and-forth just to get tools to the job site to be on my dime and I have stated that I will not be back until weather conditions permit.

      Customer stated she hired someone else to finish the job after she was not satisfied with the used trusses that she picked out and blamed me for…. The new contractor was to take the used trusses down, I told her I would reimburse her for the trusses and the cost of the contractor to take them down. There was no more contact made from the customer to give me a bill for the trusses and contractor labor. Now she is trying to get the price of the whole job returned which I will not be doing.

      I am rejecting this response because:

       

         **** of liberty construction pucked out and purchased the trusses on my behalf.   Please refer to one of the 108 attachments I sent with the original case dispute application.   In those documents you will see the signed contract for specific building dimensions which called for 24 foot trusses.  HE asked me if used trusses of good condition were ok to use to cut cost on the job as a whole, I gave permission for HIM to buy the trusses. It wasn't until after they were delivered that HE realized they were the wrong length of 20 feet.  Instead of bringing this discrepancy to my attention while I was out of state for work, HE took it upon himself to continue moving forward on the project and HE knowingly put up the INCORRECT length trusses the HE ordered.  When I came home from working out of state he had still not disclosed this discrepancy and I felt something was off upon seeing the building's structure for the first time. I measured the building and brought it to HIS attention. Which his response was "it was only the porch (lean too) part so HE didn't think it was that big of a deal".  I then told him right away that decision was not his decision to make and it needs to be redone to the correct specifications.   I gave him a second chance then, I PAID in FULL for new trusses that he was supposed to cover the first 700$ and take the old trusses to make that part correct. And I agreed to pay the difference.  He didn't even put the 700$ down. I had to purchase them in full.  Thereafter he had every excuse to not finish the building,  I gave him months to make it right, all while still having to board my horses and pay boarding bills I would not have had to pay had he started and finished that building when he said.  He became hard to get ahold of, irigont, rude, arrgumentive, and I gave him a time line to finish or I would be getting new contractors. That time came and went, I hot new contractors to finish the job.  The metal kit **** had picked out didn't have enough black metal, or black metal trim, the new contractor had pointed out multiple areas of short cuts **** had taken in the construction of the structure.  I had to pay the new contractor to undo most of what structure **** had started and build it back correctly.   I didn't reach back out to **** about buying back the trusses because I was going through this dispute here with BBB which part of my request of funds includes the cost of the used trusses that **** picked out that were INCORRECT length on ****'S doing, not mine.  My dispute request is only for the cost of the incorrect used trusses, the reimbursement estimate from my new contractor for taking down those trusses and bringing them up to a more easily accessible place for **** to pick them up, and the cost of lost wages of having to board my horses past the time he said the job would be completed... I only put in for 2 months on that aspect, when in all reality ****'s neglect of the situation has cost me over 6 months of extra board during his involvementof the situation... so I was being fair in only asking for the 2 months worth of which the was a "break in the weather" which he could have finish the barn, as that's what he kept telling me why he couldn't finish the barn.  I have reached out to my new contractor and he is working up a formal bill for the necessary labor and equipment that he utilized for taking the incorrect used trusses down and relocating them only.  I will submit this bill when it is given to me.  I will be satisfied if **** paid the bill and the cost of the incorrect used trusses and came and got them AFTER they are paid for and the bill is paid for... that is only offer.  Should this offer not be accepted I will be getting an attorney and go through the courts to be paid in full the original request of reimbursement plus court costs.  I would highly suggest **** accept this offer and we both find resolution of this terrible experience.   Again,  BBB, please resort to the 108 pages of attachments I sent with my original dispute application. There you will find every document and CORRESPONDENCE  between **** and I, and his ignorance and complete disregard to HIS errors will be obvious in the text.
