On July 2nd my car was struck head on by a younger boy & after police took their report they called ****** ***** and sons to tow my car. we moved most of what we couldn’t take with us to the trunk. The next day we went to get my possessions and became aware that the tow company had smashed my whole back end into another vehicle. I called the office asking them to send someone down into the yard to talk to me about the issue and they refused. I took photo and videos (having proof that the trunk was intact the evening prior) and went into their office to discuss it, on video. The worker explained that the owner of the business would contact me about the damage done. I was finally able to get ahold of the man and asked him for his insurance. He refused to provide it to me and started blaming me for the damage saying I was “only trying to get paid twice for the same vehicle” and that “the other boy’s insurance will be able to pay for the vehicle. He isn’t paying for it.” After multiple attempts to get his insurance i directly contacted the insurance to make them aware of the situation. on the phone the owner claimed that my car smashed due to my “brakes being locked up” (which was untrue and can be easily proven by witnesses and the police cam from the original accident when he offers us to drive the vehicle away). During another call (this one being recorded by the insurance company) hisworker explains that “the car was stuck in park” which was the reasoning for the crash. She also confirmed that not only was their phone line recorded (so every conversation of the man not only denying responsibility but also trying to commit insurance fraud against the other boy) but she also tried convincing me that if I wanted to pursue any form a legal action she would not let me remove my vehicle from their lot- in fear of “someone else doing further damage”. I allowed the insurance company to remove the car from the tow lot. Then got video proof that gears worked.

I am rejecting this response because:

There was no issue with my vehicle in regards of you “almost getting hit” I have on pictures and video the car being loaded onto the tow truck from my dads house (across the street) the vehicle was not deemed a total loss until after the damage done to the back and the insurance sure didn’t say “don’t worry about it” when they picked up the vehicle. Try an apology my guy and take responsibility for your actions.
