      Date of the transaction: On or about June 3, 2021 The amount of money you paid the business: $1,930.50 What the business committed to provide you: Remove fallen tree from housetop, as well as remove 2 trees, 2 stubs and 2 tree limbs. What the nature of the dispute is: Workers of Black’s Tree Service, LLC., under the supervision and direction o* ***** ****k cut tree(s) and tree parts and wrongfully tossed these items into neighbor’s yard without consent from neighbor and without authorization from Customer. When Customer complained, ***** Black, owner/operator, represented he would provide worker(s) the following week to remove the waste from neighbor’s yard. Due to no show on the following week, Customer removed the waste himself from neighbor’s yard. Customer was physically strained by the manual labor and suffered from poison ivy due to the task. Black’s Tree website states customer satisfaction is guaranteed. Customer was not satisfied. Additionally, stop payment was not put on check given to Black's Tree Service because Customer believed company would return, as promised, the following week. Whether or not the business has tried to resolve the problem: At a meeting with ***** *****’s attorney on 12/13/21* ***** ***** inappropriately focused on telling Complainant 4 x of his theory about the marriage relations of Customer. G**** ***ck stated Customer had authorized the discarding of tree(s) and tree parts into neighbor’s yard and suggested Customer did not know where the property line was located. There is a sharp contrast between the cut lawn area of Customer’s yard and the natural scrub area belonging to neighbor. Customer knows where the property line is because Customer cuts lawn on his property, pays property taxes for his own land, and about 28 years ago was involved in a property line dispute resulting from a seller having sold Customer a portion of the neighbor’s property which the seller falsely believed seller owned.

      It is with some reservation I submit this answer. The reservation is that there is so much untrue information involved in the complaint that the entire matter becomes muddled.

      Customer's husband did hire Black's Tree Service, LLC, hereinafter called Black's. Black's did everything customer's husband requested; and Black's did it in the most professional and appropriate manner possible. No tree parts were put in a wrongful place by Black's. In addition, Black's performed extra work at customer's husband's request at no charge.

      When Customer's husband requested more work for free from Black 's, Black's was willing to do it, However, due to business volume, customer's husband was told it might be a couple of weeks before Black's could return to the site. In the alternative, Black's offered to provide tools and a worker who could do the additional work sooner, for payment by customer's husband directly to the worker, not to Blacks. Apparently, customer's husband decided not 10 wait for Black's to return to the site nor to hire one of Black's workers to complete his requested additional work, but chose to do the work himself.

      In an attempted mediation, Black's pointed out that customer's husband was completely satisfied and that all communication regarding the job was conducted with him. To state that the contract and all communication was with customer's husband is not and was not a comment on marriage  relationship. 
      Because customer's husband was present while the work was performed and helped with the cuttings placement, Black's relied on customers husband knowing where his property line was.

      The mediation was attempted because Black's does not abide unhappy customers and goes to great lengths and expense to amicably resolve issues. Additionally, customer (if she is) threatened to defame Black's to her students at a local college and use this situation to undermine the business.

      The complaining person here made no effort to discuss resolution and refused to engage in a reasonable discussion. Black's suggested the mediation include customer's husband to get to the root of all issues, but she refused. All communications and business transactions had been with her husband not with the complaining person.

      Black's normally would resolve a situation such as this. The fact that none of the criticisms are true, is the only reason to answer.
