      The repair to the seawall was intended to strengthen it for a period of 5 years. This was intended to buy time to accumulate the funds needed to replace he seawall at a cost of $100,000 (quoted by another contractor previously at $80,00 for the wall and $20,000 for the boardwalk). The other intent was to stabilize the wall enough to sell the home to a buyer with knowledge of the stabilized condition of the seawall. However, the project failed, as the repairs did not work and I am left with no product for my $40,000 effort. I have elected to sell the home, with full disclosure to potential buyers of the failing condition of he seawall. After 3 months on the market, the house is in contingency with a buyer who has offered $510,000 for a house I paid $485,000 for 2.5 years ago! I am not recovering any of the investments towards the repairs and improvements I have made to the home, including the $40,000 investment in the failing seawall. I am asking for an intermediary to work with me and Mr. Level towards a settlement that better reflects the loss I have incurred. Someone else in the business has since stated to me, this was a very poor, ill-conceived professional decision by Mr. Level from the beginning. And I have nothing to show for the $30,000 debt I am paying off to the bank. The pain of this amount of debt is exacerbated by the fact there is nothing I have in return. I have nothing at all.

      ******.   Respectfully we have spent hours on the phone discussing your project and I feel we are still at the same point. So yes, I feel it's best to communicate through text at this point.   

      Your realtor didn't tell you the seawall had issues when she convinced you to buy the house.  The same realtor is now selling your house and demanding you disclose it because she is now legally on the hook to disclose. She was not on the hook as she sold you the house to give you important info.  I have offered my help to you to find a new realtor and even offered to help you sell your house by owner.  There is nothing more I can do with the potential of your neighbors destroying the wall when I do my work.  I have spent well over $20k to spray your wall 2x and I'm willing to give you $10k back which will cover your 40k loan payment for the next 10months while you try to sell the house. I’m still willing to do all I can to help but our phone calls go unresolved with solution.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      [To assist us in bringing this matter to a close, we would like to know your view on the matter.]
      Mr. Level's response is a diversion from the central issue, which is the failure of the contract to provide the product I was to receive in exchange for $40,000. References to what the realtor did and did not do and about the very kind offer to help me sell the house (an offer I did not pursue) has nothing to do with the grievance of the failure of the contract. The contract was for fortification of the seawall to help withstand the corrosive, destructive forces of Lake Erie. The contract referenced stabilization of the seawall for five years. There is no dispute that the process Mr. Level applied to the seawall has failed immediately after both attempts. That failure is likely due to the powerful forces of Lake Erie that this part of the lake the product was not intended for.  There is also e is speculation (and that's all it is) that interference by neighbors may have had something to do with the outcome. I have paid $40,000 to Mr. Level per the contract and have nothing to show for it because there is nothing to point to. Mr. Level previously offered $15,000 in restitution and I have documentation of this. I did not accept that offer. He later changed the offer to $10,000 in restitution and, of course I don't accept that either.. Neither offer is fair compensation for the $40,000 I borrowed from the bank in good faith.  Mr. Level's written response to this complaint is indicative of the conversations we have had as I seek a fair settlement. Mr. Level always turns to collateral matters, just as he has in his written response. I have come to believe that because I am a single, older, black female, I am not taken seriously. Instead, the business of the contract is substituted with feelings, speculation and kind offers to help me sell the house.  Because he has already been paid, he tires of the matter and exercises his authority by shutting me down, leaving the matter unresolved. He even states in his written response to this complaint that the phone conversations have not been productive and he doesn't see a need for further conversation.  And that's the stand off I've been dealing with for months now. That is the reason I have turned to the BBB.  Because I am a consumer who is dissatisfied with the outcome of the contract I have with Mr. Level to provide a product that I don't have. I am seeking to have this matter settled, based on the contract and on sound, fair business practices.

      I called, and sent a certified letter US mail. The calls and text messages continue.

      All of my phone numbers are currently listed on the DO NOT CALL list on Wed 29 March 2023 I have received a robo text on my cell. I have since written the company t stop. I continue to receive calls and texts from Mr. level. FYI Even though the TCPA was passed in 1991, a year before SMS messaging even became possible, it has been consistently held that the TCPA applies to SMS messaging (i.e. text messages). More to the point, the Federal Communications Commission (FCC), which is the agency under which enforcement of the TCPA falls, has specifically held that: The TCPA’s consent requirement applies to short message service text messages (“SMS” or “text message”) in addition to voice calls.” (FCC Declaratory Ruling and Order, June 18, 2015 at Page 18, Paragraph 27) I will be taking the company to court.

      They continue to call and text even after I reached out and asked them to stop. I am on the do not call registry and had no existing relationship. Many calls come from a private number and it rings once and then they leave a voice mail.

      I signed a contract that was accepted on 04/13/22 with Mr. Level to replace my concrete driveway. On 08/05/22 I asked for an estimated project start date via several emails to Mr. Level and to Josh Newell, the cost estimator. I also went to their website and asked for a start date. So far, no one has responded ! Do they have "vendor remorse" and no longer want me as a customer ? If they can't or no longer want to fulfill the contract I wish they had told me earlier so I could have contracted with another concrete company. Most of the concrete companies that I contacted this month say they are booked thru October/November and probably won't get to my driveway until 2023. What should I do ? Can you find out what's going on with Mr. Level ?

      **. ******* driveway has been scheduled to be completed on 9/30/22.  There have been multiple issues with concrete this year that have caused great difficulty in scheduling concrete especially in Cleveland and East side communities.  We are very sorry for the delay.

      I left you a voice message. I had concrete work done. A day  After they finished I stated my concerns saying that the work was bad. They said not to worry about it.  It will get better with time. Instead a time made it crack and the concrete starting to come off only a month later. I contacted them they said they are willing to fix it if I pay for it. They are not responsible for cracked concrete that they just laid down !!!  I sent pictures and I called but still they are not willing to do the work since I got a big discount on the work ! Though I didn’t get a discount they miss quoted me and just honored the quote since I had a valid argument. I didn’t make the mistakes they did. 10k later I still need my driveway to be done right. If it is 10 bucks or 10000. It’s what they quoted me. I shouldn’t have bad work. I am not even mentioning that they laid down the side walk all crooked, they did not do a good job at all ! Not worth the money I paid. I am asking either refund me or fix it !  Which also at this point I don’t trust their work. Already messed up my yard and grass!

      When installing new concrete there are a number of variables that are outside of the contractor's control.  First and foremost is the concrete mix that is supplied for the job.  We do not control the equipment or the personnel batching the concrete and we must trust the concrete supplier that everything is according to the order.  The other notable variable outside our control is what the customer does to the concrete after the pour and cure time.  If a customer abuses the concrete by putting loads on it early or loads that exceed the strength of the concrete, cracks may occur and these are nothing that can be controlled by any contractor.  For these and some other reasons Mr. Level does not guarantee that new concrete will not crack.  We do not hide this and have it expressly written out in our agreement.  The same agreement that *** ***** signed.  Please see the attached agreement, specifically pages 2 and 13.
