      On September 25, 2022 my husband and I signed a contract to purchase a shed and to have two concrete pads poured with a RTO contract. Three weeks later, we were then led to believe they could not finance both concrete pads and asked for more money to pay for the concrete direct. We were willing to pay for one of the concrete pads, but were then again informed that they could do neither pad. At that time we asked for a refund. The contract that we signed could not be honored and we asked for all of our money back. We have been working with Kody via text. He does not respond most of the time, and he has told us two separate dates that we would get a check back neither of which have been true. He has also told us, that the refund would come from another company, also not true. We paid $1728.60 via cash app to $******************** At this point we believe we have fully been scammed and are completely unsure of who all is involved. We have called the RTO company that had the name on the contract and they informed us that tri-state sheds Direct was the one who would need to refund our deposit.       We are in receipt and response from a letter received today (2/7/23) dated Tuesday, January 31, 2023 in reference to the above named complaint ID; ******** *****. 
       
      Our company specializes in the growing shed barn industry with portable Sheds, Cabins, Chicken Coops, Dog Kennels, Gazebos, Playsets, clubhouses, greenhouses, metal building and garages, through cash deals, financing, or rent to own and more. We are here to meet a resolution to this customers complaint. This dealer location has been open since June 2022, and is growing quickly. We take all complaints serious and would like to make our meet our customer with satisfaction and resolution.  We would like to ask upon receipt of payment that this case be closed and resolved. As to the circumstances, states as follows:
       
      In September of 2022, Mr. ***** contacted our customer service to place an order for a metal garage building through our RTO Company (RTO National). At the time of the purchase Mr. ***** was wanting us to finance the concrete for that unit to be placed onto. After approximately 2-3 weeks we were notified that the concrete could not become part of the financing that it was the sole responsibility of the customer. At the time of the contract that is dated for September 24, 2022, the customer paid a down payment that is required for the purchase of any contract whether through financing and or rent to own program that is offered in the amount of the order of $1728.60, through Tri State Sheds Direct Cash App ID: ********************. The order at that time was forwarded for processing with a lead time of 4-6 weeks. After the customer found that we could not provide them with the concrete for the garage building to be installed, they were given the option of canceling the order. At that time, they decided to cancel the order around the end of the month of November. On December 18, 2023 the customer was refunded back through the processing of a check payment sent to the address on file. The customer stated that did not receive that payment and yet another payment was refunded to the customer (reissued payment) on January 14th, 2023. The customer to this date has not received there payment which is why we are responding to a BBB Complaint with regards to such. 
       
      Our company policy is that all down payments are retained by the local office for the purchase of the unit and the balance is received through the RTO Company. However, when the payment has been refunded and released to the customer it is a matter of the mailing process. If the customer is not receiving the check via regular US Mail, we need to have the customer contact our office to confirm the address on file. However, with review of the BBB Complaint the information on file with the consumer is the same address that we have on file and on the contract with the RTO Company. However, per the contract with the metal company, any customer that places an order signs a contract that their deposit is non-refundable. However, due to the nature of these circumstances with a miscommunication with regards to the concrete being added to the order for financing purposes, we are refunding the customer with a full refund. 
       
      The next step to assure that the customer complaint is resolved is to verify, once again, that the address on file is correct. If that is the case we can issue another payment to the customer, expedited to assure the customer receives their entire refund. 
       
      We would request that the customer be patient through this process to assure everything is completed in its entirety and that the customer receives there entire refund. Due to the concerns of not receiving a second payment that was sent out, and now having to send yet another payment, we will enclose a gift card for the delays.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ** ********* and find that this resolution is satisfactory to me. However, needs to be noted that this tri-state sheds direct has repeatedly ignored our communication attempts and I’m unsure at this time if they will take our call to verify the address! I would like to keep this complaint open until we have sed check in hand and deposited into the bank! This company has lied to us stating that the check comes from another company even though in messages we attached fully admits that payment was for his commission. This complaint was carefully consider and given more than enough time to make right. Thank you for your help with this matter and I will get in touch again should this company not fulfill obligations.
