In July of 2022 we entered into a contract with **** ***** DBA aab Construction to remove our existing deck and install a new 2000 square foot TimberTech deck. After months of back and forth with drawings for the permit it was finally submitted to the city in September of 2022. The contract stated that the deck would be completed within 3 months and no later than November 3rd 2022. From the time we entered into the contract till currently the contractor never completed a full day of work he only came for about 2 to 3 hours and it was always late afternoon early evening if and when he showed up at all. The contractor had many excuses about why he was not coming to complete the deck during the day and why he needed extensions. We were very understanding people and allotted him the extension till November 3rd 2022 as noted in contract revision. After many attempts to have clear communication with the contractor and him not communicating with us about many aspects of this project we had decided to inform him that he was in breach of contract and wanted the money's returned that was given to him at the beginning of this project for the material that never showed up and look for a new contractor to complete this job. At this point he went silent, was not returning any calls text messages or emails. We decided to stop at his home and he would not come to the door even though family said he was there. He was given $35,000 on August 13th to purchase material per his request. He stated many times that he had ordered through ****** Lumber and we had called the corporate office to see if he was telling us the truth and there was no pending order at any ****** Lumber. He also has our previous property (our deck) which he estimated at $5,000, which was partial payment at the time this contract was solidified. There's no more than 15% of this project completed at this time and well past contract deadline with no communication or resolution pending. We have also filed with local police and prosecuter to attempt to move forward with charges.
