      Conversations about project began around 5/30/24, work commenced on 6/27/24 and concluded 7/5/24 after complications arose/strain in communications on how to resolve issues. A total of $4329 was paid. A down payment of $2338 pd on 6/19/24 and bal of $1991 on 7/5/24 after deducting $200 for antenna job undone and est price to haul away old wood that contractor left in grass. Org bal was $2191. Contractor failed to installed cedars and rebar on both sides of upper deck. I specifically pointed to both sides of the deck and verbally stated "both sides" that needed replaced which had disintegrated over the years. The barrier was to help keep mulch from rolling down hill. He only installed the cedars and rebar on one side of the deck. He claimed it was not on the contract. He and I read the statement differently. He never stated that he was not going to haul the old torn up lower deck wood away. At no time did he tell me this was my responsibility until on 7/5/24 when I pointed out the flaws in both projects. He threw something together to fix the issue around the steps of the lower deck but the other items not resolved: cedar & rebar; gaps around upper deck to keep groundhog out; closing gap around lower deck where deck wood and concrete come together. He agreed to fix the cedar & rebar for extra money, but then got upset and declined to do anything. He did agree to deduct cost of me hauling the wood away and antenna job. I wrote him a post dated check since it was holiday weekend and needed time to transfer funds from one acct to another. He falsified the date on the check and had his bank cash it early. On 7/21/24, I noticed holes in the wood of the new deck he laid. I sent him a pictures; he asked three questions which I answered but he never responded. I want the wood replaced where the holes exist, the cedar & rebar installed on the other side of the upper deck which should have been done at same time as the other side and old wood hauled away.

       I am rejecting this response because: I do not need to email him.  I have stated in the complaint what I want done - although I have already paid to have the old wood hauled away the other items are still outstanding.  Having me wait until November is unacceptable and he knows it will be too cold to do anything at that point.  Again this is what I am requesting he do to complete the job:

      I want the wood replaced where the holes exist, the cedar & rebar installed on the other side of the upper deck which should have been done at same time as the other side.
