Date of transaction 8/12/2023 Contractor had a very long and detailed conversation with me to discuss my issues with the work completed including standing water for extended periods of time that will freeze in the winter and cause breakdown of product faster then if job was done correctly. Water does not mitigate in the manner it is suppose to. Large divide in the middle of the work that should have been smooth and was done impropperly. Owner said he could easly come out and fix it with a blowtorch. He came out looked at it and said he didnt see any issues. Then contacted me to let me know he was putting a lein on the house. At this point the business owner is harassing me instead of correcting the iossues as discussed. He was very confident it was a simple fix however is attacking me and my neighbors property now instead of collaborating like the professionals they claim to be. Continues to escalate the situation and get angry and aggressive instead of being productive and correcting the issues so that the product is as described when we were given the quioteBusiness response

This project was for a shared driveway of 6 houses. All of which agreed and signed to have the work done, and the job was started, and completed on September 13th 2023. After completing the job each of the 6 home owners were mailed their invoices which were agreed to be paid upon completion of the job. All of the home owners except for ** ********* completed their payments for their portions of the work and were beyond satisfied and thanked me for the excellent job they received.
After receiving all other payments except for ********* I reached out to him via phone call on October 13th to ensure he received the invoice and had everything he needed to be able to make the payment. When he answered the phone he insisted that the driveway was not done to his standards and that I did not even use a roller on the driveway (which is absurd as we use 2 and the home owner who was in charge of hiring us watched us perform the entire job) and that there were some kind of lines in the driveway (which was also a surprise to hear as I personally walked and inspected the entire driveway before leaving). He then went on to tell me how he didn't want to get the work done to begin with and was pressured by the other home owners and that he didn't have the money. I then told him that we have payment options through financing if he needed it and that if he were not approved I would allow him to pay me here and there as I could understand his situation. He then went from there to telling me that the driveway held a puddle of water which sounded impossible as it was a straight lane with tilt for drainage with a T area which was entirely crowned, so I told him if these issues were there they could easily be mended and I will personally stop out to fix them and I asked him to send me some photos of the area so I could address it, however he refused and told me he would not send me any photos of the areas.
I waited until we had a heavy rain all night and on October 16th I followed up with him to stop out and he said he would not be home but I could go anyway. So I brought the tools needed to fix what he said could have been wrong and upon arriving I seen no water on the driveway anywhere and no signs of any flaws throughout the entire job. So I go to one of the other home owners while I'm there and ask if they may have known what he was talking about and they told me they had no clue that the job was flawless, but said try asking his Dad who was at his house. So we both walk over and his father informed me that he could not see any issues with the driveway either and that he has had many parking lots paved for his business's and that our work looked great and he could not see what he was talking about and that Matthew is very difficult to talk to and if I explain that once its sealcoted it will look even better than it does now.
So while I'm there I texted him and said "Hey I'm here looking and I can't find anything" and he still refused to tell me the area and instead says "I would say that is concerning" so I say "It rained here last night and there is no puddles I see anywhere? That's great news" he does not respond.
On the morning of October 30th I texted him again asking if there is any water on the driveway after last nights heavy rain if he could please send me a photo. He then responded telling me its the same puddle but refused to send a photo and that he was going to get another professional to show me what was wrong and that he was out of town so I told him to have the other professional call me or for him to call me once he is back in town so he can show me what he wanted fixed. He then said he will just take it to the BBB as if he was trying to blackmail me for trying to fix his job.
I then followed up with him on November 6th asking if he was back yet and he did not respond, and again on November 9th still no respond. Then later that day I text him and tell him "I'm trying to make this right for you. If money is the issue if you just let me know that I can help you and work with you on this" He still never replied to that so I waited over another month and on December 11th gave him a call and informed him since I did not receive payment and he does not want me to fix the "issues" I would have to take legal matters. He immediately tried threatening going to the BBB again if I did, instead of just letting me come out and show me his concerns.
All other homeowners had no issues with the work and if he had an issue I sincerely tried all that I could to make it right for Mr Bonfiglio but he refused to show me any photos of his concern and there was no issues at all when I went out to look at it in person.Customer response

I am rejecting this response because: the business did not complete the job as described.The surface was to be flattened with a 2 ton roller. There is a 'speed bump' in the middle of the drive where the two ton roller was not used properly.
There was damage done to existing concrete as well as poor workmanship on transitions, areas where not enough asphalt was used causing depressions and water to collect, as well as very unprofessional communication instead of collaboration.
Business owner said the fix was simple and refuses to come fix the issue. The issue is in fact significant and requires a professional to take an unbiased look at work completed and complete the job in a professional manner. Any expert can see major issues with this job that the owner states is "completed" which is a bold face lie.
