Construction on our home started in April 2021 and we moved into our brand new home in August 2021. In March *************************************************************************************** the basement. The builder, Americas Home Place (AHP) hired a geotechnical firm out of ********, who recommended we put in a 2nd sump system. This sump pump has been undermining our house. As a result, our brand new home has sunken several feet. We have a faulty foundation and have been living in an unsafe home.The builder has taken the position that they did nothing wrong during the contruction of our home. We were promised a safe home and now we will have to completely tear it down and find a way to start over.Business response

Thank you for contacting America's Home Place. This matter is currently in active dispute resolution.
We are working to resolve the customer's concerns however it is inappropriate to discuss the case in this forum during active litigation.

Litigation is a formal legal process where a judge or jury makes the final decision on the case. However, per contract terms we are undergoing Arbitration, not litigation as they are claiming. This has been a 2-yr long process that has not had any resolution thus far.

I did not find any mention of a "pre-dispute clause" in our contract terms. However, the contract specifies that "every claim, complaint, controversy, or dispute among two or more Arbitration Parties that arises out of, relates to, or otherwise concerns [.....] shall be exclusively resolved by binding arbitration and not by judge or jury."Business response

Thank you for following up on this matter.
This complaint is related to an ongoing binding arbitration with ******.
In my opinion, it is inappropriate for *********** to file a complaint until this matter is resolved.
I did timely respond to the complaint within the BBB guidelines.
We cannot further respond to the allegations within her complaint at this time except through counsel as both parties are represented.
As stated, we are actively trying to resolve this complaint.
We have upheld all standards as agreed as a BBB Accredited Business.
I respectfully ask that this complaint be closed or be put on hold for 6 months as we have an arbitration hearing date scheduled for early 2025.
Would you also please list me as the primary Handler for America's Home Place as well as copy ***** on any correspondence.
