***** ******* owner of Hylite Painting Co, gave me a quote of $1600 for labor and materials for my basement which includes drywall for ceiling and wall along the steps and to repair the holes in the basement walls, smooth, clean, and then paint the entire basement (Contract agreement attached). His contract paper (Attached) requires 50% deposit. I gave ***** the required 50% of $1600 which was $800.00. This was on Thursday, February 29, 2024. ***** and his team visited on March 1st for just about an hour and half and left with just a scanty work of scraping on the wall. ***** never showed up again until on March 4th when he sent one of his worker called **** who filled the basement holes with insulation material (Which was the only material bought by *****). And on March 6th, ***** and his wife, ******* came and used my dryloc to start painting the basement. To my greatest surprise, ***** and his wife used the dryloc that I bought for water leak (Waterproofing) for the concrete on the drywall including damaged drywall and holes in the walls were painted by ***** and wife, ******* with my dryloc (Pictures attached). That was not enough, ***** and *******, pulled down some drywall by the step area and left them all over the place causing unsafe condition/environment. On March 7th, 2024, I texted ***** and ******* regrading the unfinished work in my basement and that it was already one week since the signing of the contract because ***** told me that it is going to be done in just one day that he has been doing this for the past 25 years. Up till now, ***** and ******* did not reply to my text message neither did they call me. It was my wife who called ******* to ask when will they finish the work that they have started, it was then that ******* told my wife that "they are quitting from the job." ***** and ******* his wife abandoned the work that was contracted to them and signed by both parties without refunding my deposit. To worsen the situation, ***** did not buy any materials as contained in the contract language except a piece of insulating material. He used my cement and dryloc that was in the house. (Picture attached). Up till today Tuesday, March 12th, 2024, I have not seen nor heard from *****. This is why I decided to contact the BBB where Hylite Painting is a member.

I did quit the job after the consumer changed the lock box on them numerous times. Hylite purchased insulation and caulk for the job. We filled 50-60 holes, insulated, mortared, and painted half of the basement with the sealant. We also tore down the ceiling and tore carpet up tack strips and cleaned the floor. The Drylock was purchased by the consumer for the cement but there was enough for the entire basement and that is why we applied it to the drywall as well. The consumer kept doing work on his own and I was not comfortable with that. The basement was part of a larger scope of work originally and was added on to help out the consumer and we would have been able to do the work in the basement at the same time as the work upstairs was being performed. Consumer then decided to go with a different company that gave a lower bid for the larger scale work and left the basement for us. There is no possible way for the work to be competed in one day and done correctly due to drying and that we never promised it could be. Consumer also has two ladders, hand tools, and an expensive coat that belongs to me that they refuse to give back. The work that we did in the basement was almost complete other than the last bit of painting and we completed well over $800 worth of work plus my items that the homeowner will not return.

      Complaint: ********

I am rejecting this response because:

The Hylite painting owned by ***** has made a lot of false claims in his response to my complaints. For instance, ***** claimed that he cleaned the area (my basement), the pictures that I attached in my complaints speaks for itself. So, I move on. Yes, I changed the lock box code just once (for security purpose because I have a lot material in the house) and when ***** called, he was given the new code immediately. It was not serval times, another false claim. Moreover, I never did any work personally in the basement and the basement is in the same condition that ***** left it except that I swept the steps to enable movements. How can do any work when I have contracted out the work to Hylite painting? Yes, there are tools, ladders and  a coat left in my house but since March 7th that I sent a text message to ***** and his wife, neither ***** nor his wife ******* has called or texted me, how can I withhold the items that he mentioned when he has not asked for them or reach out to me, another false claim. The dryloc that I bought was not for ***** to use. This was because ***** told me that dryloc was not good for the purpose for which I had bought it for (waterproofing a leaking area of the basement) that he will be buying a flex seal which works better than dryloc. Another false claim. If ***** said that he has done more than $800 worth of work, the pictures again speaks for itself because painting a damaged drywall and holes in the concrete walls with my dryloc and not actual paint that I paid for as shown in pictures submitted, is unacceptable by all standard. I personally told ***** that I do not give anyone all the works in my house to do at once when I do not know how good his works look. That, I prefer to give work piece by piece. That when he completes the basement and I see that the work looks good, then I will give him more job. I showed him another contractor who had completed remodeling the bathroom on the 1st floor and his work looks good that it was then that I gave him the 2nd bathroom upstairs. He saw the man and they talked and the man even gave ***** his business card. Just imagine if I had given ***** and his company all the jobs in my house and he quit mid way like he did, what will be my fate in my property and, I believe that he would given the same false stories/reasons why he had abandoned the job. Finally, if ***** was not okay with the basement alone, why did he accept it? Why did he took the deposit of $800 from me and why did he signed the contract agreement on February 29th, 2024. ***** is still bind by the contractual language that he wrote and signed.
      Sincerely,

      ******* * *******

12/27 - 12/30 Paid 600$ for skim coating , prime, and 2 coats paint. Hylite team did not tape off other rooms of house or the carpet in the room they worked on. The house was covered in dust / sand, paint drips on carpet, and compound in carpets. The walls were not smooth or close to what we agreed upon. Hylite requested to continue to work on project, but given the unprofessional prior days / treatment of property consumer denied access. Hylite left consumer with costs to repair walls, deep clean entire house, and required furnace servicing due to sand in hvac system. Consumer has to replace carpet due to paint drips.

Company said they were hired to paint 1 room for consumer.  Consumer gave a down payment of half the agreed amount prior to work beginning.  Company began work, prepped the room, including sanding down the existing textured walls, then applied the skim coat, then sanded the skim coat which tends to expose some of the imperfections in the wall.  It is standard to wait a day for skim coat to dry before applying the final coat of paint.  It was at this point, that consumer told company not to return, consumer said he preferred to finish the paint himself.  Company ALWAYS cleans the dust and splatters when they are FINISHED WITH THE FINAL COAT OF PAINT.  Consumer did not allow company to come back to finish the job and clean up.  Company feels that this consumer is trying to get out of paying the balance.  Company has time and materials invested in this job.  Company can provide a copy of the contract if needed.  Additionally, this home was vacant and the company was told that the floors were being replaced so if paint splattered, it was not a problem. It was company's intent to finish the job as contracted, consumer did not allow company to return, company was very surprised to get this complaint.

      Complaint: ********

I am rejecting this response because:

Hylite was suppose to begin job 12/24 Saturday as agreed. No call no show and business showed randomly at 12/27. Consumer decided give them a shot anyways even though lacking professionalism initially. Consumer paid 500$ down for skim coating which was done incorrectly, priming which was don’t at all, and 2 coats of paint ( consumer allowed only 1 once consumer seen how they conduct business).

After seeing walls with “skim coat, no primer, and 1 poorly painted coat, consumer made note to Hylite that walls were very wavy and not smooth like agreed Hylite response was: “No walls are perfect”. Consumer paid for smooth walls
Consumer then paid final 100$ for agreed price to just cover consumers agreed expensive giving the job was not done. Consumer with confidence knowing Hylite was not able to provide professional service as initially agreed, consumer asked to no longer attend.

Consumer had to redo complete skim coating job, prime walls, and apply 2 coats paint totaling 400$ in cost, but done correctly by myself.

Consumer had to hire HVAC tech to attend to furnace as there was so much sanding dust clogged into system due to not properly sanding with shop vac or taping off rooms. 175$

Consumer has to hire a deep cleaning team to reach every single inch of the house to clean dust / sand. Unknown cost.

Floors are to be replaced at some point in time, but that’s never to the Business’s transgression. As a painter you always cover consumers property.
The company can provide contact. Consumer provided damaged carpet, incorrect skim coating, and poorly painted photo.

Consumer provided correctly looking walls done by myself
Business should not be surprised with a complaint, giving the quality of their work.

      Sincerely,

      ****** ******
