Work completed 6/30/23 at a cost of $2,500. I contracted with M &H Preservation to install a 10’x14’ slab for my new shed. It was critical that my slab at least meets these dimensions. The slab as installed actually measures: 9’ 10.5” W x 9’ 11.75” W x 13’ 11.75” D x 13’ 7.75” D My shed contractor could work with the first 3 dimensions but due to the last one they will have to design a custom shed to fit on the slab. The custom shed can be installed but will not fit perfectly on the slab. M&H Preservation claims this major discrepancy on one side was due to them going by a string and nail area I had marked off to give a rough idea of where the ground needed to be excavated to enlarge my existing 10’x10’ area to 10’x14’. I never indicated that my marked area was to represent the finished dimensions of the slab. As my quote states I wanted a 10’x14’ slab. If proper measurements were made by the contractor this issue would never have happened.Business response

Hello this is ******* ******* with M&H Preservations Phone Number 937-219-6254I received a phone call from a customer Tuesday August 1st 2023 the customers name is *** ******.I contracted a Concrete Shed Pad extension with the customer with the dimensions of 10' x 4'Upon arriving to the job site *** ****** change the dimensions of the contracted work without any notice I asked if something had changed and he said no.So I preceded to explain that my quote was for a 10' x 4' and the stakes and strings *** ****** laid out were roughly 9.5' x 13.5'. *** preceded to act upset and I explained to him I had a $3,000 minimum and when I agreed to do the 10' x 4' extension for $1,500 was because I was trying to cut him a break and we would have to use bag Concrete because ordering a truck for Concrete would be too expensive. Now that the dimension had changed I could no longer do the job for the originally agreed price that 9.5' x 13.5' Concrete Slab would have to be delivered by a truck because it's too big to use bagged Concrete.*** finally admitted to me that the existing shed that was removed that contractor also removed the existing Concrete Slab by accident and that's why the dimensions changed.*** felt like $3,000 was too expensive so once again I felt bad and said I could do the job for $2,500 and he verbally agreed.*** had existing stakes and strings marked out that he said He wanted the Concrete Pad to be. I asked him 2 separate times if that's how he wanted the pad laid out he said yes. My foreman ***** asked a third time to make sure once again he Said yes.We preceded to dig while *** monitored the progress of the job we laid our forms to his strings and stakes *** monitored and had no issues we poured the Concrete Pad and again *** had no issues.A month later I receive a phone call stating the Concrete Pads dimensions were not correct. That the replacement shed would not fit to the dimensions of the pad. I explained to *** that we originally agreed to 10' x 4' Concrete Shed Pad Extension that the dimensions were changed upon our arrival and that he wasn't even going to inform me until I asked why he had strings and stakes laid out bigger than what we originally agreed to and that he thought adding quite a bit more square footage without informing me. That we would still do the job for $1,500 dollars. Then I explained to *** that he laid out the stakes and strings for the new dimensions we confirmed 3 different times that's how he wanted it before disturbing the Earth and setting Forms to his preset dimensions.He was noticeably upset yelling at me while speaking with the Shed contractor that brought the wrong Shed. I offered to come out and have a look Friday August 4th 2023And see what could if anything be done to rectify the situation but also explained that if we agreed to any resolution that I'm about 3 to 4 weeks out because of ongoing obligations. This infuriated *** and he became verbally abusive and extremely mad. I said that I wasn't going to be talked to that way and wasn't going g to argue that I will come and look at the pad and if we agree to a resolution I have to finish my current projects before I can be there. He said don't worry about it that he wasn't waiting the Shed contractor would make it work and hung up the phone. I reject the response from M&H Preservations (*******) because it is not correct and does not state what occurred between ******* and myself. I asked him for a 10’x14’ pad and that is not what he installed.
He states that I had strings laid out delineating the area where he was to install the pad. This is a quote taken from his response, “*** had existing stakes and strings marked out that he said He wanted the Concrete Pad to be. I asked him 2 separate times if that's how he wanted the pad laid out he said yes. My foreman ***** asked a third time to make sure once again he Said yes.” That is not correct. I never had a complete string rectangle laid out in string. I only had a 3-sided string and stakes area laid out. It was 10’ across with 2 4’ legs.
The strings and stakes were installed to show the Beavercreek zoning inspector the footprint of my new 10’x14’ shed which was replacing my 10’x’10’ shed. When the inspector was there the original shed was still there too and my strings and stakes were attached to the end of the shed and ran out 4’ on each side and 10’ across the end.
By the time ******* arrived to install the 10’x14’ pad the shed had been removed and only my strings remained. They only delineated the area he needed to excavate dirt from to make the pad 10’x14’. The area was 10’ across with 4’ legs on each side. It did not make a complete rectangle as ******* states in his response. He is claiming that I had marked the full area of the pad marked out in string. That is just not true. He also stated that I told him the contractor that removed the shed also removed the 10’x10’ concrete pad by accident. I never told him that because the old shed was installed on a wooden base and the guys that removed my shed did take that as well.
I know ******* knew I wanted a 10’x14’ pad because I sent him this email on 6/26/23 (copy is available if needed).

He provided me with a verbal quote that he could do the job on 6/30/23 for $2500. I accepted this quote.
Another issue with his reply is he indicated I wanted a 9’ 6”x13’ 6” pad installed. IF THAT WAS TRUE – and it isn’t why does my installed pad have these dimensions: 9’ 10.5” Wide and 9’ 11.75” Wide by 13’ 11.75” Deep (closest to the house) and 13’ 7.75”. None if the sides agree with what he stated he was to install.
He also stated that he would line up the left end of the pad with my house foundation. That never happened either. Pictures included in my response so that the corner closest to the house is approximately 3” to the right of where it should be and the corner farthest from the house is approximately 6” to the right of where it should be. This also shows that the slab is not square.
I am disappointed by *******’s lack of attention to detail. He not only did not install a 10’x14’ pad as required but the one he installed is not even square and no two sides are the same length. Even going by his assertion that I wanted a 9’ 6”x13’ 6” pad the 9’ 6” sides are actually 9’ 10.5” and 9’ 11.75” (closer to my require dimension of 10’ than his assertion of 9’ 6”), and the 13’ 6” side is actually by 13’ 11.75” and 13’ 7.75”Customer response
