State of Ohio v. William D. Taylor Sr. Inc. dba OG10Ktech and William D. Taylor individually

The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved.  We are providing a summary of the government’s allegations, which have not yet been proven.

On June 20, 2022, the Ohio Attorney General's Office filed a civil lawsuit in Delaware County Common Pleas Court, against defendants William D. Taylor Sr. Inc., dba OG10Ktech, William D. Taylor Sr. Statutory Agent, and William D. Taylor Sr. individually.

The Ohio Attorney General's office alleges the defendants failed to provide gaming and other computer products estimated at more than $100,000, and states that William D. Taylor Sr. sold personal computers and hard-to-find computer parts used mainly for gaming or for mining cryptocurrency, and that consumers searching online for such parts were often directed to the OG10kTech website or store. The lawsuit maintains Taylor misrepresented the business, falsely claiming that the store had special relationships with vendors who could obtain, or currently possessed, highly sought-after products at prices that didn’t reflect the substantial mark-ups seen elsewhere. At the point of purchase, consumers were required to pay in full to be placed on a waiting list for the products, and after waiting several months for delivery, customers began requesting refunds, which Taylor didn’t provide, even though OG10kTech’s return policy stated that refunds would be given for items not received within 45 days, according to the Ohio Attorney General's Office.

The state's lawsuit alleges violations of Ohio’s Consumer Sales Practices Act and its rules – including:

  • Failing to deliver products.
  • Misrepresenting the availability of goods.
  • Selling merchandise on its website that it neither possessed nor could deliver.
  • Failing to observe its duty to segregate purchase monies.
  • Failing to provide refunds.
  • Misrepresenting that the subject of a consumer transaction was available.
  • Misrepresenting the availability of refunds due to the defendants’ precarious financial position.

The state is asking the court to grant a monetary judgment sufficient to reimburse all consumers found to have been damaged by the defendant's alleged unfair, deceptive, or unconscionable acts and practices, and to impose a $25,000.00 civil penalty for each separate violation.

The matter is pending before the court, according to the information in BBB files as of June 30, 2022.

    In order to facilitate a timely and equitable refund process the following has been implemented as of this date 1.13.2022. In order to receive a refund of a refundable order the following steps must be followed.
    1. If you have an order that has NOT been disputed with your credit card processor or has had a dispute declined for age of order, or you have requested a refund with out a dispute you must send an email requesting a refund to REFUNDRELEASE@OG10k.com
    2. You email must include; Name, Order Date, Order Number(s), amount and item ordered. Requests without this info will not be included in this process. This is required regardless of any other email, to any other mail box, or social media request. This new refund mail box is open and accepting requests immediately. No other information should be included in your initial email as this process is being handled by a third party, and forwarded to the Newegg account manager.
    Within 24 hours of receipt of an email to REFUNDRELEASE@og10k.com, the sender will receive a automated response verifying the validity of the refund request and opt in instructions for this process. You also will receive a weekly update as to the amount of sales, and number of refunds processed so that you are informed as to progress.
    Should you wish to exchange your existing order for store credit that can be used either on og10k existing stock of non-gpu components you can send an email to EXCHANGECREDIT@og10k.com, YOU MAY NOT REQUEST BOTH OF THESE OPTIONS. These exchange request ill be processed on a weekly basis.
    OG10Ktech has undergone a complete inventory of remaining component stock,(in excess of 400k in total retail components) and the entirety of this inventory is being released for sale on Newegg.com. A refund account is being setup with 100% of the proceeds of this inventory sale going to the account for refund processing. The 30th of each month refunds will be processed from this fund directly. With the age of the original order being the determining factor as to timing of release of refund. It is expected as of this date, with over 700,000.00 in refunds processed, that the amount of existing inventory will be more than sufficient to process any outstanding requests.
    BASED ON EXPECTED SALE VOLUMNE ALL REFUNDS SHOULD BE COMPLETED BY THE END OF THE FIRST QUARTER 3/30/2022
    During this time and until the competition of all refunds Og10Ktech will not accept new orders for any item. Existing orders that have not been requested to be refunded, shall continue to be filled based on original order date. Og10Ktech is still receiving GPU and other components and will continue to fulfill orders.
