The customers purchased a used travel trailer from Dave's RV on 06/13/2017. The original title issued to the ******'s at that time, had been reassigned from the customer who traded it in. When the ******* applied to Kansas for a Kansas title, they were notified that Kansas wanted a copy of the trust papers from the previous owners. Upon their request, that was provided to them. We did not hear anything from them again until 2019, when they informed us that Kansas did not like the fact that the "Make" on the Title did not match the Bill of Sale (The Bill of Sale showed the model of Canyon Cat and the title showed Puma). Canyon Cat is a brand manufactured by Puma. The ******'s also requested two separate affadavits along with the Kansas affidavit for voiding a previous voided assignment and lienholder. These items were completed and provided to them promptly.
In October of 2019 Mrs. ****** notified us that Kansas would not accept the title corrections and affadavits previously requested. Under the advice of OTC (Oklahoma DMV), we then applied for a loss of assigned title, so it would come back assigned to Dave's RV with the ******'s lien from Bank of the West on it. Therefore, the previous voided assignments would not show at all. This clean and new title was then mailed to Mrs. ******.
We did not hear from Mrs. ****** again until May of 2022, when she arrived in person, with yet another list of corrections Kansas wanted. These corrections were unclear, so our Title Clerk along with Mrs. ****** called Kansas DMV for clarification. Kansas now stated they wanted a lien release from Bank of the West for Dave's RV. This is not an option because the lien was in the ******'s name, not Dave's RV's. One option that our Title Clerk did mention was that if paying off the remaining debt to Bank of the West was a possibility, the ******'s could do that and use the lien release she would receive to provide to Kansas. Mrs. ****** also mentioned the option of just letting Bank of the West come repossess her trailer.
She left with the understanding that she was to notify the title clerk of what she decided to do so that if she needed further assistance, we would be prepared to help in any way we could. She was given the Title Clerks name, phone and email, but once again we did not hear anything further.
On 06/15/22 Mrs. ****** faxed a copy of a Kansas Lien Release to the title clerk (not a regular lien release issued from Bank of the West). She has in fact paid off the loan; however, Oklahoma cannot use the Kansas Lien Release to release an Oklahoma Lien. We asked her to contact Bank of the West and get the proper lien release so that we could request that Oklahoma release their lien. This would then allow her to apply for a clean Kansas title. Once again, we offered to help in any way we could; however, since she is the Bank of the West customer, it would be quickest for her to request the lien release related to the payoff.
Since then, we have not heard any more from Mrs. ******. Unfortunately, this is a case of two State systems not working the same or well together. We are trying all avenues to help resolve this for Mrs. ****** so that she may get her Kansas title. It is worth mentioning that all of this may have been easier if the sale had occurred more recently. At this point the sale date is over 5 years ago. Dave's RV is currently trying to obtain the lien release from Bank of the West on her behalf (a process which takes approximately 20-30 days). Once received, we will do the paperwork needed to release the lien in Oklahoma, which should allow the ******* to get finally get their Kansas Title.
