      Date of transaction: Sep/10/2024 Paid amount: $2,643.39 The vehicle was listed as running and driving and the CA cert of title or Salvage Acq clean was listed on title description; however, on the dmv purchase form, where Autobidmaster was acting as broker, signed the form for the purpose of dismantling the vehicle which has caused several problems for us intending to use the vehicle as described. The car was received on 9/10/24. We got the car before we received the paperwork which means the following fixes were for nothing.The vehicle did not start at the time of delivery and the battery was damaged. I bought a new battery for the amount of $97 just to start the car. After installing the battery the car started but would not move. A mechanic was called and we were told the car needs a new hydraulic pump, which costs between $500-800. Last week on 10/03/2024, I received the paperwork in which I have already paid for which includes the bill of sale, dated 09/20/2024. The *** gives only 10 days after purchasing to transfer to my name and title was available at the time of purchase but now is not. I am now stuck with a car that does not runs/drives , run out of time with the dmv processes and worse if they consider the car was sold just for dismantling. Their page misleads buyers with a statement claiming smooth transfer of ownership and we were sold a car labeled as operational; however, were given a car to be dismantled instead. We want a full refund of all that was done including the repairs, shipping, and paperwork which happened as a result of false advertising. We have all supporting documentation if needed.

      Thank you for the opportunity to correct the facts regarding ******** ****** complaint regarding the vehicle she purchased via AutoBidMasters platform.     

      It might be helpful to understand that AutoBidMaster is not like your local used car dealership. We operate a membership-based online auto auction marketplace to facilitate the purchase and sale of salvaged,damaged, and used vehicles through our website at ************************. Our site contains Terms and Conditions (TAC), which all members have to agree to in order to use our services. 

      Ms. ***** agreed to these Terms and Conditions when she became a member on July 13, 2022, and the updated Terms and Conditions covering the sale of this vehicle on August 29, 2024 (the Agreement).

      As provided in the Agreement, vehicles are listed based on the title type and state that the vehicle has when it is received by an auction. This is explained in the Agreement. Section 7.2 of the Agreement states:

      "Vehicle Information" means any and all information related to a vehicle listed on our Website, whether provided in written, oral, or digital form, including: year, make, model, body style, color, drive type, engine type, cylinders, fuel type, condition, damage amount, damage type, primary damage, secondary damage, mileage, odometer,odometer descriptions, runs and drives status, vehicle identification number ("VIN")or serial number, title or ownership document type, title or ownership document state, title or ownership document history, estimated retail value, actual cash value, repair estimate, estimated repair cost, repair history, total loss history, airbag deployment, keys, any Auction Highlights, and any and all other information (including images) listed on any lot listing page and the "Lot Details" or "Copart Auto Auction Lot Details" for any vehicle.
      The vehicles listed on our Website are not owned by us or our Dealers. As a result, all items of Vehicle Information are provided by the auction seller (via ****** as the operator of the auction). This information is not reviewed or confirmed.
      Titles may change when vehicles are sold and reregistered.  This is also explained in the Agreement.  Section 7.7 states:

      [D]ue to variations in applicable laws and regulations, you may receive a title or ownership document which is different than the title or ownership document that is listed on the lot listing page. 

      As is further detailed in the Agreement between the parties, Ms. ***** agreed that it was her responsibility to research the history of the vehicle and its title and that he is not relying on any information provided by us. This information is detailed in many sections of the Agreement.

      In Section 7.1 of the Agreement, the Agreement provides, [Y]ou agree that it is your sole responsibility to ascertain, confirm, research, inspect, and/or investigate any vehicle and all related Vehicle Information (as defined in Section 7.2 (Vehicle Information Disclaimer)) before placing any bid or purchasing any vehicle using our Services.

      In Section 7.2 of the Agreement, the Agreement provides, [V]ehicle Information is provided as a starting point for your research regarding the history, title, condition, and other information about the vehicle. 

      In Section 2 of the Agreement, the Agreement provides, While we may provide information which has been provided to us as part of our Services, such information is only to be used as an unverified starting point for the research you must do regarding any vehicle you wish to purchaseYou understand that you bear the entire risk that the vehicle does not conform to the information in the listing because the same is provided by the auction and not verified by us. 



      In addition, in the Rules and Policies Section of the Agreement, we specifically detail the documentation that a California resident will receive.  This Section provides, in part:

      If a California resident purchases a vehicle which is located in **********, the purchaser will not receive the title as listed on the lot listing page.Instead, the buyer will receive an Acquisition Bill of Sale. An Acquisition Bill of Sale may be revived into a salvage title when you register the vehicle with the State of **********. The vehicle will have to pass various inspections before it can be registered. Please note that we do not assist with repairs,registrations, or inspections. Whether a vehicle sold with an Acquisition Bill of Sale is registerable in the various states is a determination made by the states and as such, we do not guarantee that a vehicle sold with an Acquisition Bill of Sale will be registerable.

      Ms. ***** also agreed to the terms of the Agreement, when she signed, via DocuSign, the Purchase Agreement Documents.  The Purchase Agreement Documents state that all transactions are based on the Agreement between the parties. The Purchase Agreement Documents states, in part:

      BY SIGNING BELOW, YOU ACKNOWLEDGE THAT (1) YOUR PURCHASE OF THIS VEHICLE IS SUBJECT TO THE AUTOBIDMASTER MEMBER TERMS AND CONDITIONS (***************************************************************) (the "Agreement")

      Ms. ***** signed the Purchase Agreement Documents via DocuSign and as such, is bound by it.

      We are sorry that Ms. ***** is unhappy with the vehicle she purchased via one of our Affiliated Dealers/Dismantlers but as the issues she complains of fall within her responsibilities under the Agreement, no credit or refund is due.

      On October 8, 2024 I won a bid for a vehicle. When I went to change the title to Florida and register the car, Florida tax collector said the dates on the paperwork provided from AutoBidMaster has conflicting dates of sale and that some of the paperwork shows October 8, while other paperwork shows Oct 9. For instance, the odometer statement shows a sale date of Oct 9. The bill of sale shows Oct 8. ******* is stating that the dates cannot go backwards. When I contacted AutoBidMaster, they requested a rejection letter from the state of *******. I sent that immediately. Today (9/23/24) they sent an email stating that the date of sale is 8/8/24 and sent an attachment of the bill of sale. Then they said, "Please have the *** double check, you should not have any issues with registration." This is clear refusal to address the issue and/or resolve it. I understand that the bill of sale says 8/8/24 however the odometer statement says the sale date is 8/9/24. The sale dates conflict with each other. They have already "double checked" and although I "should not" have any issues, there are issues. I would like AutoBidMaster to correct their paperwork, or refund ALL of my money spent on this car, which includes the price of the car, ALL fees and shipping costs.

      To whom this may concern I decided to try autobidmaster as a means to potentially gain owner ship of a car. I read through the rules and created an account. There was a deposit required to be allowed to bid on vehicles, so on September 6 I made a six hundred dollar deposit using money gram. I was allowed to join the auction on the vehicle I was interested in. In the rules it states all deposits are 100 percent refundable if auction is not won. I didnt win and request my deposit back to my account. The money was never returned.

      I am writing to formally address an issue regarding the vehicle I purchased from Autobidmaster. The car was listed as Run and Drive, but upon delivery, it did not start or function as advertised. The delivery driver left the car on the street and insisted that I sign the paperwork. However, I refused to sign or accept the vehicle since it was not in the condition I agreed to.On August 7th, I contacted my bank directly and initiated a dispute, as I could not accept a non-operational vehicle. Unfortunately, my bank informed me that they could not reverse the payment since it was made via domestic wire transfer.Given the circumstances, I am now in the process of consulting with a lawyer to explore my options for recovering the funds. I expect that Autobidmaster will address this issue promptly and provide a resolution.Please contact me as soon as possible to discuss the next steps.

      In the Agreement between AutoBidMaster and *********************, he agreed that he understood that he was purchasing the vehicle on an as is basis, with no warranties, and without reliance on any of the information provided in the vehicle listing.  ********************* further agreed that it was their responsibility to research and inspect the vehicle before bidding on the vehicle.

      In the Agreement, AutoBidMaster explains, and members agree and accept that as AutoBidMaster does not have possession of the vehicle, we cannot and do not make any representations regarding any vehicle.  The run and drive information is not provided by AutoBidMaster but is information provided by Copart, as the company running the auction.  The information is taken in as a part of their inventory when they add a vehicle to their services.  It is not guaranteed by AutoBidMaster, nor is it verified in any way.  We expressly disclaim any representations and or warranties regarding the vehicle.  We require that members agree that they understand and agree to such conditions of all purchases, prior to making any purchase.

      On some vehicles, there is a notation that says Run and Drive?  The question mark is a hyper link to the following information:
      According to Copart, Run and Drive is defined as follows:  At the time the vehicle arrived at Coparts facility, Copart verified that the vehicle (i) started,(ii) could be put into gear, and (iii) was capable of moving forward under its own power. There is no guarantee, representation, or warranty that the vehicle is in roadworthy condition or can be lawfully driven.   There is no guarantee, representation or warranty that the vehicle will (i) start,(ii) drive, or (iii) move forward under its own power at the time the vehicle is picked up at Coparts facility.  It is the Members sole responsibility to ascertain, confirm, research, inspect,and/or investigate the vehicle prior to bidding on it.  Once the vehicle is removed from Coparts facility the Member accepts the vehicle as is. 

      Further, Section 2 of the Agreement specifically states, in part:
      While we may provide information and other guidance as part of our Services, such information and guidance are for informational purposes only and you may decide whether or not to follow it. By using our Services, you understand and agree that neither we nor our Dealers (a) own, control, employ, recommend, or endorse any of the independent third-party sellers who own the vehicles available for purchase using our Services; (b) own or possess the vehicles available for purchase using our Services (unless we are listed as the seller); (c) research, verify,confirm, guarantee, or warrant the accuracy or completeness of any Vehicle Information (as defined in Section 7.2 (Vehicle Information Disclaimer)) for any vehicle available for purchase using our Services; and (d) make any representations, warranties or guarantees of any kind regarding the quality or condition of the vehicles available for purchase through our Membership Services.

      In addition, per Section 7.1 of the Agreement, ********************* agreed that: 
      All vehicles are "AS-IS" and "WHERE IS" and "WITH ALL FAULTS". All vehicles are sold from by our Dealers. We do not buy or sell vehicles. You agree that vehicles sold via our Services are sold without any warranty, express or implied, including but not limited to any warranty of fitness for a particular purpose or warranty of merchantability. You agree that vehicles sold via our Services are not represented as being in road-worthy condition or mechanically sound. You agree that vehicles sold via our Services may have latent, hidden, or undisclosed damage or other conditions that are not immediately apparent or discoverable.  You agree that vehicles sold via our Services may not be fit for use as a means of transportation, may not comply with local, state, or federal emissions standards, and may require substantial repairs at your expense.  You agree that it is your sole responsibility to ascertain, confirm, research, inspect, and/or investigate any vehicle and all related Vehicle Information (as defined in Section 7.2 (Vehicle Information Disclaimer)) before placing any bid or purchasing any vehicle using our Services.

      In the Agreement ********************* agreed that it was her duty to inspect the vehicle prior to bidding on it. 

      Section 2 of the Agreement states, in part, Purchasing a used or salvage vehicle from an online auto auction marketplace presents many risks. It is your sole responsibility to inspect any vehicle prior to placing any bid. 

      In addition, per Section 7.1 of the Agreement, **************** agreed that You agree that it is your sole responsibility to ascertain,confirm, research, inspect, and/or investigate any vehicle and all related Vehicle Information (as defined in Section 7.2 (Vehicle Information Disclaimer) before placing any bid or purchasing any vehicle using our Services. 

      This vehicle was sold on August 6, 2024, and left the yard on August 7, 2024.  Per Section 8.3 of the Agreement, if there is an issue with a vehicle it must be ****** to our attention prior to the vehicle being removed from the auction lot.  As we received no complaint about the vehicle until after it left the auction yard, we have no way to ascertain whether the damage the member claims were present at the time of sale or occurred latter.  As per the terms of the Agreement, as ********************* took possession of the vehicle without brining any concerns to our attention prior to taking possession, he has accepted the vehicle in its as is condition.

      We are sorry that ********************* is unhappy with the vehicle he purchased via AutoBidMaster, but based on the Agreement between the parties, he is not entitled to a refund or other compensation.

      Thank you for your response. However, Im still facing issues with your company. Some of your employees are being unprofessional, and it feels like theyre trying to scam me. I asked them a simple question over the phone, and they hung up on me. Please review the call recording for further details. Additionally, I have not received the car I purchased through Autobidmaster. The delivery was never completed. If you believe the car was delivered, kindly provide me with the signed delivery papers from the customer as proof. While its true that the delivery driver came to my location, he informed me that the car wasnt working and asked if I could help him pull it behind another vehicle. I told him no, as Im not responsible for that. Whatever he did after that is unknown to me, but he did not complete the delivery, nor did he give me the car keys or any documentation confirming the delivery. Please refund my money immediately, as I plan to escalate this issue legally if not resolved. My home security system recorded everything, and I have solid proof of the incomplete delivery.       AutoBidMaster is a motor vehicle dealership.  We sell cars.  Members, if they elect, can arrange transportation for their vehicles with third parties through our services, but those deliveries are provided by those third parties. 

      Per our records, your driver picked up the vehicle on August 7, 2024. Per the terms of the Agreement, once the vehicle leaves the yard you have accepted possession. 

      If you have an issue with the company you hired to deliver your vehicle, you should reach out to them directly.

      We are sorry that you are unhappy with the vehicle purchased via AutoBidMaster, but based on the Agreement between the parties, you are not entitled to a refund or other compensation.

      I am rejecting this response because:

      I am writing in response to Tabithas recent email, and I am truly shocked by the information provided. As you know, Autobidmaster is already a third-party company associated with Copart, yet she is instructing me to contact the delivery person directly, which is unreasonable. There has been no information or contact details provided to me for this purpose.

      Furthermore, I have not received an answer to my original question. ******* also claimed that the vehicle was delivered and accepted at my property, which is completely false. I have home security cameras, and there is no record of any vehicle being delivered to my yard.

      I demand you provide documentation of my signature confirming acceptance of the vehicle. As you know, the delivery cannot be completed without my signature, and the car should be delivered to my addressnot in a public place or elsewhere without my consent.

      Please provide these signed documents to both me and the Better Business Bureau (BBB) to confirm whether or not I accepted the car. If you are unable to do so, I urge you to resolve this issue internally and refund my money immediately.

      I expect this matter to be addressed without further delay.

      I bought a car through autobidmaster.com 2 days ago. The vehicle i bought was listed with only minor dent or scratches as a primary damage. Secondary damage was not mentioned there at all. Considering this, I bid and won. I paid whole amount in a day and Received vehicle. When vehicle came and delivery person pushed the car all the and left it half way because it was not starting, I changed the battery and starter. But still didn't work. I called mechanic and he told me engine in locked. WHAT! It was a big shock for me because I didn't want any vehicle with mechanical issue and refined my search before bidding. I complain them but they are not listning. According to me it's a total fraud that they hide actual damage. I want my amount back

      Section 2 of the Agreement states, in part, Purchasing a used or salvage vehicle from an online auto auction marketplace presents many risks. It is your sole responsibility to inspect any vehicle prior to placing any bid. 

      Per the signed Purchase Agreement that ************** attached with his complaint, ************** agreed that the vehicle as sold as is, where is, with no representations or warranties and subject to the terms of the Agreement.  In addition, on page two of the Purchase Agreement, ************** acknowledged and agreed that, I acknowledge and agree that AutoBidMaster does not make any representations, warranties, or guarantees regarding the accuracy or completeness of any Vehicle Information or any Auction Verification contained in the Lot Details on the auction listing.  Further, on page three of the signed Purchase Agreement that ************** provided with his complaint, he signed that he agreed with the following statement:  AutoBidMaster made no representations, warranties, or guarantees regarding the accuracy or completeness of any damage disclosures or the condition of this vehicle..

      We are sorry that ************** is unhappy with the vehicle he purchased via AutoBidMaster, but based on the Agreement between the parties, he is not entitled to a refund or other compensation.

      They have no way of protecting customers from false bids on auctions or verifying the bids as accurate. I had a max bid on a car for somewhere around 3500$ and somehow the auction ends and the price is at 8000+ not including fees!! Only resolution they offered was to relist the vehicle, in which I had to pay extra fees because they delayed responding to my customer service inquiries with management multiple times. They charge more the longer u go without paying so I had acquired more fees waiting on their response. This company must love free money off relisting vehicles and giving customers the run around to add extra $$ on top. Not to mention if you dont pay the relist fee they threaten & send collections after you which hurts your credit score. Altogether Ill never do business with this company again.Also want to put in that Ive purchased multiple cars through them, and have had multiple issues. But losing $1200 for absolutely nothing in hand is crazy. One car purchased through them is *** swapped. Paperwork says ***** k10 but the truck is a gmc k1500 and u can see the *** plate has been taken out and re put back in.Another issue is the damages listed on cars. Minor dents & scratches yet the engine and transmission will have ticks or knocks.Just stay clear if u dont want to waste your money. Ill be posting this review on Reddit as well.

      Thank you for the opportunity to respond to ******************* complaint regarding the vehicles he purchased through AutoBidMaster, LLC.

      All sales are made under the terms and conditions a person agrees to when they become a member of AutoBidMaster.  ************************* agreed to the terms and conditions on June 23, 2024 (the Agreement). 

      Per the Agreement, members agree that it is their duty to know the amount of the fees and to inspect the vehicles prior to purchase. 

      ****************** purchased six vehicles from us in June 2024.  He does not specify which vehicle he believes he did not bid up to $8000 on but we have reviewed our records and confirmed that all bids came from his account. 

      ****************** states that we charge additional fees for vehicles which are not paid for on time.  That is correct.  Per the Agreement, Late Fees are charged when vehicles are not paid for as per the Agreement.

      All vehicles are sold as is, where is and all sales are final.  The information is listed on the vehicle listing page and is also in the Agreement.  It is also in the Purchase Agreement Documents which ****************** signed. 

      As specified in the Agreement, information provided with a vehicle is only the starting point for a members research and inspection of vehicles prior to purchase.  In multiple places in the Agreement and in the Purchase Agreement Documents, ****************** confirmed it was his duty to inspect the vehicle, that he understood we made no representations regarding any vehicles, and that all vehicles are sold as is and all sales are final.

      Vehicles which are not paid for are relisted and the relist fee is due from the member.  If a member wishes to resell their vehicle, they have the option to consign the vehicle with AutoBidMaster, and those applicable fees are due.

      We are sorry ****************** is unhappy with the vehicles he bought but under the terms of the Agreement, he is not entitled to a refund.

      On ******** the following unfair and deceptive act occurred:Im referring to a vehicle I bought from Copart through AutoBidMaster [ Car Make and ************** Tucson 2018 | VIN: ***************** | Lot#******** | location: ************, *************. Unfortunately, the vehicle doesnt conform to the description on the listing page. Precisely, Minor dents and scratches were mentioned to be its primary damage. Unfortunately, upon inspection, I learned that the engine was completely damaged, and the car wouldnt run/drive. Consequently, the car wouldnt pass vehicle inspection of my state of *************, rendering the car not road worthy. Unfortunately, this calls for engine replacement [refer to the document attached from the mechanic].Listing a car with a damaged engine as having minor dents and scratches as its primary damage is misleading and is considered a deceptive act according to the Code of Federal Regulations, Title 16, Chapter I, ***************** 455 PART 455USED MOTOR VEHICLE TRADE REGULATION RULE. Additionally, according to the Massachusetts Implied Warranty Law: Warranty of Merchantability, I am entitled to full refund or repair at no cost to **** reached out to the company to refund or repair the car as provided by the law. Unfortunately, they refused instead they claimed that all sales are "As is".However, even though they may claim that according to their terms all sales are As is, this is not applicable to United State of Massachusetts [where Copart is located, and the transaction took place] and as per the provisions of the Code of Federal Regulations Title 16, Chapter I, ***************** ***** which allows states laws to override As is disclaimer. As a result of this unfair or deceptive act, I suffered a loss of $5932. Regrettably, all efforts to get this issue resolved with the AutoBidMaster's Director of Business Relations has not been fruitful.

      Thank you for the opportunity to address Ms.******* **************** **************** states that she bought a vehicle from Copart through AutoBidMaster.  We cant say whether **************** has purchased vehicles from Copart but the vehicle at issue was purchased from AutoBidMaster.    

      Prior to purchasing the vehicle, *************** joined our membership service that allows members to buy vehicles from AutoBidMaster and affiliated dealers.  Our process is fully explained on our site:  www.AutoBidMaster.com, and anyone wishing to utilize our services must agree to our Terms and Conditions, Rules and Policies, Terms of Use, and Privacy Policy, in order to use our services.  **************** agreed to these when she became a member of our Services on June 15, 2024 (the Agreement). The vehicle at issue was sold via one Dealers on July 3, 2024, and the vehicle left the auction yard where it was stored on July 18, 2024.

      In the Agreement between AutoBidMaster and ****************, she agreed that he understood that she was purchasing the vehicle on an as is basis,with no warranties, and without reliance on any of the information provided in the vehicle listing.  **************** further agreed that it was her responsibility to research and inspect the vehicle before bidding on the vehicle.

      In the Agreement, AutoBidMaster explains, and members agree and accept that as AutoBidMaster does not have possession of the vehicle, we cannot and do not make any representations regarding any vehicle.  ************** agreement with AutoBidMaster,she agrees that AutoBidMaster does not make any representations regarding the condition of the vehicle.  Section 1 of the Agreement provides in part, By using our Services, you understand and agree that neither we nor our Dealers make any representations, warranties or guarantees of any kind regarding the quality or condition of the vehicles available for purchase through our Services.

      In her complaint, **************** states that the vehicle was misrepresented but this is not accurate because no representations were made regarding the vehicle.  Section 7.2 of the Agreement specifically states, in part:

      Please be advised that the Vehicle Information may contain inaccuracies, errors, and omissions. Please note that what the auction lists as Primary Damage may not be the only damage or the most significant damage applicable to the vehicle in the auction listing. We and our Dealers expressly disclaim all representations, warranties, or guarantees regarding the accuracy or completeness of any Vehicle Information,Auction Highlights and Copart Auto Auction Lot Details. Vehicle Information is provided as a starting point for your research regarding the history, title, condition, and other information about the vehicle. We strongly encourage you to inspect, or retain someone to inspect on your behalf, any vehicle prior to placing any bid or agreeing to purchase any vehicle.

      In addition, per Section 7.1 of the Agreement, **************** agreed that: 
      All vehicles are "AS-IS" and "WHERE IS" and "WITH ALL FAULTS".All vehicles are sold from by our Dealers. We do not buy or sell vehicles. You agree that vehicles sold via our Services are sold without any warranty, express or implied, including but not limited to any warranty of fitness for a particular purpose or warranty of merchantability. You agree that vehicles sold via our Services are not represented as being in road-worthy condition or mechanically sound. You agree that vehicles sold via our Services may have latent, hidden, or undisclosed damage or other conditions that are not immediately apparent or discoverable.  You agree that vehicles sold via our Services may not be fit for use as a means of transportation, may not comply with local, state, or federal emissions standards, and may require substantial repairs at your expense.  You agree that it is your sole responsibility to ascertain, confirm, research, inspect, and/or investigate any vehicle and all related Vehicle Information (as defined in Section 7.2 (Vehicle Information Disclaimer)) before placing any bid or purchasing any vehicle using our Services.

      In the Agreement **************** agreed that it was her duty to inspect the vehicle prior to bidding on it.

      In addition, per Section 7.1 of the Agreement, **************** agreed that, You agree that it is your sole responsibility to ascertain,confirm, research, inspect, and/or investigate any vehicle and all related Vehicle Information (as defined in Section 7.2 (Vehicle Information Disclaimer) before placing any bid or purchasing any vehicle using our Services. 

      On July 5, 2024, **************** signed, via DocuSign, the Purchase Agreement Documents.  In the Purchase Agreement Documents she agreed, under penalty of perjury, that she agreed that her purchase was made subject to the Agreement she entered into when she became a member.  She further agreed in Purchase Agreement Document that the vehicle is purchased "AS IS", "WHERE IS", and "WITH ALL FAULTS", and without any warranties of
      any kind (expressed or implied), including without limitation any warranty of merchantability or fitness for a particular purpose or as to the condition or history of the vehicle, that AutoBidMaster does not make any representations,warranties, or guarantees regarding the accuracy or completeness of any Vehicle Information or any Auction Verification contained in the Lot Details on the auction listing.

      In addition, per the Terms of Section 8.3 of the Agreement, if there is an issue with a vehicle it must be ****** to our attention prior to the vehicle being removed from the auction lot.  The vehicle was removed on July 18, 2024.  We received no complaint about the vehicle we received this BBB complaint on August 7, 2024.  As we did not receive any complaint for almost a month since the member took possession of the vehicle,we have no way to ascertain whether the damage the member claims were present at the time of sale or occurred latter. As per the terms of the Agreement, as **************** took possession of the vehicle without brining any concerns to our attention prior to taking possession, under the Agreement between the parties she has accepted the vehicle in its as is condition.

      *************** claims that Massachusetts law applies to her issues.  This is not accurate. Pursuant to Section 9.2 of the Agreement, Oregon law applies to all disputes between the parties.  In addition, the invoice provided by *************** clearly states that AutoBidMaster is a ********, *************** We do not have offices or locations in ************** In addition, the title was transferred to **************** from the dealership in ****** on an Oregon reassignment form. Under no circumstances does Massachusetts law apply to this transaction. 

      We are sorry that **************** is unhappy with the vehicle she purchased via AutoBidMaster, but based on the Agreement between the parties, she is not entitled to a refund or other compensation.

      I am rejecting this response because:

      1. I maintain my position that the whole transaction took place in ************* regardless of what your terms mentions for the following reasons: 

      Although the transaction took place online, the yard where I picked up the car was located in ************, ** and owned by Massachussetts-based Copart. Please refer to the Lot number of the vehicle on your platform. Additionally, AutoBidMaster explicitly mentions it in the pick up instructions they sent me.

      Furthermore, even before taking the car out of the yard, I reported to the Copart personnel at the yard that the car seemed faulty where he inspected it and assured me that I only needed to change the spark plugs, meaning it was a minor issue. But, unfortunately upon taking it to the mechanic outside the yard it was discovered that the car had a bigger issue. As soon as I learned about the issue, I emailed AutoBidMaster but their response was that as long as the car had been taken out of the yard it cant be returned. However, considering the provision of the law of Massachusetts and Code of Federal Regulations as I quoted in my first writing, As is disclaimer is not accepted and doesnt apply to our transaction regardless of the terms and conditions in the contract.

      2. I disagree that I didnt report the condition of the car until after a month of transaction. For your information, I reported the matter immediately via this email ********************************.

      ***************************** responded to my complaint, and after a few correspondences she rejected all of the options I offered. Instead, she mentioned that AutoBidMaster offered to re-run the vehicle on auction in order to minimize my loss. Unfortunately, I wasnt satisfied with that offer.

      I sincere hope you will revise and consider the options I gave you to minimize potential loss that I may suffer from that transaction.

      AutoBidMaster, LLC provides a membership services, where members of the public can join our services which allows them to purchase vehicles listed for sale via auto auctions.  In order to do business with us, a person must agree to the terms and conditions under which we do business.  ************** agreed to the terms and conditions June 4, 2024 (the Agreement.)

      ************** purchased shipping facilitation services from AutoBidMasters preferred shipping broker, EasyHaul.com, LLC. EasyHaul facilitates the shipping of items by connecting buyers with shipping companies under a ******** Services Agreement (LSA). Per the LSA,the quote provided to ************** contemplated shipping with other vehicles in the container.  As there are no other vehicles at the warehouse that are shipping to the location, our team is working with ************** to ship to a different location or to ship his item in a private container for a different amount. Per EasyHauls records, they have been in regular communication with ************** providing options and updates. 

      We are sorry ************** is unhappy with the delay in the shipping of his vehicle but based on his LSA with the shipping brokerage company, and the limitations of where he wants to ship to, EasyHaul is performing as required under the LSA.

Once you have completed your Wire Transfer please upload the payment confirmation.Before you bid, run a full VIN check at ClearVin.com. This has to be against *** regulations. The worst part is that they start adding charges on Friday and by the time it reaches Monday, it is already $150. Please file a report with the *** as well If you are reading this and they did not refund for their deceptive practices. I shouldnt even owe them cos your stored the car and sent the car late. This is my last car I ever buy from u lot.

      Thank you for the opportunity to provide information about Mr. ******* complaint regarding the delivery of his vehicle.       

      AutoBidMaster, LLC provides a membership services, where members of the public can join our services which allows them to purchase vehicles listed for sale via auto auctions.  In order to do business with us, a person must agree to the terms and conditions under which we do business.  Mr. ****** agreed to the terms and conditions originally on February 16, 2021 and the updated terms and conditions on July 19, 2023 (the Agreement.)

      Mr. ****** purchased shipping brokerage services for vehicle through our recommended shipping provider, EasyHaul.com, LLC.  The shipping services are covered through ******************* Services Agreement (***) with EasyHaul.com, LLC.  EasyHaul.com, LLC is a Washington based vehicle transportation logistics company. 

      We have discussed Mr. ******* allegations with EasyHaul.com, LLC (EH).  Per the *** between Mr. ****** and EH, Section 5.3.1 provides that:

      Vehicles may be stored in warehouses prior to shipment. You are responsible for all Storage Fees charged by the warehouse. Storage Fees begin to accrue daily if your vehicles remains in the warehouse more than ***** days, depending on the warehouse and other factors outside of our control. If your vehicle arrives without proper documentation, you may be charged Storage Fees of up to Fifty Dollars ($50) per day, as of the day of arrival at the warehouse. In all cases, you will be charged daily Storage Fees starting no later than the 30th day after your vehicle arrives at the warehouse.

      Mr. ****** did not purchase his vehicle from AutoBidMaster.  Mr. ****** purchased the vehicle from Copart.  In order to export the vehicle,the title has to be with the vehicle. Copart did not timely sent the title to the shipping company.  As provided in the ***, the warehouses charge storage fees when cars are not shipped timely.  Because ****** did not send the title timely,the vehicle incurred storage fees, which are the responsibility of the owner of the vehicle.

      We are sorry Mr. ****** is unhappy but as he did not buy the vehicle from AutoBidMaster, we do not have control over when the title was sent by the seller to the warehouse.  Under the terms of both the Agreement with AutoBidMaster and the ******** Services Agreement with EasyHaul.com, LLC, Mr. ****** is responsible for storage cost incurred and no amount is due to Mr. ******.
