Hi, I couldn't find where to enter this on the original complaint. I wanted to let you know, Simplicity did reach out today and has agreed to replace the plants and take care of a few other outstanding issues. I want to thank you for your help. I was getting nowhere trying to resolve this on my own. I will let you know when the plants are actually replaced.

We are neighbors to Simplicity Home Construction site. We had purchased our home 6 mos prior to the start of the home build. At the time of the construction we discovered that 1 of 4 of our 46' windows had been damage. The window sits on the side of our home that is considered a low traffic area. Our house sits 5 from the construction of the adjacent house. We witnessed construction workers moving building material, and equipment on our property within close distance from our home. The window that was damage is our bedroom window and we kept the blinds down because of all the workers and had no privacy. Because of the construction and all the dirt and dust generated and covered our windows we were not able to see the damage that was done until after completion and a proper cleaning. I called the warranty ***** spoke with *** who told me it was not their problem because I could not prove it and it was bad business to pay for damages incurred without proof. I was upset by his response and asked for his supervisor. I called ****** the next morning and she came out that afternoon to look at the window. While ****** was here I express my frustration regarding the comment *** made to me. ****** response was to chuckle and say we train *** to say NO, that is his job. I was surprise by ******* response. ****** asked me to get quotes on repairing the window and let her know what I found out. I called her back the same day. She returned the call the next day. She told me she was willing to pay half of the replacement of the window. I told her I did not think that was right, all I was asking for was my window to be returned to the way it was prior Simplicitys build. She tried to blame shift that we were victims from another sources and that her company should not be held accountable for what was done since we had no proof it was them and by paying half she felt it was a generous offer in this situation. I just want my window returned to in original condition

October-current. There is hinging construction occurring with multiple code and OSHA violations occurring. Construction materials blocking egress, sidewalk and left in the street. A porta potty is sitting where they removed the sidewalk. No construction tape or safety marking off the area during construction nor after the workers leave for the day. Construction materials scattered everywhere outside in nearby public areas. Vehicles block access to mail boxes and neighboring driveways.Work being started before 7am and continues until 730pm, work continues on holidays and during weekends. No permits listed. Workers not safety tied off when working on the 2.5 story building. No construction license listed nor visible. Workers were rude when asked about the safety issues. This company doesn't care about their workers, or the neighborhood they are building homes in, also don't follow local code or OSHA rules. Multiple ongoing violations occurring every day.

Thank you for contacting Simplicity by Hayden Homes. We care about the communities in which we build and have considered this claim carefully. Jobsite cleanliness is very important to us, and it is our goal to provide the constant vigilance required to manage these expectations. We do apologize that at times during heavy construction phases debris was not confined to designated areas for pickup and disposal. We appreciate the communication from a community member who contacted us directly that this jobsite needed attention and responded immediately, removing the portable toilet from the right of way, reiterating to our trade partners both the importance of safety and the designated parking areas for construction team.  We believe our working jobsite is in good condition currently.

Simplicity by Hayden Homes also takes safety seriously and places it first and foremost in our communication with our subcontractor teams. As part of our commitment to safety we implement a stringent regiment of required monthly Safety Toolbox talks in which we conduct meetings with our teams on site to keep safety top of mind and a priority. We do rely on our subcontractors to take safety seriously.Given the widespread geographic diversity of our region, our project managers are not able to be onsite daily but, do make regular rounds to ensure the safety and cleanliness of our job sites adhere to our highest standards. We absolutely care about our employees, and our subcontractors and are very receptive to concerns from the community.

In addition to the action already taken, we will place no parking signs next to the mailboxes and direct our subcontractors to park in the construction entrance. We are going to further manage and keep top of mind cleanliness and the impact to the community. Additionally, we will remind all subcontractors of local noise ordinance and request they do not work before 7am or past 7pm.

We appreciate the opportunity to respond and dont take it lightly that a member of the community felt it necessary to contact the BBB.

      Respectfully,
