      on 2/16/2022 numerous heavy equipment vehicles ( chipper, boom truck, logging truck, forklift?, etc. from CWPrice company used my property as a staging location to remove trees on an adjacent property (*** ********************* ****, owner **** ********).  at no time did **** ***** or CWprice company contact the property owner (myself) for permission to use my property. when i returned home that afternoon from Chicago, i told the foreman they did not have my permission to be on my property and that their equipment was damaging my driveway and to vacate my property. the foreman  told me not to be cranky and it took them at least 20 minutes to remove their equipment so i could park in my driveway. when i went to get my mail on 2/18/22 I noticed fresh large tire ruts in my lawn, the driveway was covered in saw dust and wood chips and the asphalt driveway ramp had numerous cracks. i am unable to determine if the heavy equipment caused damage to the level portion of my driveway, although i believe damage occurred. internet research indicates that heavy equipment will damage residential asphalt driveways. i had checked my property on 2/14 before my business trip and the driveway ramp was not cracked, there were no ruts my lawn my driveway was clear of sawdust and wood chips. i reached out several times via their website and email and finally was able to set up a meeting on 2/24 @2 pm. at 1:55 pm i look out my window and see both drew and brett p**** walking down my driveway and going behind my garage, again no permission was giving to the P****s to trespass on my property. Brett p****** denied responsibility for the damages, i replied the damages weren't there on 2/14 and i noticed them after your equipment was removed from my property. i gave my name and email address to brett and asked his insurance company to contact me about repairs. i have received no further contact from brett p****** or their insurance company.

           Good Day, my name is Brett P**** and I am the owner of CW Price Tree and Landscaping.  I am sending you this in response to the complaint # above put forth by **************.  On 2/16/22 we were contracted by the owner of *************************************** to remove trees on his property.  At that time, the owner of ***************************************. advised us that he would ask the owner of ***************************************. for permission to park on their driveway.  I witnessed our customer have a conversation with the occupant of the home, whom he happens to be “neighborly” with while asking for permission.  It was a woman, she advised it was fine.  We proceeded to park 2 trucks a **** **** and a **** **** in the driveway while performing tree trimming on neighbors property.  At lunchtime, I knocked on the door of *** ****** **** and asked the occupant again “if she needed the trucks moved” at which time the same woman (who my client spoke with in the morning) replied “No, not until later on in the day” which I responded to just please let us know when or if they needed to be moved.  At no time, were those vehicles anything but “parked” there.  We did not enter, exit more than 1 time on 2/16/22.  At approximately 2pm *** ***** returned home,  advised us to “get off of his property with all of our equipment”.  At that time, I advised him that we would remove the trucks asap but, wanted to let him know that we were granted permission by our customer and the occupant of the house before we entered.  At that time *** ***** became irate, and we exited his property promptly and left the job being performed. 

      *** ***** contacted us via email at that time we set up an appointment to meet on 2/24 @ 2pm.  I met along with my customer from *** ****** **** **. waited in ********s driveway for him to come out since we had an appointment.  *** ***** showed us the cracks that he alleged we caused by simply “parking” in his driveway.  I advised him that I did not feel those accusations were accurate.  I took it upon myself to get to get another opinion from a professional.  So the next day I contacted the Roadmaster/Supervisor from ******* Township (which is the township In which *** *****’s home is located) his name is

      When I met with *** ***** he advised me he was familiar with those cracks and the “apron/driveway” of the road, because he had been there in the past to address water issues from runoff/drainage issues that had been a previous complaint from the other neighbors on ****** **** **.  He also advised that the “right of way” is 32.5 feet wide and that the “alleged cracks” are in the township “right of way” and were not caused by our trucks driving in and out of *** *****’s driveway 1 time. It was *** *****’s opinion as well that with the “said frost in the ground” that it is not likely for cracking to occur.   **** ***** also advised that he would be more than willing to make a statement or meet with any appropriate parties to explain his professional opinions.

      I am also going to attach photos of *** *****’s driveway that I took on 2/24.  Since I have been in business over 30 years this is a first.  But, certainly not something I take “lightly”.   We are a reputable company who have never run into an issue as such.  I pride myself on the work that I do.  I will stand behind the fact that the “driveway” in question was already in a state of terrible “disrepair” to begin with from the obvious damage that water has caused or lack of maintenance over the years.  I felt confident that what *** ***** was saying to be correct since he was clearly already aware of the damaged areas on ****** **** **.

      I am rejecting this response because:of numerous issues with Brett P**** (CWPRICE landscaping and tree services) response to my original complaint.
      As the company owner and a local contractor, Brett P****, should be well aware of SECTION 3503 of the STATUES of PENNSYLVANIA, which to summarize: concern legal access private property rights; land owner rights; trespass; criminal trespass; and defiant trespass. Brett P**** and his client, **** *****, failed to secure permission from the landowner to use his property on 2/16/2020.so the damages caused to my property by his crewmen, heavy equipment are his sole responsibility to make ammends. mr p**** was informed he did not have premission to be n my property on 2/16 yet days later i observedhim and **** ***** walk ~ 80 feet down my driveway and go behind my garage, again without my permission.
      mr p****s “professional” ( **** *****) is the Roadmaster. he is not a Professional and/and or Registered Civil Engineer. the roadmaster over sees, snow plowing, pothole patching, etc. mr p**** did not submit a written report from ** ***** so i am unable to comment. there may also be a confli  of interest since **** ***** , is listed as an employyee of **** ***** on the ****** township webpage.
      photos submittedby brett p**** show the apron after his equipment used my property, not before. also my research indicates the a residential asphalt driveway can only withstand 8000 pounds before damage occurs.both of the heavytrucks used by B p**** weigh well in excess of 8000 pounds. and my asphalpt driveway was substantially less that 3 inches of asphalt and not rated for commercial vehicles. 
      without documentation of ***  ******’ conversation with mr p**** it is difficult to respond. although in mr p****s response, he stated that ** ***** told him that with “the said frost in the ground it is not likely for cracking to occur”. “ Not likely” does not rule out damage caused by the heavy equipment. 

      on 2/24/2022 i meet  with brett p**** and explained that what i required from him was to fix the sloped apron that was cracked from his heavy equipment.  i was not looking to get a new driveway, nor was i attempting to be reimbursed for the resodding/leveling/reseeding of my lawn or the cleanup of the driveway. the apron was not installed by the township and was installed  new~ 4 years to allow residential vehicles to enter my property.  

      since brett p**** will not accept responsibility for damages caused by his equipment, when he cut and removed 8-11 trees with up to 40 inches diameter along my ~80 feet  driveway. i can offer a limited time resolution which will only involve some labor on brett p****s part. i have 2 hard wood (maple?) trees that he can  cut to ground level and brett p**** can either remove the wood or cut pieces 18-24 inches and place it on my wood pile at the corner of my property. one tree  is along ****** **** ***** and one is behind my house. there is no truck access to the tree behind my house - it has one trunk with two branches approximately 30 feet high and diameter care would need to insure no damage  occurs to my septic system. the road side tree my be 25 feet high and care would need to be taken to insure no damage occurs to my wood and metal fence. this tree cutting desired outcome would need to be completed in entirety by business close 4/20/2022. photos below.
