Dear ******************:
I am the managing attorney of Ratchford Law Group, P.C. My office specializes in the legal collection of delinquent accounts. We received your letter and the above-noted complaint. We deny that we harassed ************** or violated the Fair Debt Collection Practices Act in any manner.
The account at issue is an account of **. ****** husband that was placed with my firm in November 2017. After receiving permission from *********************** to speak to his wife about the account in December 2017, we arranged a $50 payment arrangement that was to begin in January 2018. When the payments were not made as agreed, we initiated a lawsuit in April 2018 and a judgment was entered on May 16,2018. My office spoke with ************** in May 2018 and arranged another $50 payment arrangement. Payments were made to the pursuant to the agreement through June 2019, but then the payments stopped.************** contacted us again in April 2021 to reestablish the payment agreement. Despite renewing the agreement, we received just one additional payment of $150 in August 2021. We spoke to **************** again in October 2022 in which she said she would start making payments again, but we did not receive any. In April 2023 my office initiated a writ of execution on **. ****** bank account in an attempt to collect on the judgment.
My office denies that we harassed ************** or violated the Fair Debt Collection Practices Act in any manner. To the contrary, in the years preceding the bank execution we placed fewer than one call per month in our collection efforts. We also deny that we were rude towards the ****** in any manner at any time. To the contrary, we acted with professionalism and worked with the ****** on multiple calls to find a reasonable repayment arrangement. We understand that the bank execution is not what ************** wanted to happen. However, after years of attempting to collect the judgment owed to my client, we took the lawful action required to protect my clients interest.
If you should have any questions or require additional information, please call me at ****************************.
Thank you for your attention to this matter.Very truly yours,
***************************, EsqInitial Complaint

On Friday May 19,2023, I received an Alert from *** bank stating that my three accounts had been frozen. I was told it was done by a collection company. I was told by the bank that this company took the $ 508.59 that was in these 3 accounts combined. Ratchford is trying to make me pay 40,833.40 on a account that I have no knowledge of. I have tried since Monday 5/22/23 to find out what this is about but they won't talk to me until I give them my personal information. Which I refuse to do, I know I don't owe anyone that amount of money. My personal information has already been compromised, also I received a scam alert about this same situation.Business response

We deny that we violated any of *************** rights in any manner or that our collections attempts are any sort of scam as alleged by *************
The account at issue became delinquent in or about January 2007. A lawsuit was filed to recover the delinquent amount and a judgment was entered against ************ in a ****** County Court of Common Pleas at Docket No.:*****-**** on October 21, 2008.The account was placed with our office post-judgment for collection on October 23, 2019. Due to Covid-19 our post judgment execution attempts were delayed until recently when we filed and served a writ of execution upon her bank. On May 22, 2023, ************ called our office but refused to verify her identity. As a result, without confirmation that we were indeed speaking to ************, we terminated the call. **. **** called our office again on May 24, 2023, and verified her identity. A representative discussed the case with her and agreed to provide verification of the debt.
We understand that this is an old judgment that ************ may not remember. We assure you that we are willing to discuss this with her to find a reasonable resolution. Moreover, we are confident that we took no actions that are not permitted by the Fair Debt Collections Practices Act.
If you should have any questions, please call ******* Ratchford, Esq at ****************************.
