      Signed contract August 21, 2021, and Phil M****** kept telling me he'd try and do the work, but kept making excuses & never did.

      In reference to ********* ** ********* Prior to signing the contract *** ********* was informed numerous times that we as a company were very busy and that if she was looking to sign a contract late in the season this may have to be a spring job. *** ********* did explain her leg injuries and the urgency of this job. She was told that we would try to get her job done before the cold weather hit but could not guarantee the job completed by then as we had other clients signed prior to. The contract was signed and we have communicated with **** ********* several times about the job. Towards the end of October Phil had called and left a message for *** ********* to call him back. The next time we heard from her was on January 10, 2022 to inform us that she had searched for, signed and had another contractor do her job and completed by the middle of November. *** ********* had not made any attempt to legally or otherwise null and void her current contract with M******** Masonry prior to this. Communications had stopped on her end until just recently. There has not been any exchange of monies.

       At this time I don't know what **** ********* wants as a resolution.
      M******** Masonry respects each and every client. Our goal is to focus on individual jobs so as to ensure each project is done in a manner that would prove to be a lasting credit to our clients and our company as well. We didn't get the opportunity to provide this level of service and workmanship in the weeks between when **** ********* signed with us and then signed with another contactor.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********* and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      Thank you for forwarding to me the response from M******** Masonry.  At least they responded to the complaint.  I do know they were busy, but Phil M****** did string me along making me think he probably could do this job, but had lots of excuses. If they truly had that many people lined up ahead of me, how could they even take me on??  I wish they'd had the courtesy of telling me early that they were too busy or just didn't really want to do the job; and it would've been easier & more timely for me to find someone else. However, his wife did tell me they'd give me some priority due to my circumstances, so I held onto that.

      As I told Phil M******, I did have someone earlier that could do the driveway, but my front steps also needed refurbishing, and he didn't have time for that. However, Phil said he could do both. That's one reason it was Aug. by the time I signed the contract with him. There was a mistake on the first contract they sent, and another had to be sent.  I couldn't print the contract from my old computer, but Mrs. M****** said she'd mail me one.  I never received it, and had to go to the library to print it and mail it to them. All these things contributed to the contract being sent as late as it was. But I thought surely in a couple of months they could do the job. I wonder if those other jobs weren't larger and offered more money, so my "priority" was dropped.  I should've stayed with the 1st contractor as at least he could do the driveway.

      It was a dire need to have this done last yr., as I tried make the M******s understand. I couldn't drive over the sunken area that collects rain & snow & freezes;  and with our frigid winters, it's just about impossible to thaw ice that deep even if I hired someone.  I certainly couldn't do that myself as I'm almost 76 & with these leg injuries I can't do what I could do a few years ago. My back tires have gotten stuck in the low area at times, & I had to call 911 to help me get out. That was before my injuries and afterwards, I couldn't drive for a good while & had to have help from my daughter and a caregiver.  I'd be unable to get out and purchase groceries and other supplies. Even having deliveries wouldn't be feasible because I can't get out & shovel the steps or driveway so a delivery person could safely make it to the house.

      As I'd said, I did find someone after many calls, with a notice of a few weeks, with someone that understood and sympathized with my situation.  He has a young family with 5 children and I'm sure at least as busy as Phil M******, and this man also works on weekends as he's so busy. He did the job in one day.   So as I asked the M******s, how could this young man come and do my driveway with a few weeks notice, when Phil couldn't after a few months?    

      Phil did call sometime in early Oct., and told me that he'd call in 2 weeks to try and set something up, but I never heard from him.  It's stated in their correspondence that he called in late Oct. and left a msg, but I never received a msg from him at that time.  I check my messages very often and also the caller ID, but nothing from him.  Also, as stated when I called him in Jan., it certainly sounded like he hung up on me.

      I am grateful that some people care when others have needs. 

      The only RESOLUTION from them that I could possibly hope for is that they have a little compassion on needs of others, esp. the elderly.  I hate to think that others might have the disappointment I experienced and also the fear of not being able to get out of the driveway to get needed supplies, or being inured if trying. They may not have dealt that much with the elderly or people with injuries and not understand.  This world wouldn't be so cruel at times if more people would just practice the "golden rule".

      Thanks to all in the BBB for your time, and I'm sure you're ready to move on to other issues.
