Jonny concrete was paid in full at the end of 2021 . Within 2 months concrete porch cracked and it was winter Jonny said I will fix in spring of 2022 and finish the rest which was stacking of the stones he started , I paid $1000.00 for that and finish the handrail which was 2000.00 (I paid) and finish the staining of the driveway and steps which I paid over $40,000 for all of the other work. His excuse was weather was to hot in 2022 to finish. We will gets texts messages saying I will finish. Last we received one may 2023 saying I will contact you in June . On December 17, 2022 I communicated text message a statement expressing my need to cancel the contract (summarized below):-Jonny Concrete LLC hired to remove existing slab and lay new concrete for related deck project at ****************************, Archbald, PA *******. I stated he was no longer authorized to perform any work on my property. My reasons for cancellation of our attached contract are as follows:-Jonny Concrete LLC did not complete work by verbally agreed deadline (before Winter of 2022).-Jonny Concrete LLCs lack of communication when asked to start (documented text messages that were ignored during valid work opportunities).-Jonny Concrete LLCs inability to commit to the previously agreed schedule (when the deck builder had downtime or any time after he was finished before Winter).-Jonny Concrete LLCs did not complete any work since the signing of the contract on 09/03/2022.-Jonny Concrete LLC has made future work on this project more difficult by delaying concrete pour until after deck build (not part of original verbally agreed plan).I have retained records of our cellular text message conversation (his preferred method of communication) and schedule details and dates of the missed work opportunities (accounting for good weather scenarios) for future reference. On December 17, 2022 I asked for my initial deposit of $3250.00 by the end of December 2022 via text message. I have yet to receive my initial deposit back. I sent him the summarized information below in the mail with a copy of our original contract noting my desired cancellation, but I am unaware if he received it. Since then, he has confirmed he has received the messages and has promised 3 times to return my initial deposit since February 1st 2023, but has yet to do so.
