I have a contract to receive 3 hour long workout sessions per month for $660/month. I have not been receiving services that I have paid for. So far I have paid for 4 months of personal training and only received 3 months of training. Workout Anytime is in breach of their contract with me. The trust and character of the personal training manager has been absolutely lost in this endeavor and I am not wanting to complete the contract.

      10/13/2022

Business Response /* (1000, 5, 2022/10/04) */ The attached personal training contract does not specify the frequency of workout sessions nor with a specific trainer. The member pays for the sessions to be used as they are able. The member has the sessions they pay for which can be scheduled at anytime. I have attached the copy of the PT contract for reference. Prior to this the personal training manager offered several other concessions to the member as in freezing the payments an extra month outside of normal company procedure due to the member stating he was financially overextended. And during this dispute and as a professional courtesy the personal training manager offered a 50% buyout to satisfy the financial responsibility but that was declined. As of the date of this response (10/3) The member is in default of the agreement as the Sept payment did not go through. Consumer Response /* (3000, 7, 2022/10/04) */ (The consumer indicated he/she DID NOT accept the response from the business.) The brochure clearly shows 3-1hour workouts per week at $660 per month. That is what my contract is for. I have the bank statements that prove I paid all of my dues except for the last 2 months. I am current. My account was on a 1 month freeze for the month of September. I have had four payments for my monthly dues for my personal training sessions that have cleared. The response has clearly been made in haste since there is plenty of incorrect statements in it. I have been met with unprofessionalism from the fitness manager ******, as well as misled & lied to about my sessions and personal fitness. Almost a month went by before ****** contacted me about why I hadn't been scheduled for training. I replied that no one had contacted me about setting up trainings for the month yet. My personal trainer was supposed to have contacted me. Hearing that, she immediately put my personal trainer on the phone to schedule sessions. The next day my personal trainer contacted me to let me know that he was no longer going to be with the company. I immediately went into the gym to ask about canceling my 2 months remaining in my contract. I have already paid for for months and only gotten three months worth of training. I was 11 sessions behind. The contract I signed specifically states 3 1 hour long sessions per week each month for 6 months at $660 per month. There is nothing that showed the sessions were supposed to be whenever they were set for like the person in the response is claiming. I was supposed to be contacted by The Fitness Manager ******'s supervisor, who has yet to contact me and it has been a week. Business Response /* (4000, 9, 2022/10/10) */ Workout Anytime has resolved the issue and went ahead and cancelled both the Personal Training agreement as well as the membership. Consumer Response /* (2010, 13, 2022/10/12) */ (The consumer indicated he/she DID NOT accept the response from the business.) There is no truth to the statements that have been made by the person responding. However I was contacted by ***** the GM of the gym who informed me that my contract was ended and my membership would be canceled upon my request. This Gym doesn't only claim falsehoods about the contract but it also doesn't know how to treat its customers I will not be paying any more to this gym. I am going to proceed to the federal trade commission for further complaint

Business Response /* (1000, 16, 2022/08/08) */ We have attached a copy of the original agreement stating that cancellation requests have to be received via certified mail.
