These claims may come to our attention from our internal review of advertising, consumer complaints, and competitor challenges. BBB asks advertisers to prove their claims, change ads to make offers more clear to consumers, and remove misleading or deceptive statements.
On June 23, 2023, BBB contacted First Day regarding advertised claims on their website https://firstday.com and Facebook page https://www.facebook.com/hifirstdaysf.
First Day advertised bioavailability claims. BBB Code of Advertising states claims relating to performance, energy savings, safety, efficacy, or results for a product or service should be based on recent and competent testing or other objective data. BBB requested First Day to substantiate the bioavailability claims with recent, reliable, and competent studies or other objective data to substantiate the claims. Furthermore, bioavailability claims require human testing as it measures the absorption of a product into the human body. First Day discontinued the advertised claim.
First Day also advertises testimonials and endorsements from professionals and consumers. BBB Code of Advertising states in general, advertising which uses testimonials or endorsements is likely to mislead or confuse if it is not genuine and does not represent the current opinion of the endorser. If a consumer's experience represented in an advertisement is not the typical experience of using the product or service, unless the advertisement clearly and conspicuously discloses what the expected results will be. BBB requested First Day to disclose the connection between the, and the testimonials. First Day modified its website to disclose the connection between the endorsement.
BBB also requested First Day to substantiate any claimed results advertised.
BBB Code ofAdvertising states the primaryresponsibility for truthful and non-deceptive advertising rests with theadvertiser. Advertisers should beprepared to substantiate any objective claims or offers made before publicationor broadcast. Upon request, they shouldpresent such substantiation promptly to the advertising medium or BBB.
First Day discontinued the claimed results.
